The Persecution of Kassim Ahmad: A-G Gani Patail loses again

In the past two weeks, the mainstream media have been screaming the news that Kassim Ahmad had lost in his attempt to get leave to sue the Minister of Religious Affairs, the Syariah Chief Prosecutor and the Jabatan Agama Islam Wilayah Persekutuan (JAWI). It is as if they were gleeful that Kassim Ahmad had initially lost in the High Court and then failed to get a stay in the Court of Appeal.

The Malay media, especially Utusan Malaysia, portrayed that Kassim Ahmad will finally meet his doom in the Syariah Court for “menghina Islam”. That immediately made the already controversial Kassim Ahmad Islam’s Public Enemy No.1 in Malaysia.

But what stunned me most was that the Malay Muslim public was even quicker to label the counsel whoRosli Dahlan acted for Kassim Ahmad as also “bersubahat” or an accomplice to an enemy of Islam. Thus it was that my young friend Lawyer Rosli Dahlan who acts for Kassim Ahmad ended up being painted negatively as if he too was an enemy of Islam. I know Rosli to be a deeply religious person, and that such remarks would hurt him.

What most people do not realize is that Rosli is the 1st batch of the law graduates of the International Islamic University (IIU). I know Rosli is proud of his alma mater and fiercely loyal to the concept of justice taught by his mentor, the late Professor Tan Sri Ahmad Ibrahim.

I know that because on the occasions that I get to speak to him about civil rights including when we had lunch with the former US Ambassador John R Mallot, Rosli was passionate about the Rule of Law and justice and insisted that these two concepts are not just Islamic concepts but are the demands of the Syariah. John and I found that very refreshing that a UIA graduate is not insisting on the importance of implementing Hudud but was more concerned about the justice that an Islamic system would bring.

That gave me an insight as to why Rosli would defend Kassim Ahmad and persevered even as he faced initial failures when the High Court rejected his bid to seek Judicial Review against the Minister Agama, the Chief Prosecutor and JAWI. But today is a different story.

Today, most alternative media reported that Rosli succeeded in persuading the Court of Appeal that Kassim Ahmad should be given leave to challenge Minister Agama, the Chief Prosecutor and JAWI. Today, the Court of Appeal unanimously directed the High Court to hear the judicial review application filed by scholar -researcher and public intellectual Kassim Ahmad.

Today, Rosli perseverance in fighting for Kassim’s case paid off. Today, Rosli won against the A-G in Kassim Ahmad’s case (Malaysiakini’s report below).

But, one of the reporters also whispered something to me that many people may have forgotten. This is the end of Ramadan. In 2007, at this time of Ramadan, Rosli was brutalized by the MACC and that started his on-going battles since then with the AG and others whom he called the “rogues in government”.

What the reporter whispered to me was that after Judge Vazeer Alam ruled that the AG is not immuned from legal action brought by Rosli, A-G Gani Patail has been avoiding going to trial. And yesterday, A-G Gani Patail succeeded in getting a Stay Order so that Rosli’s case against A-G Gani Patail and 11 others will not see the light of to trial. I was sad for Rosli, here he is successfully fighting Kassim Ahmad’s case, but , unknown to many he suffers another personal tragedy when his own case against AG Gani Patail cannot go on. But I know Rosli, he will not yield. He will not surrender. He will persevere. He is a fighter and I know he will fight to the end until he thinks justice has been served!

High Court must hear scholar’s review bid

The Court of Appeal in a unanimously decision today ordered the High Court inKualaLumpur to hear the judicial review application filed by scholar Kassim Ahmad.In ruling that the civil court has jurisdiction to hear matters pertaining to questionable actions by Islamic religious authorities, the appellate court ordered the case to be remitted to the High Court to hear its merits.kassim-ahmadJustice Balia Yusof Wahi, who led the three-member panel, did not make an order as to costs. Sitting with him were Justice Mohtaruddin Baki and Justice Rohana Yusof.

Justice Balia said the court was satisfied that Kassim had passed the low threshold in establishing a prima facie case for the judicial review to be heard.He said the application related to the defendant (the religious authorities), being a public body, for initiating proceeding against Kassim, after he was charged under the Syariah Criminal Offences (FT) Act.

