BREAKING NEWS: FREEDOM under Threat.

I have just received (at 1.24 pm) a call from Raja Sara that her Dad, Raja Petra Kamaruddin, the Doyen of Bloggers and websmaster of the popular http://www.malaysia-today.net, has been taken in under ISA and that the Police are at their residence. Dato Ahmad Ismail, UMNO Bukit Bendera Division Chief, gets away with a 3-year suspension for his racist remarks with intent to incite unrest, and Raja Petra gets the ISA  purportedly for being “a threat to national security”(?). This makes a mockery of the Rule of Law.

Who is behind this? If it is Najib and Syed Hamid AlBlur are behind this move on Raja Petra, then I can only conclude that Badawi has lost control of his own government and he himself is under siege.—Din Merican

PUTRAJAYA: The Cabinet has ordered the Multimedia and Communications Commission (MCMC) to reinstate access to all blocked websites, including the controversial Malaysia Today news portal.

Energy, Water and Communications Minister Datuk Shaziman Abu Mansor said the order was made because there were other “harsher” laws in the country which the authorities could use to take action against the owners of blogs and websites, instead of blocking them.

“The Cabinet has asked the ministry to direct MCMC to reinstate access to any blocked website with immediate effect.

At the same time, it is asking for MCMC to closely cooperate with the police, the Attorney-General’s Office and the Home Minister to monitor websites and blogs to ensure that they do not contain seditious, racist or religiously insensitive remarks.

“Instead of blocking access to such websites, the Cabinet wants authorities to investigate and act quickly against the owners of these sites,” he told reporters at a press conference which was also attended by MCMC chief operating officer Mohamed Sharil Tarmizi.

To monitor the content of websites and blogs hosted in Malaysia, Shaziman said that a committee comprising representatives from the A-G’s office, the police, and his ministry as well as the Home Ministry, had been set up two weeks ago.

The minister denied the Government had come under pressure from various groups, including former Prime Minister Tun Dr Mahathir Mohamad and Deputy UMNO Youth chief Khairy Jamaluddin, who had criticised the blocking of Malaysia Today.

“We want to encourage the spreading of information via blogs and websites but at the same time, the owners must be responsible for their postings and content,” he said. MCMC had instructed all Internet Service Providers (ISPs) in the country to block access to Malaysia Today.

Since then various parties have slammed the move saying the action went against national commitments spelt out under MSC Malaysia’s Bill of Guarantees. Shaziman said action would now be taken against the owners under diverse laws such as the Sedition Act, the Penal Code, the Communications and Multimedia Act, and even the Internal Security Act.

“In the Cabinet meeting on Wednesday, the Prime Minister informed the Home Ministry that detention under the ISA should be considered if the situation in the country had reached a dangerous and unacceptable level. “This is important to preserve racial harmony,” he said.

On the police report lodged by the Department of Islamic Development (Jakim) and several Muslim bodies against Malaysia Today website editor Raja Petra Kamarudin for allegedly insulting the Malays, Muslims and Islam, Shaziman said police investigations on this matter were still ongoing.

Home Minister Datuk Seri Syed Hamid Albar had earlier said the site was target blocked because it showed no respect for religion.

The Cabinet’s decision received the thumbs-up from various groups, although some bloggers said the initial ban should not have happened in the first place.

Malaysia Today editor Raja Petra Raja Kamarudin said he was not surprised with the “flip flop decision” and considered the whole situation as ridiculous.“They have been contradicting themselves on whether to block or not to block, the decision makes no difference to me,” he said when contacted.

Raja Petra also said he would leave the old website as it is and those who wanted to access his website could continue to do so at which was set up after his initial website http://www.malaysia-today.net was blocked.

Blogger Ahirudin Attan, who runs the Rocky’s Bru blog, said the lifting of the ban was great news but added that MCMC should be asked to explain why it blocked access in the first place. “It is ridiculous to block a website as it can still be accessed via mirror sites.

“It also goes against the Government’s promise not to censor websites. The Government must renew its pledge and ensure this does not happen again,” he said.

Another blogger Oon Yeoh said reinstating access was a necessary move to “prevent a bad precedent from being set as justification for future crackdowns.” He said it was not necessary to ban websites as there were enough laws to deal with libelous and seditious matters.

Meanwhile, lawyer Sonya Liew said one should be careful when making online statements as action could still be taken under present laws, especially if the statements were defamatory or seditious.“Action can still be taken under the Sedition Act, the Defamation Act, the Penal Code and even the Communications and Information Act.

