PKR’s top two leaders – Anwar Ibrahim and Azmin Ali – are expected to be charged tomorrow in relation to the BERSIH 3.0 rally.

According to a notice that was served to Azmin, he is accused of violating Section 188 of the Penal Code, read together with Section 109 and Section 34 of the same law.

Section 188 refers to “disobedience to an order duly promulgated by a public servant”, while Section 109 and Section 34 refer to abetment.

The notice to Azmin said he and five others who are still at large, had conspired with R Tangam, G Rajesh Kumar and Farhan Ibrahim @ Alias to breach a court order issued by Magistrate Zaki Asyraf Zubir on April 26.

Azmin is accused of abetting and inciting Tangam, Rajesh Kumar and Farhan to breach the barricade surrounding Dataran Merdeka.

The notice also stated that the breach could have caused a riot or clashes in the area.A separate notice stated that Azmin had participated in a street protest with the intention of protesting against Zaki Asyraf’s court order.

The notice said that this constitutes an offence under Section 4(2)(c) of the Peaceful Assembly Act 2012, and is liable to a maximum fine of RM10,000 described in Section 4(3) of same law.

It is understood that Anwar is facing similar charges. This will make the duo the first persons to be charged under the newly-passed Peaceful Assembly Act 2012.

Another person who have received a similar notice is prominent Negri Sembilan PKR activist Badrul Hisham Shaharin. At the time of writing, the details of the notice have yet to be confirmed.

Badrul Hisham was behind Anwar at the time.

Various videos circulating on the Internet depicted Azmin gesturing and pointing over his back while Anwar was depicted gesturing to the former with both hands in a rolling motion.

Seconds later, while Azmin was trying to get down from an elevated platform after the exchange, a man standing behind him appeared to have lifted a metal barricade.

The man behind Azmin was later identified as Tangam, who has been charged on May 3 under Section 143 of the Penal Code for participating in an unlawful assembly, which was read together with an alternative charge of breaching a court order under Section 188 of the Penal Code.

thanggam bersih barrier breach barricade 010512Tangam was the first to be charged over the rally. Two others who have been charged for similar offences are lawyer Rajesh Kumar Gejinder Nath and Farhan, who is also a PKR Youth exco member.

Anwar and Azmin have denied claims that the exchange of hand gestures had anything to do with the breach.

Anwar claimed that his hand signals were instructions for Azmin to negotiate with the Police, while the later claimed he gestured back to inform him that the negotiations were completed.

Attorney-General’s Chambers prosecution head Tun Abdul Majid Tun Hamzah confirmed that only Anwar, Azmin and Badrul Hisham (Chegubard) will be charged tomorrow (May 22, 2012).

His followers will do his bidding and those who do not are quickly removed. That is PKR culture: those who are not get on the wrong side of the law do not qualify as members.

    The video is incriminating. I have changed my mind about this Ketua Umum PKR and would like to see him locked up for good this time.

    At the same time all those who are trying to set up stalls in front of Ambiga’s house should also be punished to the full extent of the Law. It is invasion of privacy. The ringleader of this Persatuan Peniaga-Peniaga Kecil is filthy rich and drives a Ferrari.

    The Mayor should be sacked. The DIGP should be asked to retire from service for being an idiot. CID Agent provocateurs must be charged for their role in inciting violence, not to mention the Men in Blue who beat up citizens. Let us put an end to this culture of impunity. Cry Geranimo.

  2. So much for the Peaceful Assembly Act. When you say people can assemble and then you put 10,000 conditions on it, that “law – an ass if ever there was any” – was always asking to be broken.

    But, the police only said you cannot assemble in Dataran. Anwar and Azmin were not at Dataran proper; they were well outside it. So, what case do the police have? Hand signals? On your unelected mayor of KL’s ass! You think with all those cameras and microphones focusses on A& A, they would let themselves be caught on camera committing a stupid act?

    This is sandiwara and demonisation all over agin. Watch Anwar & Azmin batter an already discredited police, judiciary and unelected PM Najib’s “Govt.” Najib & Kerismudin are gambling wrong big time, again, and will soon be history (as in not even a footnote)!

    Would any right-thinking Malaysian vote for a PM who for 5 years has not ordered the IGP to charge the person who gave the orders to kill Altantuya, thus protecting and covering up for murderers?

UMNO/BN is mired deep in its corrupt ways, that it in fact exploits the legitimate frustrations of the public to serve its self serving interests ,which is to maintain its stranglehold on power. So create more diversions, charge Anwar, Burgers , butts and farts at Ambigas house, stone throwing and vandalism at Merlimau,funeral services at Penang CM’s house, whilst the LEMBEK of MODERATION spends time in USA, squeezing in his sons graduation,with a cooked up working visit , so as to justify blowing tax money !!

And now the follow through. These are distractions. The struggle for freedom continues as it always does. Why have they not charged Ambiga?

    Bean, that is not way UMNO sees itself. It thinks that it represents stability. They will deliver that public good but they want to be paid for it via corruption.   10. The peaceful Assembly Act of 2012 is a very simple Act to understand and to follow. It only has 28 sections. All of us must read, understand and follow if we want to take part in any assembly, demonstration or rally. Don’t blame the authorities and the government. Ignorant is no excuse. Just click, sear have and read. Don’t simply follow the crowd. It is not a picnic when you follow Bersih.

    Anwar as with all the other political opposition leaders have a right to be there as it concerns all freedom loving citizens. Needless to say this is a case of selective prosecution to remove two main actors in the hope that by cutting the head of the snake, the snake would die. Good luck to that.

Never has Umno so blatantly abused its incumbency to impose misrule by law on all Malaysians. To call it this a rogue regime is being too euphemistic.   20. My family and I are more convinced that the present bunch of people running the government has to be flushed down the toilets… Do they know the power of modern communications? For example today, I received in my email three different articles – Vancouver Sun article on Najib, the story of the Ferrari-driving trader and his friendship with Noh Omar, and the suspected whistleblowers at NPC being harrassed and victimised! Najib and Hisham are both really stupid or is Hisham pushing the buttons to remove his cousin?

A probation inspector with an SPM studying for his first year law would know that invasion of privacy does not mean you must physically enter any private space.
