The arrests of MP Theresa Kok and journalist Tan Hoon Cheng under the ISA following that of blogger Raja Petra Kamarudin raise grave concern for Malaysians.

An endearing legacy of Abdullah Ahmad Badawi’s leadership that we have come to appreciate is the openness albeit limited, that has come as a breath of fresh air after 2 decades of punitive control of the public sphere.

The arrests of the three individuals under the draconian law at a time when Malaysians have become more mature politically and less inclined to be baited by racial politics will no doubt further erode the legitimacy of and support for the ruling party, perhaps irrevocably.

Of no less import will be the repercussions to Malaysia’s reputation internationally, that time and again the ruling party resorts to an unjust and antiquated piece of legislation to silence dissent in order to sustain her cling to power.

It is clear to all that the arrests of MP Theresa Kok and journalist Tan Hoon Cheng are completely without justification. Tan was merely doing her job as a journalist and UMNO has undertaken the appropriate measures, including an apology from its deputy president. In the “Puchong Azan Issue”, MP Theresa Kok was arrested over what is clearly a false allegation. We urge the authorities to immediately release the two and bring to book those responsible for fomenting racial and religious hatred.

It cannot be completely denied that Raja Petra Kamarudin in his writings and those who contribute to his blog have expressed views that many Muslims consider as denigrating the prophet and the religion of Islam. However we believe this can be countered by sound arguments based on well accepted teachings and sources of Islam. In the extreme, the authorities may take him to the Syariah court. The use of the ISA is excessive, inhumane and runs counter to Islam’s principles of justice.

In this blessed month of Ramadhan, we urge the authorities to act justly in carrying out their responsibility of maintaining the peace and security of the country. We also urge everyone in the public sphere to exercise restraint and wisdom in discussing issues of race and religion.

    I have always thought that RPK seems to have a death wish of some kind because of the many warnings he received and his persistence in engaging in the same line of argument with reckless disregard for the law – laws like the law of defamation. For that he would have to face the consequences of his actions. We cannot play by double standards i.e. on one hand we say we need a return to the rule of law and on the other hand we seem to want to excuse someone who has broken the law – allegedly, of course.

    Their only interest in applying laws such as the ISA is in the absence of legal safeguards. The right to due process which is a constitutional right is denied anyone arrested under this law. The legal burden of proof is reversed and sits instead on the shoulders not of the party who alleges but those alleged to have committed the crime. What is worse is that the party alleged to have committed the wrong has to discharge his or her burden without ever seeing the state’s evidence!

    Nobody is saying that RPK is completely innocent but at least give him his constitutional right of due process. Have him charged for crimes he allegedly committed and allow him bail so he could prepare for the state’s case against him. Give him the same rights enjoyed by murderers and thieves. Is that too much to ask?

    Obviously it is! There is another agenda.

    They should! Why haven’t they done so is obvious. Lots of dirty linen to wash in public.

    What the prosecutor has charged him with is criminal defamation. It is harder for the Public Prosecutor to prove criminal defamation than it is for Najib and wife as Plaintiffs in a civil action to prove civil defamation because of the different standards of proof involved. The criminal standard of proof is ‘beyond reasonable doubt’ as opposed to the lower standard of proof in all civil cases which is ‘on the balance of probabilities’.

    These people want to put RPK out of circulation for a period of time and see what happens. Also when his defamation case comes he would be ill prepared since he would not have the same kind of access to counsel the way he’d have if he were a free man.

    The government – and those who seem to want to excuse RPK from blame.

    Don’t get me wrong! I’m with RPK as far as freedom of speech is concerned. We all are. What got RPK into trouble is not so much the freedom of speech but the contents of that speech! His reckless disregard for the law is what got him. What good is he to the rest of us now that he is detained indefinitely??

    You say his sources are “impeccable” . Well the rest of us don’t know that. I don’t know that. I’m not challenging the veracity of the evidence that he says he has – and I’m not casting aspersions on his character by saying that I do not know. Lawyers don’t decide the guilt of the accused. The court does.

    Yes, why??