The Acts are in place to safeguard individuals from harassment, including online harassment, and to also ensure the country’s stability.“The Internet encourages freedom of speech, Where do we draw the line? The government must find a way to deal with this,” said Liew.

Section 233 of the Act deals with the “improper use of network facilities or network service and related to communication that is obscene, indecent, false, menacing or offensive with intent to annoy, abuse, threaten or harass another person.”

If he fails to deliver his promise to become PM by 916 or even 920, then it looks like RPK will be languishing in Kamunting for a long time. Please convey this message of urgency to Anwar, Din. The monkeys have decided to lock up one of the greatest warriors in Malaysia, fighting for our freedom. While a Ahmad Ismail gets off scott free for TRYING to start racial violence.

    My first posting in your blog. This is like the cruelest joke ever played. First they unblocked the site then they arrest the Chief Editor of the site under ISA. I truly have no respect for the Govt. To me, they have no credibility and principle left in them. I am just truly disgusted by this news and it clearly spoilt my day. I truly think that the Govt. is just so bankrupt of ideas and their only tool is to used the ISA and showing show cause letters.

    You are right about Pak Lah shooting himself in the foot again. I am more sure now that majority of the Rakyat despises him and his band of lowlifes. I am sorry if my expression is harsh but waking up everyday to this Govt. is like having rotten eggs for breakfast.

    As a Malaysian, I am totally DISGUSTED and have completely lost faith for the current government.

    What dopey lacks in spine is more than made up for by the not-so-senile agent provocateur’s evil. The timing reeks of sulfurous fumes.
    This incident behooves DSAI/PR to move faster now than ever to preserve the sanity and integrity of our nation.

    I’m usually not interested in politics but with the recents events and plus the jailing of PRK while allowing people like Ahmad to walk free without any further punishment really made me felt totally disgusted with our government.

    I think they still don’t get it.
    You can’t force a stop on the momentum of change by using force.

    I might not have the strength & courage to fight like RPK and others but I will at least stand up against injustice mettled to them as a Malaysian.

    They tried to create racial tension in Penang through Ahmat Is Mail and Bodowi was definitely involved because the incident of ripping the photo of happened a day after Bod0wi went to Penang. I wonder whether the Bodowi group gave instructions to increase the racial temperature.

    This could explain the relatively light “punishment” for the bastard.

    RPK, the man who stands for justice for all is put away under ISA and the satans who tried to incite racial strive are free.

    We really need the change of Government. Please send a word to Dato Seri Anwar Ibrahim to not make the wait long. It’s unbearable…..

    Our first order of business is to ensure that Mdm Marina Petra and their children are safe; we must stand ready to help them, moral as well as financial or any other way we can. Here I am counting on your understanding and cooperation. The Blogger Group at Fisherman’s Wharf led by Haris Ibrahim and Bernard Khoo will be planning something and I will keep you posted.

    Second, let us pray that Raja Petra will be treated with dignity and granted his rights while in Police custody. He is strong and determined to rough it out. But he needs God and our prayers too. We must ensure that he is not forgotten by the Malaysian public.

    Third, PR leaders will do everything they can to ensure that Raja Petra is safe. We have outstanding lawyers.

    Finally, I hope those BN and UMNO MPs including those having fun in Taiwan realise that their government is increasingly repressive. They must now make a stand and join PR to change the way we run the country, if they truly care for their country and Malaysians who voted them into positions of respectibility. They must give Anwar Ibrahim the chance to lead us out of this political and economic mess created by an incompetent and corrupt government led by Badawi. The sooner the PR takes over the better it is for us all.

    Your role? May I suggest that you ask your MP to act and join PR. You can also explain to friends and neighbours about what is happening to our country. Please ask them to pressure their MPs, but do not disrupt the peace or incite violence.

    The days of sitting idly by and being unconcerned or indifferent are over. Today, it is Raja Petra. We could be next since we are dealing with leaders of UMNO-BN who are under mental siege. Save our country, our democracy, our economy, and protect our fundamental freedoms. —Din Merican

And all they get is a three year suspension!!! Raja Petra gets detained under the ISA for telling the truth and for trying to make Malaysia a better place, politically. I do wish that DSAI would hurry up with this sept 16 thingy, as i am getting more and more impatient by the day!!

