The Registrar of Societies (ROS) has no objections to DAP candidates using its own party symbol in the May 5 general election despite not recognising its party leadership.

DAP was informed of this late yesterday evening in a letter by ROS Director-general Abdul Rahman Othman.

“The ROS so far has not made any decision to de-register DAP. The ROS also does not have any objection against DAP participating in the 13th general election with its own symbol,” wrote Abdul Rahman.

In an immediate reaction, DAP Organising Secretary Anthony Loke said the ROS appear to have succumbed to public pressure and clarified the matter.

“It’s obvious that they issued that letter in face of overwhelming public pressure. Nevertheless, we will still stick to our plan,” he said.

NONEThe plan involved producing two authorisation letters – one from DAP’s Secretary-General and another either from PAS or PKR – to the respective returning officers during the nomination process.

Nominations of candidates will be made today between 9am and 10am. The authorisation letters are for the use of the respective party logos.

“We will use DAP’s appointment letter first, if it does not work, then use PAS or PKR’s letter,” Loke (right) told Malaysiakini.

The ROS had sent a letter on Thursday informing the DAP that the central executive committee (CEC) was not recognised, pending investigations into problems with the CEC election last year.

This sent DAP into panic mode, because authorisation letters for the use of the party logo is signed by the party’s secretary-general and might be considered invalid by the returning officer.

Thus, both PKR and PAS has issued authorisation letters to use their party logos to DAP candidates as a back-up.

However, there are concerns that even if the returning officers were to allow the use of DAP’s logo, the ROS’ notice on April 17 may be used to nullify election results later.

Feedback in one month

The latest letter by Abdul Rahman did not address whether the authorisation letters issued by the DAP Secretary-General will not face legal problems.

In his letter last night, Abdul Rahman explained that the notice under Section 16 (1) of the Societies Act 1956 was issued to inform the party that there was a dispute over the DAP’s internal election on December 15 last year.

“The notice that was issued under Section 16(1) urged DAP to provide feedback in one month from the date of the notice on what has been done to resolve the dispute.

“In addition, only office bearers of the CEC elected on December 15, 2012 are not recognised by the ROS,” said Abdul Rahman.

  1. What flip flopping again? This problem was created by the DAP itself from the beginning and the official complaints against the malpractice in the CEC were made by the DAP members themselves. The DAP shouldn’t blame others now even if it is trying to gain some sympathy votes.

  2. What a question to ask? Of course, we don’t trust the entire public service. Their top brass are pro-UMNO-BN, and have been bought. This could be a trap. Today, April 20, we will know who many are returned unopposed on technicalities. Desperation forces people to act irrationally. UMNO-BN is truly desperate.

  3. This is gone into a real legal tangle now, but if ROS uses its power to debar, it may be subject of Judicial review, post Election and then what ? The entire Election flawed , and have a Re-Election all over again ?
    Remember, the late legendary Justice Harun Hashim declared even UMNO to be ‘ illegal ‘ , but UMNO had time to re-do the re-registration
    In this case, public uproar on DAP’s improper election of CEC office bearers, did not deter the Sec. General LGE to rectify, instead bulldozed his authority contrary to law.
    As events unfold, 753 members were not sent Notices on the Election – not few. Ask the lawyers, Notice is a very fundamental prerequisite for any official conduct that MUST be applied in compliance with Natural justice, the lack of which renders the whole assembly ‘ illegal ‘ and/or void ab initio.

    That’s the crux of the problem, people vested with ‘ power’ – no matter, mainstream or opposition – too often think with political power they can prevail over the law……

  4. Just curious how come UMNO Baru was set up in the matter minutes after UMNO was declared illegal. Did UMNO suffer the same fate, having the decision made 2 days before nomination

    Should ROS is impartial the subject of party election irregularity should not have been bought out when the entire country is having general election.
    These irregularity can be resolved after the general election at a proper time. I am sure DAP will fulfill what ROS wants. The timing for discrediting the party CEC at this moment speaks well of ROS intentions and clearly show that ROS is not independent but serving the current political masters.
    The complaints against DAP are all allegations need to be investigated. Investigation required evident gathering and all these things if to be done professionally needs TIME.
    In a nutshell DAP complaints can be resolved not now but a an appropriate time. Doing it now should that there are other motives which until now DAP has been reacting professionally.

  7. I agree with aliefalfa. Where’s the flip flopping? The whole fiasco was caused by them? And it might have even been engineered by them as well.

    Do not insult our intelligence by pretending that the DAP does not have any political motives when they want to contest under PAS/PKR symbol. Fortunately, ROS has clarified that they can still use their symbol. But if they still insist on using PAS/PKR, then to me, it’s clear that this is just a political game. They’re trying to garner sympathy votes and confuse the voters.