    There isn’t the same respect for the law as there is over here. Malaysia’s judiciary functions as an appendage to the executive branch and has lost enough of its credibility to become the butt of jokes of not only Malaysians but of lawyers everywhere.

    Mahathir and his ilk, just like Dollah and his ilk, are immune or above the law – at least for now. Soon they will be out of reach from the long arm of the law. Through abuse of power and the threat of selective prosecution, they managed to silence their critics.

    The country’s top prosecutor sits on his ass all the day until he is told to move. When he does he acts more like an instrument of oppression than of justice.

    You escape from being charged with sedition when you are defending UMNO and its policies but fall foul of the law of sedition when you criticise UMNO and its policies. That is not new. It only became glaringly so only recently.

    So what do we do?? Make more donuts and knead more buns? 🙂

    RPK has his source of information, and he put forward his analysis. It is up to us to believe or not based on our own judgment. Furthermore such investigative journalism is much needed in this nation when state institutions such as police and judiciary are badly malfunctioning.

    How could putting up articles without any resort to violence constitute reckless disregard to the laws?

    “It seems the Affidavit also reveals that Altantuya was camped outside Razak’s house and this caused him to panic. He then went running to Najib, and Rosmah summoned Najib’s ADC, Musa Safri, and instructed him to solve Razak’s problem. Musa then summoned the two police officers currently on trial.     I find nothing defamatory here.

    But RPK did make a sworn statement, a statutory declaration, didn’t he? He adopted what was told to him by unnamed sources (?) as being his own(?) and true. That apparently could have exposed him to allegations of slander, libel and defamation – and sedition(?). I don’t know the contents of this statutory declaration.

    When I said RPK has a reckless disregard for the law, I’m referring to his habitual use of hearsay as substitute for the truth, his reliance on hearsay to make his point, his use of hearsay as talking points probably in an attempt to increase readership for his blog. I believe his focus is on entertainment rather than serious journalism. There is nothing wrong with that. I believe he expects visitors to his blog to take everything he writes with bucketfuls of salt and separate the truth from fiction themselves. Their failure to do so is their fault and not his.

    Is it surprising at all that many of his readers visit his blog to find out what is the latest in the grapevine? I do. Where truth stops and gossip begins is something he leaves it to his readers.

    However, I believe he knows there is a line he should not cross. He is not stupid. Whether he did cross the line in this particular case is the subject of the charge and for the court to decide.

    I do not know enough to say that he did cross the line in this case for him to be charged with criminal defamation. Criminal defamation, in any event, is not easy to prove. But if he did I’m not surprised because I think he has a careless disregard for the truth and his near contempt for lawyers suggests to me that he has a reckless disregard for the law as well. It is understandable because the guy suffered a lot as a result of the abuse of the law and the legal process.

    That having been said, based on the little that I know, I believe the government has no case against him in criminal defamation. I do not know about sedition though. My opinion on both counts, however, is not relevant to prove the truth. 🙂

    I tend to agree with Bean in this instance. There were times when RPK’s statements were taken out of context. He wrote about the Bersih rally in KL where armoured vehicles were sighted attributing it to an Agong’s directive who being the supreme commander of the armed forces had deployed the armoured regiment to counter any moves by he Police to act on the protesters. I had verified this with my friends in Mindef and they told me something else. The armoured vehicles were deployed to KL in anticipation of a need to assist the Police. The vehicles were there to quell the protesters not to support them.

    In time like this when the mainstream media are so unreliable resorting to rumours is the rule of the day. We all like a good story where the ending is to our liking.

    I think we could agree that certain preconditions must exist before there could be a rule of law.

    One of those is an independent judiciary – the third pillar of government. But having an independent judiciary is not enough. An efficient court system is another. Judges would have to be appointed along bipartisan lines, based among other things on their judicial philosophy and not based on their political affiliations. Lawyers are also officers of the court and it is important that as members of the legal fraternity they live up to their strict training and uphold the values of their profession.

    It is not semantics. Here’s why. You can have an independent judiciary and yet not have a rule of law. But you cannot have a rule of law without an independent judiciary.