    A lot of hope has been riding on PR’s ability to take over by 16/9/08. And we must agree that with the bold statements that have been consistently pronounced by the PR team, many people felt liberation was around the corner. Perhaps this high anticipation also contributed to an increased level of boldness agst the present day UMNO led Gov, & thus the release of waves of criticisms agst it, or ppl connected to it. From the blogs such MT to unabashed reportings of the likes of Citizen Nades, there was a sign of a deep hunger for truth & justice.

    Were the present ISA & show-cause letters un-anticipated? No.

    But that is where the hopes of PR taking over comes into play. I must say, if the best we can do, is to hope that present BN MPs in Taiwan, or elsewhere, will simply join PR, then may be it is a thin slice of hope that we stand upon. Why? If we had those 30 or so MPs that wish to change over, shouldn’t they do so now, or even earlier? Why must a PR tean be sent to Taiwan to meet up with them? Unless, there is still some convincing that needs to be done? If we have the numbers, execute the plan now. Unless we don’t. And then the trip by PR to Taiwan becomes necessary.

    The BN, as we see now, isn’t waiting for 16/9, or any other date for that matter. They are going for execution now, & every other day sees someone else being taken down or sacrificed….but for what? If 16/9/08 does not happen, then, nothing else matters. RPK and every other ISA detainee will remain locked up; BN will consolidate it’s position, Mahathir will be back on the saddle,….& life just goes on…

    Din, we must stop shouting slogans and saying inspirationals and so on and so forth. I mean, these things are nice & needful every now & then, but what we need is action now. Patton can’t continue to deliver his “Speech to the Third Army” forever. It’s time to step down to the beaches of Normandy and do it.

  29. Syed Hamid Albar and Najib need each other more than Badawi needs them. After all by now Badawi must be quite comfortably assured that he is going to leave after all. Now or later does not matter. And after all he cannot go any higher and he knows it.

    The one feeling most threatened is surely Najib. And Syed Albar too for trying to be too clever by half.

    Yes, it sounds more like Badawi is losing it and this could be a Najib/ Syed Hamid Botak escapade.

  31. I’m soooo sad by this arrest on RPK. His intentions were noble and sincere. He wants justice and he also highlights the weaknesses of the present majority population with regard to their religious beliefs. His religious postings does not in any way degrade Islam. Just ask the PAS experts on religion. Maybe a debate between the government religious scholars against the opposition religious schoalrs on Islam is required. What a sad day for Malaysian democracy.

    The best lawyers in the world cannot set a guilty man free. The best lawyers cannot set RPK now detained under an act like the Internal Security Act free. They can only challenge the Minister on procedural matters and that will not be enough to set a detainee free since procedural flaws can be corrected and the person detained and the process begins anew.

    There is no legal solution to a political problem.

  37. For the last 12 hours I have been sitting infront of my computer, hopping from one blog to another, reading most of the scripts and comments regarding the ISA-ed of Raja Petra. Most are like me ,hot up to the neck with anger, many cried and pray for RPK, and many more offered “what can I do to help”.
    Apart from the above, what can we really do???
    To avoid another 513, the only person who can help is the Sultan of Selangor. Yes, the Sultan is the protector of his subjects, right? Do the Sultan consider RPK his subject?

  38. In l969 I was working in Ipoh. During 513, the Sultan of Perak at that time ordered a curfew in his state. With’in 3 days he lifted the curfew. I learned that during that 3 days the Sultan travelled in his jeep from Taiping to Sitiawan, from Ipoh to Telok Anson, Bagan Datok and Ulu Selangor.
    So concerned of the safety and well being of his subjects that he even made sure that the police helped the people got their food and sundry.
    In the Royal town of Kuala Kangsar, those chinese who were frighten converged into the compound of the royal Palace, and was given protection there.
    May 513 came to pass without an incident in the state of Perak!!!!!
    That was my beloved Sultan of Perak.

Fear got the best of you, and in your panic you turned to the now high chancellor, Adam Sutler. He promised you order, he promised you peace, and all he demanded in return was your silent, obedient consent. Last night I sought to end that silence. Last night I destroyed the Old Bailey, to remind this country of what it has forgotten. More than four hundred years ago a great citizen wished to embed the fifth of November forever in our memory. His hope was to remind the world that fairness, justice, and freedom are more than words, they are perspectives. So if you’ve seen nothing, if the crimes of this government remain unknown to you then I would suggest you allow the fifth of November to pass unmarked.
