RPK dares Malaysia to fight him in the UK

Fugitive blogger Raja Petra Kamarudin has thrown down the gauntlet to Malaysian authorities, challenging them to bring standing charges against him to the courts in the United Kingdom.

Swaggering into a packed hall in the UK capital yesterday and flanked by two burly men in dark glasses, the controversial Malaysia Today writer insisted that he would fight charges of criminal defamation and sedition as well as the appeal against his Internal Security Act (ISA) detention, given a level playing field.

“I will take on the government and I will fight them but I will do what Sun Tzu said, ‘Fight him in your territory.’

“So my territory is here in the UK,” he declared to applause from a largely partisan crowd of over 300, who had their bags searched before entering the hall at the BPP Law School.

Many had to stand for the two-hour talk by the blogger, who repeated what he had written over the years, in his first formal appearance after over a year in self-imposed exile.

Raja Petra wore his now signature beret and immediately refuted the notion that he should return home to prove his innocence of the charges leveled against him.

“A first year law student can tell you that it is not the job of the accused to prove his innocence. It is the job of the prosecution to prove guilt.

“There is the UK court here. There need not be phone call or phone call from someone’s wife,” he said in a thinly-veiled jibe against Prime Minister Datuk Seri Najib Razak and his wife, Datin Seri Rosmah Mansor, whom he has previously accused of interfering with institutions such as the judiciary.

Despite calls from various BN lawmakers to bring Raja Petra to justice, the government has so far not followed up on suggestions that they apply to extradite the runaway blogger who has made many claims, including the involvement of Najib and Rosmah in scandals such as the murder of Mongolian translator Altantuya Shariibuu.

Police have said they were looking into reports that he was seen in several countries, including the UK and Australia, after he absconded but have not reported any success.

Raja Petra, widely known by his initials RPK, also explained that Opposition Leader Datuk Seri Anwar Ibrahim, who is facing a sodomy charge which Pakatan Rakyat insists is trumped up, was in a different boat.

“Anwar has accepted the fact that he has to stay (in Malaysia) as he aspires to be the next prime minister. I have no political aspirations.

“I’ll probably be a free man longer than Anwar,” he quipped.The member of the Selangor royal family referred to several incidences in his previous brushes with the law to back his claim that the Malaysian judiciary was not independent.

He questioned why the Federal Court had yet to decide on the government’s appeal against his release from the ISA, after more than a year.

He also said that he had tried to obtain a full bench of nine judges and “thought that maybe we will get seven but we ended up with just three.”

“We were told it was an administrative decision but nobody told us who made the decision or who were the judges until the day of the hearing.

“On the morning of the hearing, we found that one of them was Augustine Paul,” Raja Petra said, repeating what he had written about the hearing.

The late judge had in 2001 denied a habeas corpus application by Raja Petra to declare his first ISA detention illegal. Raja Petra had also written numerous articles criticising the judge who had also presided over Anwar’s first sodomy trial, which saw the sacked deputy prime minister being jailed for six years.

“I’ve written a lot of nasty things about him and called him all sorts of names. Even I would cite myself for contempt of court! How will he give me a fair trial?” Raja Petra said.

    He may be screwed up, obviously by the Malaysian Government, but he is still capable to prove the Malaysian Government and police are truly impotent plus a lot of other uselessness and really not fit to govern..

    Dia tahu kerajaan tak boleh dakwa dia mengunakan sistem kehakiman di Britain..mana boleh buat jenayah di britain kemudian didakwa di oleh mahkamah jepun etc..

    jadi dia berlagak hero dan orang yang ingin percaya kepadanya akan berjaya walaupun benda bodoh.

    Mahkamah sudah beri dia peluang membela dirinya kerana dituduh membuat fitnah terhadap rosmah dan dia pun tahu dia tak akan memang kerana Rosmah ada alibi maka dia lari dan menipu lagi kononya mahkamah tidak adil.

    The entire law enforecement and judiciary in this country has been systematically dismantled and destroyed since the time of Tun Dr Mamakthir Kutty and is still being destroyed by the present administration. No Malaysian today will have an iota of confidence with these corrupted government agencies and neither will they get a fairb hearing if they ever need to step into these agencies.