Appellant should not be shut off from remedy’

“The High Court judge concurred (in her judgment) that the issue is not confined solely to jurisdiction. The appellant is challenging the enforcement and administration of a public body. On this, the appellant should not be totally shut off from his remedy for judicial review and from ventilating the challenges,” the Judge said.The court, Justice Balia said, is also guided by the 1988 Supreme Court decision in the case of Mamat Daud, that an offence against an Islamic precept can be challenged by way of judicial review. “We therefore allow the appeal and order is granted for leave (permission) to hear the merits. We set aside High Court order (that it does not have jurisdiction),” he ruled.

Kassim, was represented by Rosli Dahlan , Bahari Yeow and Ahmad Khubayb, while senior Federal counsel Nor Hisham Ismail appeared for the Attorney-General’s Chambers.  Rosli also applied to the appellate court for a stay of Syariah High Court proceedings against Kassim, but this was objected to by Nor Hisham.

Following this, Justice Balia said he would order that an early date be fixed by the High Court. High Court judge Justice Zaleha Yusof on July 14 rejected Kassim’s application for a judicial review, following a preliminary objection by the Attorney-General’s Chambers that the court has no jurisdiction to hear the matter.

Kassim, 81, named Minister in the Prime Minister’s Department Jamil Khir Baharom, the Chief Syariah Prosecutor of the Federal Territories Islamic Affairs Department (JAWI)  and the Malaysian government as respondents when he filed the judicial review application last month.

He complained that JAWI acted overzealously in breaking down the door of his house in Kulim, Kedah, to arrest him and take him to Kuala Lumpur in March this year.

JAWI has not authority in Kedah’

The octogenarian complained that JAWI had no authority to make the arrest as it  should be confined to the Federal Territory and the fatwa against his book was only applicable there and not in Kedah.

Kassim was charged in the Syariah High Court in Putrajaya on March 27 for with deriding Islam, under Section 7(b) of the Syariah Offences (Federal Territories) Enactment 1997, in his talk at the Yayasan Kepimpinan Perdana seminar, which was organised by former Prime Minister Tun Dr Mahathir Mohamad in Putrajaya in February.

The scholar is charged with stating that people appear to idolise Prophet Muhammad and that the aurat of a woman does not include her hair. He is also charged under Section 9 of the same enactment with violating the instructions of the religious authorities in delivering those views and for citing two books he authored, which have been banned by the Federal Territories Islamic authorities.

On May 6, the authorities levelled another charge against Kassim, but the charge was not read out in court when recording his plea.

In his judicial review application, Kassim is seeking several declarations: to quash the actions taken by JAWI, which includes the issue of the warrant of arrest against him; to set aside the charges he faces; to compel JAWI to give him the relevant documents pertaining to the charge; and to stop the authorities from prosecuting him.

He also sought a declaration that JAWI’s action was contrary to the Federal Constitution and a declaration that the Federal Territory fatwa is only applicable to those who live there and not in Kedah.

    That’s because the law that Rosli learned in UIA was the English common law system.

  2. All these, because ‘ Gold will be tested under fire ” constantly, applies to both Pak Kassim and his Lawyer Rosli Dahalan. Its a Conundrum of nature, man can only become wiser eventually…how or why none can predict….( Arabic : Innal’Lah homa’sabirin….I don’t know what it is ? )

    I agonize whenever I write about Rosli’s plight in upholding the Rule of Law. We are seeing in this case of Kassim Ahmad– another good friend and mentor and a fellow Kedahan who I knew when I was a student at MU– how bigoted religious functionairies operate. They just cannot entertain differences of opinion on Islam. What is more shocking to me is the role of the A-G who should be more rational, not political. As an Officer of the Law, Gani Patail should ensure that the Rule of Law is always upheld. He is not doing that at all. But we must soldier on and emulate my young friend, Rosli Dahlan. Indifference is not an option when it comes to Justice and other related issues. Thanks for your comment.–Din Merican

    It is not nice to condemn RD; he is a lawyer ( his bread and butter is law) at such he has the right to choose who he want to represent. Personally, I don’t like KA, I think he is a munafik but even then he has the right to have a legal counsel.

  5. Dato’Din, all these shows how pathetic our judiciary systems have become. Now we have ex-judges claimed Islam is under threat in Penang. I say people like these ex-judges, Perkasa & Isma are the real threats to Islam & peace to our country.

  6. One sided notions, precepts and beliefs may make up the DNA of an average man anchoring main stream thinking. Perception and reality can contradict and demolish the messages they inherently convey. For example one may say religion saves (souls) and another may say it kills (bodies). Millions of people go to places of worship seeking salvation and at the same time millions have been killed and continue to be killed in the name of religion. No amount of explanations and quotes from religious texts can justify past killings or stop present (and future) killings. How valid is the belief that all prophets are messengers of God? If religions cause all the strife in the world, why did he create them either by himself or through the prophets? The least he could have done is to create only one religion, if need be, for a more harmonious humanity.