  13. As a non Muslim, I am indebted to RPK for educating me on how beautiful Islam could be when its more profound truths are practiced. Instead of the wild-eyed sterotype Muslim of the Western press, RPK taught me the strong emphasis on truth, justice, fairness that it teaches. So I am shocked when he is accused of being the blasphemous Muslim of the worst kind. Between the Islam practiced by the government leaders and that practiced by RPK, no right thinking person could beleive that the former is superior to the latter.

  14. Is Malaysia mature enough like Mozambigue where political parties that are based on tribe or religion are not allowed? In Malaysia we have seen and are still seeing how dirty politicians play up race and religion for their selfish greed for money and power. Can we follow Mozambigues’s example? Can Malaysians not call for all political parties that are based on race and religion to open up their membership to all Malaysians.

  15. Theresa Kok is innocent and I believe that even the Minister of Home Affairs knows that.

    But arresting her for being “against Islam” can hopefully cause many Muslims to think that DAP is really against Islam and should not be allowed to form part of any government.

    And if UMNO succeeds in creating this negative image, then PR will lose support.

ISA is an outdated law inherited from the Mat Salleh and shud be discarded and repealed.The point here is the 3 of them shud not be charged under ISA.If they had broken the law they shud be charegd in court.     I am not a lawyer but you are. You say that RPK has reckless disregard for law. Which law are you talking about? You live in the US assuming that a journalist has information about Barrack’s secret life shame. Though it may be hearsay, wouldn’t it be front page for his newspapers? The probably Barrack would sue the newspapers for false information or something. The newspapers and the journalist would have to defend their source of information. So at least both sides defend what is truth and let the jury of the court decide. Where else in RPK’s case, he is in ISA, how is he to defend himself? I don’t know what wrong has he done. My opinion of RPK is that he is brave enough to speak about issues where the powers that be feels its taboo and use this issues negatively for cheap publicity.

    I am a non muslim and i have learn to appreciate and respect Islam through RPK’s writing.

    Like i said i am not a lawyer so i really don’t know what law he broke. To me the powers that be are just afraid of him and because they have power to abuse power is the reason why he is in ISA.

    The next person in my race who still can’t understand why muslim and malay can clearly see the line between right/wrong is going to get his/her butt kicked real hard by me.
    For many years i thought to myself, unless this older generation of chinese/indians and malay pass away, the racist sentiments will always be around, they are just too “brainwashed” by the gov to think straight.

I admire RPK for whatever methods, stunts, tricks etc…… he has used knowing full well that this govt would use the draconian law, the ISA (which has been abolished by its founding fathers) on him. RPK was prepared for it and it is the acid test for the govt. If this govt survives then we can savely say RPK is wrong. So until then we cannot judge RPK, our mentor and maha atma!

    I applaud your stand on these issues. You have shown strength, courage, responsibility and maturity of thought when some irresponsible parties are trying to stir up issues of hatred on the basis of race and religion, to achieve their own political ends.

    Being a non-Muslim, I am proud to walk beside my fellow Malaysians such as you, in our endeavour for a better Malaysia. Race based politics MUST end now, today, to preserve our beloved country’s legacy for our future generation.

    My wish is for more Muslim groups in Malaysia to come out to publicly declare and state their stand against such injustice (the current ISA detentions) which has no place in Islam. This is Ramadan, a Holy Month. Not only must we do things right, we must also be seen to do the right thing.

    A million words by non-Muslims will not carry much weight to the current Government and Politicians whose intent is clearly to manipulate us Malaysians.

    It is words and stands by Muslims themselves that can debunk this malicious insinuation by our own Government and Politicians. Once again, other fellow Malaysians are waiting for, and urging our responsible Muslim citizens of Malaysia to step forward and tell our Politicians that they shall not, and are unwilling to become pawns in this dangerous game to promote religious hatred in Malaysia.

    This is a great opportunity by you, my fellow Malaysians, to send a strong message to our Politicians that you reject their wicked attempt to pervert your revered religion, Islam, to manipulate the Rakyat.
