The Deepak J Saga: Now a MACC Lawyer is allegedly involved

The Malaysian Anti-Corruption Commission (MACC) was today dragged into a row over questions surrounding a lawyer on its operations panel who is alleged to have drafted private investigator P. Balasubramaniam’s controversial second sworn statement on the 2006 death of Altantuya Shaariibuu.

Zaid IbrahimFormer Minister Datuk Zaid Ibrahim suggested today that a key member of the MACC’s five check-and-balance mechanism responsible for closing the file on the case may have had a direct hand in doing so, fuelling questions on the extent of a possible cover-up into the explosive crime that has put two elite Police commandos on death row and sent the private investigator into exile.

The lawyer-turned-politician wrote in his blog that both the Attorney-General and the MACC have “conveniently refused to investigate the allegations made by the private investigator P. Balasubramaniam, who apparently got the information from Abdul Razak Baginda, and whose claims have been corroborated by carpet merchant Deepak Jaikishan”.

He reminded Malaysians that Balasubramaniam ― popularly known as PI Bala ― had made a second statutory declaration (SD) cancelling his first sworn statement made a day earlier that the police had suppressed key evidence.

“This second declaration was prepared by a well-known lawyer whom he did not know. Deepak named this famous lawyer in an interview with Harakah. If one probes a little further, one will find that the same famous lawyer sits as a member of the MACC’s operations review panel,” Zaid, a one-time de facto Law Minister during the Badawi administration, wrote. However, he stopped short of naming the lawyer.

“It was this panel that decided there was no evidence to investigate the allegations made by either Bala or Deepak,” Zaid added.

Lawyer Americk Singh Sidhu, who represents the private detective now in hiding, told The Malaysian Insider when contacted that Balasubramaniam had never told him the identity of the lawyer as the latter was unaware of the person’s occupation. However, he said the identity of the lawyer could be found out easily from the MACC’s website, which lists eight people as members of its Operations Review Panel.

“One of those eight is a lawyer,” he told The Malaysian Insider when contacted.Zaid’s allegation comes on the heels of political activist Haris Ibrahim saying yesterday he will lobby the Bar Council to reveal the identity of the senior lawyer he said had drafted Balasubramaniam’s second SD.

Haris, who no longer practises law, said he will file a request with the Council today, citingHaris Ibrahim grounds that the senior lawyer had committed “the gravest of sins” by drafting the statutory declaration (SD) without first consulting Balasubramaniam.

“There is sufficient evidence to allow the Bar Council to investigate this matter. If the Council views this as seriously as I do and many other senior lawyers (do), they will get to the bottom of this fiasco once and for all,” Haris told The Malaysian Insider when contacted here.

Haris explained that while in the past the identity of the lawyer behind the SD had remained “mysterious”, it was recently openly revealed by Deepak himself, during his disclosure in an interview with PAS organ Harakah.

During the interview, which was recorded and uploaded by Harakah on its “TVPAS” channel on YouTube, the carpet dealer had let slip the lawyer’s name when explaining his role in the second SD.

But in the 14:39s clip, the name was muted out.“Still, this means that enough individuals know the identity of this lawyer ― Deepak, PAS TV, and definitely, the editorial team. We can now kick off an investigation and reveal this person,” Haris said.

On the activist’s blog on Friday, Haris detailed his intention to write to the Bar Council and also threatened to reveal the lawyer’s name if his request is not met after 14 days.

He said he knows the identity of the “Tan Sri” lawyer from three independent and reliable sources, and would not hesitate to spill the beans if needed.

PI BalaBalasubramaniam’s second sworn statement came a day after his first on July 3, 2008, regarding Altantuya’s 2006 murder, for which two elite police commandos have been convicted and are facing death sentences.

In a harried press conference then, Balasubramaniam (left), accompanied by lawyer M. Arulampalam, came out to withdraw his first SD, claiming it had been signed under duress.He then produced a second document, which he claimed later in 2009 had been prepared by another lawyer without his consultation.

Deepak hit the headlines when blogger Raja Petra Kamarudin exposed his role in facilitating the private detective’s second SD to repudiate the first statement.

  4. Din, you should be more bothered by people like Mahathir, who today declared that Lynas plant is safe; like how does he know.

    We should set a petition for him to move his family, especially his grandchildren to live by the Lynas plant. While Mahathir issues thoughts of morality and those of religion, just remember, here is a muslim whose son owns a substantial share of San Miguel Corporation; the king of beers (arak) of the Philippines.

    Mahathir would issue statements about the worst of the Jews; but at the same time, God Jehovah or Allah prophets in Mahathir’s twisted mind must have required that Muslim own stock in haram products especially arak products.

    It is people like Mahathir that makes me sick, not Budak UMNO.

    Budah UMNO is a lackey out to spin positives for a government not caring whether our leaders kills their lovers, whether our leaders kill the most innocent Malaysians like Kelesau Naan.

    In UMNO and Mahathir, self interest comes first. And Mahathir has taught many Malays the art of corruption. Budak UMNO is simply one of the millions of fruits ripening in Malaysia courtesy of Mahathir.

    Like it or not, that is the key problem facing Malaysia; a country with citizens more interested in self enrichment and where morality and human compassion has been removed from their souls.

    Former Prime Minister Dr Mahathir Mohamed has only himself to blame for building a nation which he believes is not ready for change.

    Dr Mahathir had implemented policies which had the effect of cowing its people into accepting things as they are, notwithstanding the negative impact such policies had on its people and nation building.

    The Mahathir administration capitalised on authoritarian rule where the rakyat were put in fear of political repercussions if they went against the system.