    Kassim Ahmad basically is a rationalist and a deep thinker. It is the enquiring minds of people like him, seeking the truth and exploring answers for the unknown (and publicizing them when enlightened), that adds value and enriches the thinking process of man. For that, we should not and allow not others to put him down and get him punished, whatever our personal views may be.

  7. I always believe that justice will prevail through our good deeds and perseverance. God will always guide those who walk in the path of light, and I pray and hope that both Kassim Ahmad and Rosli will continue on the path of light, and victory will be upon them. God bless them.

  8. I like ‘KA’, or at least his spine, since i have no truck with terms like ‘munafiq’. Er.., is that word banned too?

    Things are really heating up in the Judiciary huh? Seems that the Hardcore Conservatives barely outnumber the Progressives. May the former Gravitate and the latter Levitate. Very patchy scenario ya?

    Unfortunately, that will not translate well in the Gawd-awful Legislature nor Lembek Executive.

  9. Lord Denning’s famous quote, “Justice must be seen to be done” somehow does not apply in our context. The reason is simple, religious bigots, like in most Islamic countries, have taken control of the Malays’ minds. They simply cannot separate facts from fiction and this is a cause for concern. That’s what prompted the former CJ to utter the unthinkable and Perkasa to do the incomprehensible. We are living in dangerous time.

  10. I can’t help to feel all religion are causing more problem than giving us guidance to be better people. We use religion to justify killing, discriminating, etc. When the Sultan and Agong stress the importance of unity among Muslim because of threat. I cannot help to think if I am a threat to my country and Muslim friends. What is there for non-Malay or non-Muslim?

    Does the Sultan and Agong care for all his subject regardless of their skin color or religion? Never mind …. Since I am born, I learned discrimination exist on both sides.

  11. @ AVI-8, what IF God Al’ Mighty likes him, even if thousands of other Muslims do not like him ? One can really never be able to tell, no ? What if Cat Stevens is ‘loved’ by his God, showed him the way and he then became ” Yusuf Islam ” ( there are too many to count ), conversely , there are millions born a ” Muslim ” but in conduct and actions are quite the opposite ? So, Muslims may have misunderstood Surah ” Ya’ Ayuhal Qafirun ” , likewise , Surah ” Al’Munafiqun ” ( The Hypocrites ) revealed to Beloved Prophet in Madinah, Allah SWT was guiding him about the Munafiqs within his own ranks of followers of Arabian descent, but Muslims WRONGLY interpret the ‘ revelation ‘ to mean the Jews. Not so.
    Until present day, many of the Descendants of The Lost Children of Israel ( from Nabi Yusuf, Nabi Ya’acob, Nabi Ismail etc ) have settled down in the Arabian Peninsular , and ISRAEL are still trying to trace these Lost Children of Israel.
    ( Don’t misinterpret that I am ‘ expert ‘, but numerous Koranic Revelations in which Allah SWT has repeatedly Proclaimed (to the effect ) to the Jews who HAVE gone astray : ” DID YOU NOT REMEMBER, THAT YOU WERE ONCE MY FAVOURED RACE, THAT YOU WERE ONCE MY CHOSEN PEOPLE……? – from the time of Noah ( Nabi Noh ) who had indeed first Declared ” The Nation of Israel ” ) ( Ya Bani Israel )
    Yes, subsequently, since many of them had SINNED against God, then came the Great Flood, and the episode of Noah’s Ark….its all historical narratives in the Koran….Its another aspect, another story….

    As Muslims, we ought not Interpret or Misinterpret our Holy texts lightly, or nonchalantly …..the Koran implores…..because The Holy Book is a TRUE Book of Miracle…..

  12. Organized religion especially when it is armed with legislative power is a threat to religion itself.

    Those in JAWI, Jakim, Jais and their likes, should reread the following verses:

    “And on whatever you may differ (Oh believers), the verdict thereon rests with God” – Ash-Shura:10

    “Oh you who have attained to faith! No man shall deride other men: it may well be that those (whom they deride) are better than themselves” – Al-Hujurat: 11

    “Say: “Do you by perchance, (want to) inform God the nature of your faith -although God knows all that is in the heavens and all that is on earth? Indeed God has full knowledge of everything!” -Al-Hujurat: 16

  13. I suggest that the cabinet members take up a course on Sharia and satisfy themselves that the ‘Islamic’ law is superior to our constitution. If they are satisfied then replace the constitution with the Malaysian Sharia. Then everybody can play God! Malaysia will then be in world news like MH370 and MH17 calamities. This country, my country, this otherwise beautiful country is really going to the dogs, poops and all. I am really ashamed to be called Muslim. I wish there is another name I can use for the original Islam since the current one is being hijacked by the hypocrites in its name.

