Frustration in Tok Cik’s Perak: Democracy by the Courts, not of the People

Two Lessons from Perak, says The Malaysian Insider

First, the courts are not the final arbiter.

Such is the decaying state of institutions in Malaysia that these days a Federal Court decision is treated as just another decision. It does not have the gravitas of the US Supreme Court; its judgments do not have clarity nor authority of the House of Lords, Supreme Court of India or the highest court of Canada.

Such is the cynicism that envelopes institutions that a good many Malaysians spent this week speculating whether the final score would be a 5-0, 4-1 or 3-2 finding in favour of Datuk Dr Zambry Abdul Kadir as the Mentri Besar of Perak.(Note: 5-0 was a popular choice not because many Malaysians subscribed to the legal arguments put forward by the state but because cynicism courses through their veins.)

And that is why while Zambry obtained the result he needed he still cannot have the one thing he craves most – legitimacy.

Some 74 per cent of voters in Perak feel that elections remain the best way to resolve the power grab in the state. In the same survey conducted by Merdeka Center, voters were asked to choose which they preferred: the economy or having a democratically-elected government. Sixty per cent of the respondents said they wanted a government elected democratically.

So the Federal Court may have ruled 5-0 in favour of Zambry but in the eyes of most Perak folk and Malaysians, this result counts for little.

Secondly, a scarred royal household.

The Federal Court today affirmed the pivotal role played by Sultan Azlan Shah in the change of government in Perak a year ago. It was the former Lord President who interviewed the three elected representatives who resigned from Pakatan Rakyat and surmised that Datuk Nizar Jamaluddin had lost the confidence of the state assembly!

Nizar’s lawyers and renowned constitutional law experts from Malaysia and abroad agreed that the proper forum to test a motion of no confidence should be the legislative assembly.

But the Federal Court endorsed the steps taken by HRH Sultan Azlan Shah to ascertain if Nizar still had command of the House. The intervention of the Royal Household a year ago invited scorn from Malaysians, who felt that the Ruler should have done the right thing and that is to dissolve the state assembly.

Has the anger and disappointment with the Palace gone away? No. The Merdeka Center survey shows clearly that a significant percentage of the people of Perak are dissatisfied with the role played by the Palace in the Perak coup. Some 35 per cent of those polled were dissatisfied while 36 per cent expressed satisfaction but, tellingly, 29 per cent were undecided.

The large percentage of the undecided voter are made up of Chinese (41 per cent) and Indians (27 per cent), the two groups of voters who continue to be strong supporters of Pakatan Rakyat and feel strongly that new elections should be called.

So it can be surmised that the bulk of the 29 per cent of voters who did not want to give a clear answer to this question do not agree with the intervention of the Palace.

  1. I wonder what Tok Cik is feeling right now. As a democrat – soldier, he could be under the weather, pushing his big middle finger up in the air in salutation of this Federal Court decision, which endorsed the UMNO Mentri Besar.

    Last year, it was the Royal Palace which replaced Nizar with that Kadiak boy since the former no longer had the support of the State Legislative Assembly based on the Sultan’s assessment of the situation after his Royal Highness had interviewed the 3 stooges (2 from PKR and 1 from DAP). Perak is again in crisis and the impasse can only be settled by a fresh elections.–Din Merican

    A serious challenge to the concept of constitutional monarchy. Looking forward to reading the written judgment of the country’s highest court chaired by Abang Aki( Abang Aki, you arm wrestled the other federal justices just as I thought you would but I would have thought you would request for at least one dissenting judgment. After all it is a controversial decision seen any which way).

    Like I said earlier and to quote Thomas Jefferson, one of the Founding Fathers of today’s beacon of democracy of the Free World:

    “A judiciary independent of a king or executive alone is a good thing; but independence of the will of the nation is a solecism ..” – Thomas Jefferson

    In this case, the judiciary not only went on the side of the king (who has his arm twisted by the chief of the executive branch) but tore to shreds the concept of constitutional monarchy. The role played by the ruling party at the federal level is now forgotten and focus has now shifted to the federal court. Najib will now say it is the federal court! He’d say, “We left it to the country’s highest court to decide on the law – and they have decided and we have to follow.”