    Rampant and blatant political abuse of laws such as the ISA and the Sedition Act against those who spoke up served as a dark reminder to all of the ramifications of taking bold steps in pursuit of justice or change.

    The manner in which Dr Mahathir dealt with the judiciary in 1988 spoke volumes about the freedom of judges to do what justice demanded of them. It was the beginning of the end of concepts such as independence of the judiciary then from.

    Policies which led to large scale financial abuse in terms of how economic wealth and opportunity was to be divided and used amongst Malaysians advanced by the Mahathir administration mustered even more the ‘accept, obey and be grateful’ attitude onto our people, with certain favored individuals being given preference over others.

    In education, his government failed to develop intellectual excellence nor put into place a system which would have put our generation today on par with most others in our surrounding regions, let alone the rest of the world.

    Dr Mahathir put into place a system where the people of this nation became even more divided so much so that now, it appears to him that pushing forward the call for change and liberalisation could result in tensions which may “spark racial unrest”.

    Dr Mahathir fails to recognise the fact that despite his authoritarian rule, Malaysians by and large persevered and pushed on for change, the first of which success saw the end of his rule as Prime Minister of Malaysia.

    The struggle continued and has now reached the point where most Malaysians are no longer afraid to take controversial nor bold steps towards liberalisation. This was reflected, amongst others, in the movement calling for free and fair elections.

    The current regime, under pressure by this awakening, is not obliging us with reforms for want of love for change but more so for fear of losing political power which could thereafter result in major shifts in policies which will see them accountable for their shortcomings in their 55 years of rule.

    Frankly, based on what is known now publicly and it must have been known by insiders in UMNO for some time, Najib should never have been allowed to take office in the first place. The fact no one in UMNO/BN stopped to think about STANDARDS that should be imposed on national leadership by allowing Najib to rise destroys UMNO’s claim of right to rule the country.

    It is simply ridiculous for the rakyat to have to tell a political party with so much power like UMNO that it needs to impose a modicum of standards of conduct and performance on its leadership.

    Mahathir betrays his possibility of idiocy by actually thinking that Najib is better than Badawi/KJ. He destroys claim of vendetta against Anwar by supporting a failure as big as Najib.. How can Najib possibly be better than all the charges he leveled against Anwar?

  11. What’s the fixation with the out-of-court sworn statements?? They are not evidence without the maker testifying in court.

    As for the lawyer said to have drafted such sworn statement knowing it to be less than the truth, he has a lot to answer for – with his law license.

    Nowadays it is very difficult to vote/select a political party with honest, clean, dedicated, committed and sincere political leaders and politicans, morally, religiously and spiritually. We can’t find one in USA, in Europe, in the Middle East, in Africa, Australia and in Asia, can we?

    Do we have them in PKR, PAS, DAP, UMNO, MCA, MIC, PPP, Gerakan and others. Semua pun sama – from the same Sekolah Inggeris, Sekolah Kebangsaan, Sekolah Agama, same colleges and universities, local and abroad, same mindset – family, money, assets, shares and properties and janji-janji yang ditepati dan yang tidak ditepati.

    Can we form a new political party with members who are 100% healthy, honest, sincere, clean, dedicated, committed, trustworthy, religious and with high moral behaviour and with no self interest and not corrupted, straight forward, strict but firm?

  16. I can’t say more than what GSD or James Chua have stated on Dr Mahathir. The younger generation will assess him objectively. How ironical it was for Anwar Ibrahim to have worked so hard with my own knowledge to ensure he won against Tengku Razaleigh in 1987.He won by just 42 votes. The damage he did as PM outweighs the positive he did. Our Dato Din will not go along with that. Let it be.

    The Perak State Legislative Assembly is in session now. Zambry tabled Budget 2013 yesterday. The debate that followed is very lively. So many questions are being directed at Zambry as to why large tracts of land are being given to Umno cronies without any screening. The lands in question are in Kamunting, Sitiawan and Lumut.

    Incidentally, prime lands around Sitiawan are being parcelled and given to Umno cronies for a song. The reason is obvious – payments for Umno warlords for their undying support.

  21. Putting the 2 police commandos on death row is a very unjust decision from whoever responsible in giving the judgement. The prosecutor failed to prove the mens rea to charge murder beyond reasonable doubt. It is unreasonable to claim that the 2 police commandos commited murder looking at the facts that explosives are used? What happened? They hated Antatunya so much?. If somebody paid the commandos to murder,then who has conspire? Why closed the investigation?

  25. UMNO under the present leadership has long lost its legitimacy to govern. The only reason why it is still standing is that Malays being conservatives and traditionalists fear the unknown, having been made to feel insecure over an entire generation, they feel they will have to take the rough with the smooth, Yes,in their view shaped by years of socio-economic engineering of the kind UMNO has laid claims to,, these politicians like politicians elsewhere are corrupt but so long as they keep it within limits, it is a price they as voters feel they will have to pay. Pakatan is an unknown variable with no track records – not at the federal level – and Anwar according to this school of thought and his breakaway group are losers from UMNO except they are now in cahoots with the opposition and that is a no-no. True. UMNO plays the same game with its BN components. But with Pakatan. there is PAS – the weakest link. And a coalition is only as strong as its weakerst link. Not good according to them. In the end they will make a mess.

  26. To me Pakatan is offering a re-make of the same old formula (the Alliance formula) which has given political stability through its politics of race, religion and economic re-distribution. It is time to take a different path – a path that rewards hard work and success and none of the entitlement, a path based on the rule of law. Which I think Pakatan can offer. Though not without its baggage which is religion and race.