    He wants to prove to his worshippers (there are many here) that the government and the police are impotent.
    He is actually a coward and an escapist.
    He knows he is in the wrong in his unfounded allegations against Najib and Rosie.
    But how long is he playing this cat and mouse game?
    Sepandai-pandai tupai melompat akhirnya jatuh ke tanah juga.
    Leman is placing the right perpsective on RPK for you to ponder who RPK is – a clay pigeon.

    1. Bala yang menuduh Najib (sekarang boleh hidup di UK..siapa sponsor?), gagal untuk beri bukti.

    i) Dakwaan Najib Bejumpa Altantuya di sebuah Restoran di Paris

    Restoran begitu.. tidak ada cctv kah? dan bagi seorang ahli politik sentiasa yg sentiasa mendapat perhatian media tambahan lagi bersama wanita cantik di Paris…tetapi tak ada kesan.

    ii) Dakwaan Najib bertemu Altantuya di majlis lelongan berlian.

    Majlis yang dihadiri oleh orang ramai dan wartawan ..maka mustahil tiada satu gambar pun.

    iii) Najib sudah bersumpah tidak mengenali Altantuya.

    iv) Razak baginda juga mengaku dia mengarahkan dua polis tersebut “mengurusi” altantuya, cuma pendakwa gagal membuktikan dia “mengarahkan agar membunuh”, sebaliknya dua pegawai polis tersebut terlibat secara langsung

    sebaliknya Anwar.

    i) dia dituduh oleh mangsa sendiri.

    ii) Spin media PR pada mulanya mengatakan saiful diculik oleh polis dan diarahkan/dipaksa membuat pengakuan palsu…akhirnya terbukti dakwaan PR palsu.

    iii) Karpal singh dan Mat sabu adalah dua orang yang pertama menuduh Anwar terlibat dalam salah laku seks.

    iv)Saiful difitnah memiliki kondo bernilai 2 juta…akhirnya terbukti ianya mikik kawan Anwar.

    v) Tuduhan saiful minta bantuan biasiswa dari najib..sebenarnya dia berjumpa dengan pegawai lama Anwar di pejabat TPM dan saiful ada surat sokongan dari Anwar yg akan didedahkan dalam mahkamah.

    vi) tidak ada manusia yang sangup dihina oleh masyarakat yg jahil semata mata untuk wang.

    sebenarnya saiful minta pinjaman untuk mengikuti latihan pilot yg cukup dengan kelayakan SPM.

    Sila jawab dengan hujah..jika terbukti air mani Anwar ada pada dubur saiful..bagaimana mungkin ianya dirancang.

    i) Air mani walaupun boleh direka, tetapi yang palsu dengan mudah dapat dikenal pasti..

RPK has a responsibility to all freedom loving Malaysians both at home and abroad committed to fighting oppression wherever oppression is found, to bring to the attention of those who seldom hear about Malaysia and could not place Malaysia in the world map, who think that Malaysia is somewhere in India (my neighbor in England from a middle class suburb just outside London thought Malaysia is in Africa) that we are a newly developing country with aspirations to become a model of parliamentary democracy for South Asia, and that we were on track to be those until a politician by the name of Mahathir Mohamad took over the reins of leadership in the early ‘80s.

    With Mahathir Mohamad (and the world does not know the full extent of this man’s transgressions), he allowed arrogance to go to his head once he occupied the highest seat of power. He exceeded the powers given him by the country’s federal constitution. He is a man who does not take kindly to criticism and in the process single handedly over the two decades that he was Prime Minister, destroyed all opposition to his policies; and when his opponents relied on the independence of its judiciary as their last bastion in the defense of justice, he systematically dismantled the country’s third pillar of government making a mockery of its independence which is guaranteed by the constitution i.e. a constitution he is sworn to protect and uphold. This man broke his own oath of office.

    Mahathir Mohamad quickly found Malaysia to be too small for his ambition and it is not long before he took to the international stage earning for himself, in the process, the reputation of a tin-pot dictator, a title reserved by the U.S. Department of State for third world leaders who sought to rise to power through anti-U.S. rhetoric. Except that with Mahathir Mohamad even that would not be enough and he has to add and did add anti-Jewish rhetoric to his speeches to catch the attention of the Muslim world; and which he did and did it well. That was to be his forte.