With a few days to go before the judgement, I was taken pleasantly aback by the great optimism shown by Nizar & Gang in Ayer Tawar ( Perak ) where there was the expectations of an imminent fair deal from the Apex Court ( or was it a red herring ), although prior events leading to the time from the extension of the IGP, appointment of UMNO friendly Chief Judge etc and glaring misjustices in the likes of Lingam correct, Altantuya C4,Teoh Beng Hock MACC, Nizar 1 vs Sultan, Rosli bkt aman, RPK sedition 1,2,3,4,& 5 , isyaAllah omg !, Sodomy2 Utusan and so on had confirmed beyond any reasonable doubt that a great no of the judiciary is stained and in cahoots with UMNO with judgements already determined way before the trials had even begun.

    This latest judgement has confirmed that the Malaysian Judiciary proper is now stained beyond repair. $$$ rules OK !

    In the U.S. it is crystal clear who will succeed the President – the Vice-President, followed by the Speaker of the House.

  6. So, a sultan who does not like his Menteri Besar (which is common nowadays) may one day call 51% of the state assembly members to his palace and then declare that the MB has lost support of the majority and appoint a new MB as the old one is considered sacked.
    Now what happens to the country? Will the king sack he PM.

    The written judgement is surprisingly out Bean; and NHChan had a look into it and not surprisingly said: “Tsk, tsk, tsk… contradicting themselves.”
    This i presume, is called backroom justice. Not democracy anymore – it’s absolute monarchy!

    No point crying over spilt milk!!! Let’s move on. Advise Anwar and PKR to choose better leaders in GE13. Do the groundwork now!!! To a certain extend i quite agree with Syed Nazri and most people that Anwar is only interested in being PM. PKR is looking weak now and they have to strenghten their resolve. The cause is bigger than Anwar wanting to be PM. What he has to do now is be selfless and chart a handover process.

    I may sound insensitive with what Anwar is going through now but if he is sincere about the cause then start doing the real work!!! He can be free once PR form the new GOVT!!!

  10. You guys think judges apply the facts to the law and decide?? No. They decide first. Then they search for the legal reasoning and come up with a judgment consistent with their decision formed earlier.

  11. Great , now we’ve a living dead , a Zombie to master over the brain dead people of Perak. Brain dead due to a system which is set in such an atocratic way that the subjects of the state purportedly living in a modern society are programmed to comply.

    It all boils down to democracy , politics and autocracy , the three synonomous words in dispute , and as clear as daylight we bare witness which of the three emerged victorious over the other.

    From the very beginning , for the ruling regime, the constitution never was the subject matter. On the contrary, it was furthest from their minds. The prime factor and ultimate goal was and is , umno supremacy by way of political might and the strong persuasion of the $$$.

    The judges , police and any entity in between are but mere extras , made as stand in’s throughout the entire episode!!

    They have readied the boilerplate argument to be used in states facing similar situations.

    As the saying goes, every dog has its day. When your day arrived make sure your anak mami remember the day you drove from Parit to Putrajaya with your bullets fully loaded. That will also the day we see Dr. Bean arranging ticket for his niece and her husband.

    Tok Cik’s Cooper S backseat cannot withstand the combined weight of Kak Pidah and Cik Mah Cik Cot’s asses, substitutes for Sharizat’s ass. Tok Cik has to make do with substitutes for the time being and has to effect tactical retreats otherwise known in military lingo as deployment. Sharizat and Abang Aki both sleeping partners of a law firm are busy deliberating on the coup de grace to be delivered deep into Anwar’s ass.