    You’ve insulted the lot of us who do not agree with what you think by saying we’ve thrown away our thinking cap. Geez, how much more arrogant can you get? You do not respect fellow Malaysians who have differing view than you, and therefore I don’t think you deserve any respect from us as well.

From the very beginning ROS only issue is not recognizing DAP’s new CEC because of complaints from their very own members. ROS cannot act on a political party based on outsiders complaints, only internal members can do so and many of DAPs themselves did jz that. Your illogical theories of conspiracies and bias treatment are totally unfounded solely because you are refusing to see the whole story from every perspective, instead only contend to listen to one sided stories spoonfed to you.

  13. Does Abdul Rahman of ROS understand what he is talking about ? If the DAP office bearers are not recognized by ROS then who in DAP will have the authority to sign off the nomination papers ? And why the hullabaloo just 2 days before nominations ? This hullabaloo is an insult to the integrity and independence of ROS.

  14. I think the DAP has done its sums well. The co-operation extended to DAP in its hour of need by its coalition partners, PAS and PKR is remarkable. The standby plan to have in hand and use the authorization letters from PAS and PKR to field DAP candidates as their own (as PAS’s in mainland and PKR’s in Sabah and Sarawak) in the event the DAP is – on nomination day – declared ineligible to field its own candidates on account of ROS not recognizing the currently elected CEC of the party, is a good strategic move. The prospect of DAP candidates contesting under PAS’s moon symbol must have sent chill down the spine of UMNO which feared this may undercut its Malay ground support. Directions went out fast probably. ROS back paddled swiftly resulting in DAP being allowed to contest as DAP.

    The possibility of BN challenging the validity of DAP wins post-Election, has been raised. BN has already weakened its case by not objecting to DAP candidates filing their nomination papers on the nomination day itself when they had all the opportunity to do so. What if ROS subsequently declares DAP illegal? Its MPs and Assembly men can resign and force mega by-elections and contest again under PAS and PKR logos respectively and hopefully this may bring more decisive and humiliating defeats for UMNO/BN.

    I wonder what other tricks umno-bn has up its sleeves to hang on for dear life?

    this election is not about who is going to win or who is the best candidate for the country but whether we will get rid of the multiple-sclerosis called umno-bn destroying our beautiful country.

    My take: The second faxed letter by RoS, declaring non-recognition of the CEC, is the one that did the damage. The first was actually already quite adequate, as it implies that investigations are on-going and by that, implying that the CEC was on ‘hold’.

    Then some bright spark from PMO decided: ‘Aah.., what the heck! Might as well give those bastards the work-over they deserve!’ Anybody wanna to hazard guess who this brilliant dickhead was? Anyway, the mediocrity in extremis dep-DG became the faux megaphone and faxed that nice letter. The rest is history.

    Didn’t i say this will all calm down – after the splatter of Jibs FUBARs get messier? Enjoy.

  20. They thought the Chinese will not vote for DAP if it has another logo . But the thought that the Malays will flood the moon and Eye gave them the shivers. Had to back down! Who stayed back and came to work at 10pm? Or it must have been one marathon brainstorming session!
    Pretty close, this is one more agency needing complete overhaul and the Officers given the pink slip without pensions!

  21. Abdul Rahman was formerly Immigration Head.He was removed after a few boo boos and one of which was when detainees under immigration care escaped from the detention centre.He came out with brave statement bordering stupidity that he was prepared to be removed.

    The immigration officers by and large hate him to the core.They celebrated his removal from the Immigration.Again the displeasure of the immigration guys are also due to his stupidity. He was replaced by Alias, the current head.Things are looking much better in Immigration compared to when this Rahman was there.There was no place Rahman for some time,until it was announced later that he was posted to ROS.

    How then can we expect such an incompetent guy to perform professionally wherever he is posted if he is just a simpleton.The best way o survive is to be subservient to your boss and the Minister in charge.This is, therefore, the result.

  22. The DAP CEC election was in December. The full report was submitted to the ROS. One month later, it was discovered there was an error in the counting using their Excel worksheet and this was openly declared, corrected and a subsequent report submitted to ROS. Why did the ROS not suspend the CEC elected then and ordered a re-election, why now?

    If ROS had seriously wanted to be fair to DAP, then it should have carried on with the meeting scheduled for 18th April – 2 days before the nomination day – and not postponed the meeting to 19th May 2013 ie 2 weeks after the polling day. Why did it postpone the meeting and yest took unilateral decision to not recognize and suspend the CEC Committee despite the meeting cancelled?

    And one last point Dato Din, which minister is in charge of the ROS? This minister should go have a lambchop and wash it down with his Anchor Beer….