    After being chided by U.S. President Bush at international meetings for holding on to power, he promised he would voluntarily step down for his successor. Why not? He has lined up all the ducks in one row and it was time for him to take that shot. His successor Ahmad Badawi quickly showed that Mahathir’s shoes were too big for him to fill and he eventually was forced out of office amidst calls for his resignation both by his supporters and his critics giving way to Najib Razak.

    Under Najib Razak, little changed as the man who wants to be Prime Minister is again put on a show trial before the inevitable happens i.e. political exile for the man who wants to be Prime Minister, negotiated with some world leaders whose support Najib Razak would need to protect his own legacy when the time comes for him to step down.

    But with RPK what do we find today?

    Apparently RPK has sought asylum in the U.K. as it is his right to do so under the asylum law of the United Nations incorporated into the domestic laws of countries who are signatories to the 1954 U.N. Convention Relating to Refugees as expanded by the 1967 Protocol. RPK is not a convicted felon but a political activist fleeing persecution for his political views. He should now use his celebrity status at home and security as guest of the U.K. government to defend the constitutional rights of freedom loving Malaysians of whatever political affiliations.

    He should discard his silly preference for the lone red star khaki cap (a reminder of the cap with triple red stars worn by terrorists fighting the British in the ‘50s) or even the lone red star black beret of Che Guevara as this conjures up the wrong image among his British audience. It is time for him to get serious and make good use of his celebrity status at home and the platform given to him internationally and be heard abroad as well. It is not enough for him to frolic in the limelight of his own making and that of his persecutors.

    It is time for him to appear at the Speakers’ Corner of the famed Hyde Park in London.

  18. din’s blog has taken the path of rpk’s m2day. m2day during its earlier years was both informative and discussional. indeed a lot of exposes rpk revealed and indeed a lot of intellectuals posted excellent comments which formed a cyber forum by itself. not anymore now. the intellectuals no longer want to be associated with pre-puberty commentators, so, what’s left are a bunch of “premature ejaculators” and, my version of “one touch climax” schoolgirls.

    It is unfortunate that the writer referred to RPK as ‘fugitive’ because he certainly is not a fugitive from justice. He is not a convicted felon. He is fleeing persecution and not really prosecution. He feels he would not get a fair trial – and he is right.

    As for the idea that the Malaysia government could bring charges against him in the British courts, that is preposterous! This is a jurisdictional issue and nothing more need be said about that. There is an extradition treaty between Malaysia and the United Kingdom. Even if the U.K. government wants to deport RPK it cannot do so. Under the U.N. asylum law which the U.K. government is legally bound to follow, it cannot deport RPK back to Malaysia to face certain danger.

    But what if the Malaysian government were to guarantee it would drop all charges against him and not slam him with new charges? Then RPK would do well to resist deportation in the U.K. immigration courts. Their courts are not like our courts and are fiercely independent of the executive. If the Immigration Judge on appeal were to abuse his or her discretionary powers given him under the law, that would give jurisdiction to the Court of Appeal to review but only the abuse of the judge’s discretion; and if abuse of the judge’s discretionary power is found, the appeals court could have it remanded back to the Immigration Judge with its directions.

    That’s the idea here. Have a set of hats where each one represents a different mindset. Simply put on your hat when you need it. Wearing a hat can put you in a certain mindset and reduce conflict that you might normally feel trying to manage several different opposing viewpoints. This gets in the way of energy moving and forward progress. The key is using the right hats for the right situations. When you’re in execution mode, you don’t want to be wearing the analysis hat or the fear hat. You want the action hat. When you’re in a highly political setting, the kick arse or action hat can get you in trouble if not using the political hat first.

    It is for the prosecution to prove guilt beyond reasonable doubt and not for the defendant to prove his or her innocence. Even then not beyond all doubt. The law of evidence is not for first year students. Too difficult for them to grasp.

    However, in cases of strict liability the shoe is on the other foot.

  24. AG Petai is now frantically searching his law books to see if there was any precedent. In Malaysia Petai can bulldoze his way through the police and courts but in the UK he is up against the big boys. The big wigs there will throw him out the minute he opens his mouth.
