mk50Former Tourism Ministry director-general Dato Mirza Mohammad Taiyab was today acquitted from a charge of receiving valuable gratification in the form of an expensive dental treatment as a public officer.

He was acquitted and discharged by the Kuala Lumpur Sessions Court without his defence being called. Judge Zainal Abidin Kamaruddin said the prosecution had failed to prove a prima facie case.

“Hence, he is discharged and acquitted of the charge,” he said.Mirza (photo:left), 51 was charged under Section 165 of the Penal Code with accepting dental treatment worth RM13,860 paid for by Zulhisyam Ayob, a director of advertising firm Perunding Pakar Media Sdn Bhd between January 17, 2005 and July 26, 2005.

During that time, Mirza was deputy director-general I of the ministry, while his elder brother Mirza Mohd Tariq was the managing partner of Perunding Pakar Media.

He was alleged to have committed the offence at the Clinic Practice Prosthodontics in Taman Tun Dr Ismail. If found guilty, Mirza could have been sentenced up to two years in jail, a fine or both.

Zainal Abidin in his 38-page judgment in acquitting the senior public servant said the prosecution has failed to prove mens rea (criminal intent) on the part of Mirza in receiving the dental treatment that was supposedly paid by Zulhisyam as he had denied in making the complaint.

“Although the prosecution has argued that Zulhisyam was a hostile witness, the court has to look at the evidence in totality. Hence, the court cannot accept the evidence of alleged gratification from Zulhisyam to pay the dental fees, as stipulated under Section 42(3) of the Anti -Corruption Act 1997,” he said. The question of criminal intent, the judge said, was important for criminal cases.

Failure to call complainant fatal

The judge also commented that the prosecution’s failure in calling the actual complainant Mohd Zamri Zainul Abidin, who is with the Malaysian Anti-Corruption Commission, had been fatal to the case.

“Zamri was the person who had gone to the clinic and was the complainant. Hence, his evidence on the investigations should have been important on what had actually transpired with the accused,” he said.

“The absence of such evidence as to the basis of the investigation, I would say is detrimental to the prosecution’s case,” he said.

Talking to reporters after his acquittal, Mirza, wearing a maroon “baju melayu”, said the court’s decision has vindicated him of any wrongdoing. “I have gone through a lot, been humiliated, under stress and suspended as a result of being charged. Now I feel vindicated,” he said.

He had been suspended since Aug 13 last year and he will decide on his next course of action after the ministry’s disciplinary board sits.

The father of three children had previously claimed that he was ‘set-up’ by his enemies. “It is all fabricated and I think it is unfair,” he had said when he was charged.

“I mean, think about it, somebody alleged something and they arrested me immediately based on mere allegations. I hope that person has evidence if he or she is making such accusations.”

Mirza was represented by Sashidaran Menon and Abdul Aziz Abdul Rahman, while the DPP Saiful Hazmi Mohd Saad represented the MACC.

Saiful Hazmi indicated they received instructions to appeal.

  1. It is normal practice for MACC to appeal, but I hope good common sense will prevail in this case.There is no evidence to convict Dato Mirza in the first place. Let us not waste taxpayers’ money in pursuing this matter further.

    As Dato Mirza himself said, he was ’set-up’ by his enemies. “It is all fabricated and I think it is unfair.” The complainant, MACC’s Zamri Zainul Abidin should know the truth behind this case. Alas, he was not called to the stands. But we know the truth right from the beginning and from the few key witnesses that we called, including Dr. Kamsiah and her Office Manager who endured not only long hours of interrogation in their clinic and at MACC HQ in Putrajaya. On top of that Dr. Kamsiah was on the witness box for more than 9 hours of heavy questioning from the prosecution and Dato Mirza’s defence team. Her Office Manager suffered a miscarriage when she was persistently questioned and pressured by MACC officers including Encik Zamri himself.

    The 30-page written judgment by the presiding would be a classic document in the way he argued the case and came to his conclusion of acquittal. Towards the end of his judgment, he asked Dato Mirza to cherish the moment and told him to listen to Frank Sinatra’s My Way and reflect on his trial and tribulations. Dr. Kamsiah and I pay tribute to both the judge and Dato Mirza by playing MY WAY.

    Many of us know who the pervert behind (or was it in front?) who ‘fingered’ Mirza, because he dared stand up to ‘it’. Ask any senior ptds’ etc.
    Anyway, from what i gather, ‘it’ has gone semi-wild in our nation’s 65million year old jungles due to a quirk in bumno’s electorial process.

    This joker fella, knows how to handle women but unfortunately his enemy was reported to be a hormonal imbalance creature, hence he was trapped.

    He should pay respect to Master Bean who was his senpai (Senior) at Ropponggi.

    Anyway, I am happy for my friend Mirza and his lovely wife and children.

  4. Sad, especially the person claimed in court to have bribed Dato Mirza was not charged just because only either the giver or recipient can be charged.

    As for my dear DrKam, she was not only troubled, but lost her kids , friends and patients to the man who claimed in court to entertain Datuk Mirza and who embarassed her by claiming that the treatment was ‘costly’. In addition, here is the same man who failed to support his kids while they were staying with her for the last 20 years.

    When the case was on, he quickly ‘grabbed’ the kids and turned them over against her, so that he can look a good provider. He is probably now but never during their marriage and when she was single handedly managing their kids with very little financial support, not even to the extent of paying their school and tuition fees. He portrays the image of someone who does not have any money for their welfare. He never declared his income during and after their marriage.

    It is mind troubling to see a capable professional woman being bullied mentally and financially by the father of her two kids. I personally think the kids would better off with their mother since there is no need to show off who is the better parent to MACC or his friends and associates.

    Of course, they are now old enough to choose but for someone as persuasive as their father it will be a tough decision. Dr Kam is naturally very concerned about their education and their future.

  5. I know both of them. Her husband is a revengeful person. He will do everything he can to hurt her because he cannot get over her decision to seek a divorce from him. He knows that DrKam is very close and very emotionally attached her daughter and son. This is what I call emotional blackmail.

    Dr. Kam would be well advised to control her emotions and deal with her former husband legally. Sue him for all that is due to her.

  7. I say, why is our Din Merican in kepiah? Being a Kedahan, he should tilt it a bit to the left. Much like Tok Cik and Shrek wear their beret. At least his kepiah is high enough and not the flat ones worn by Johoreans like Kerismuddin.

    This Mirza’s story seems to strike a chord with Din and his wife. Now I know why.