All I would say is that throughout the years since the early years of University of Malaya in Singapore I have always had a high regard for Kassim Ahmad as a Malay academic even though I do not always agree with some of the views expressed by him.   16. I wish all of us would respect one another as a human being. The human being is an honoured creation of God. Differences of opinion is no crime. We should listen to all views and follow the best. The Hadith, with due respect to Malaysian Muslims, is a creation of Imam Shafie, who, after about 250 years after Prophet Muhammad’s death, created the new doctrine of two principal sources (Quran & Hadith). It has nothing to do with the Prophet. Muhammad’s sole mission was to deliver the Quran, nothing but the Quran. The final judgement is, of course, God’s — Kassim Ahmad

  17. I want to thank my friend Dato’ Din Merican for his nice piece on me, Also to Lim Chung Tat for his strong support for me. I want to stress again that the so-called Hadith is NOT the work of Prophet Muhammad. They are later fabrications ascribed to him. Imam Shafi’e is the culprit for elevating the status of these fabrications. He will no doubt have to answer for his crime to God. THE TRUE HADITH IS THE QURAN. (Quran, 45:6; 39:23 dll.) Malaysia unfortunately is under the spell of Imam Shafi’e. I wish some of our scholars would criticize him and thus remove the spell. I would like to mention here also that the call to re-evaluate the hadith has been made by King Fahd of Saudi Arabia, by the Religious Affairs Department of the Turkish Government and also by a lecturer of our UIA. — Kassim Ahmad

How can the Hadith(s) be given more prominence than verses of the Revered Book?   18. 1. I will add another thing. Less than a week ago, an Arabian scholar by the name of Sheikh Hassan Farhan Al-Maliki, condemned the false Hadith culture for corrupting Islam. I told my lawyer En. Rosli Dahlan, “I have been vindicated.”
    2. Not wanting to boast, I must repeat that I studied the Quran for 36 years since I was 17. In 1986 when I felt that i have mastered the gist of the teachings of the Quran, I wrote a book, “Hadis — Satu Penilaian Semula”, which created a storm. For two full months there was intense discussion, half supporting me, half opposing. Our cartoonist Lat caught atmosphere correctly in his cartoon in the NST. Our famed writer Adibah Amin wrote a brilliant review of the book that was splashed in the middle page of the NST.
    3. In an ABIM-sponsored dilougue with me, one ABIM spokesman yelled at me and blurted, “Kassim, you have gargantuan courage. That was because I dared to criticise his idol, the Grat Master Jurist, Imam Sahfi’e.
    4. Currently, I am writing my autobiography, commissioned by Tan Sri Dr. Rais Yatim. I reffered to my criticism of the Great Master. I told Dr Rais, “I am a rebel.” He immediately responded, “Go on rebelling.”
    5. I derive my propensity to stand up for the truth from no other then the Quran.
    6. Of course, the ignorant condemn me. I must heed Jesus Christ: forgive them, for they know not what they do.

    2. However, I shall give two telling indications in high places: (a) the peoples’, Pope Francis who in the USA last year talked about the downtrodden and inter-faith discussions, and never about Christian doctrine, (b) the new US President Donald Trump who said we are created by the same one God, and to the surprise and even horror, of some members of the US Congress that he would seek peace with traditional enemy Russia! Do you not agree with me that we are in a new territory now? It is high time! Salute to the Pope and Donald Trump!

  21. 1. I grant that I do not know enough about the new US president. Muslims dislike him for being frank about them. But Muslims have changed over the years. Against God’s order, they have broken up into sects. As I said, they have fallen. The new US president is surely referring to to the hypocritical Muslims (See Quran, 63: 1-2.
    2. But I heard him clearly about mankind being made by one God, and that he wants to make peace with traditional enemy, Russia to the horror of even of most Americans.Don’t they want peace?
    3. I have never known heard or known any US president speak like that before. May be Rooservelt or Abraham Lincoln, but then it was sabotaged by the then great power Britain, who drew the Iron Curtain, and the Cold War.