    Here we are talking democratic politics. In Malaysia, executive power is working hand in hand with the Palace with the courts as the source of the legitimacy of their action. Democracy is emasculated. Elections have become meaningless. Every schoolboy and girl know we do not have clean and fair elections.

  19. Sorry guys for keeping all of you guessing.

    I was in Putrajaya with my gang to, hopefully, welcome a verdict that would see a new beginning for Perakeans. But at long last, what a disappointment.

    When the rest left for home I ambled off to my son’s house in Damansara to lick my wounds, literally. Spent the nite at Aman Club with my army buddies to forget the bitterness.

    Could not get Sharizat to come. She’s rejoicing with her boss, Najib over the court decision.

    Btw the Zambry is holding his weekly Executive Committee meeting in Putrajaya today, Wednesday, Feb 10.

    I once told Nizar that it would better for him to go into the fray as an underdog rather that the favourite. But he didn’t quiet fathom what I meant. With the lop-sided judgment, Perakeans will have more reasons to kick Zambry and his lackeys out of the state legislative.

    I am miffed but have to accept fate. Not many Perakeans were surprised by the outcome. It was a forgone conclusion. When we deal with slime-ball judges this is what we get.

    Thanks Din, Bean, tean and all of you out there for your unwavering support. We have lost a battle but not the war.We’ll recoup for the final battle. GE 13 will be Jibby’s Waterloo.

  20. Conventional warfare requires opposing sides to employ conventional tactics and weaponry. But to bring down Jibby’s government we have to employ unconventional tactics. Hitting him where it matters most becomes our target. Mao, Tito and Che Guiera had wedged wars against more organised armies using unconventional means. That’s what Pakatan Rakyat should consider.

    You did the right thing. You left this stupidly governed country ( is it a country anymore, with the Judiciary that is an arm of the Executive ??), and stayed in the land of the free and the brave.

    Those expatriate Malaysians from afar must continue to speak up without fear for their fellow Malaysians who are being cowered with fear by this oppressive govt who does not winced using the security apparatus and the judiciary to stifle criticisms and condemnation of the raw abuse of power by this UMNO-led Govt.

    I am not surprised neither should any one of us.

    ALWAYS REMEMBER, the CHIEF JUSTICE , Zaki Azmi, was a former Legal Adviser of UMNO and he was appointed by this UMNO-led govt.

    All the judges in the Federal Court and Appeals Court are pro-UMNO, and they are no more the steward of justice or the protector of the Constitution. They are the apparatus of UMNO.

    This landmark decision is the final nail into the coffin of the Federal Constitution.

    The Constitution is Dead destroyed by the Judges of the Federal Court and the Court of Appeal.

    Let us us make Syariah Law the law of the land and cut the bullshit about our secular laws.

    Being in China for some time, I have come across some documentary series on Chinese civil war between Kuomintang & the Communist. Kuomingtang is just like UMNO has been in power for some time. But because of the corruption of its leaders, lead to its demise.
    Not surprised that Kuomingtang at the beginning of the civil war, it has the best armies in quality & quantity. But it does not have one thing. People’s suipport. While the Kuomintang’s money suffering massive inflation, Communist’s money is acceptable as valuable even it was written on a pice of paper. It’s definitely not notes
    Unfortunately, some Malaysians are blinded by race & religion. These were people who suffered but support this corrupt regime wholeheartedly. Hairan! Hence, the battle of minds & hearts of people has just begun.
    As such we should put the need of third force, it’s divisive & only regime like UMNO benefits most. Lets us force in get rid of this enemy first.

    An understatement, I’m afraid.

    Abang Aki is not just a legal advisor to UMNO but together with UMNO looted the coffers and built a vast financial empire with the help of his masters in UMNO. He’s an active participant completely loyal to his masters though he did gripe to me occasionally about how he’s being made to do things for them. Well, there’s a price for everything Aki. In your case your price tag came in the millions.
