Police Black Eyes

Anwar Ibrahim has been released on police bail this morning.

Yesterday, the Prime Minister Abdullah Ahmad Badawi promised that there will not be another “black eye” trauma for Anwar as happened ten years ago.

However, the police has received a “black eye” of its own making, in its highly-provocative, unprofessional and unjustifiable arrest of Anwar by police commandos in balaclava at 12.55 pm yesterday – when the former deputy prime minister had already promised to report to the police at 2 pm.

This is the second self-administered police black-eye within a week – the other being the completely unjustified three-day 1,600-personnel police operation to lock down the Federal Capital and the Klang Valley to thwart a massive demonstration in Parliament on Monday when there was not a single protestor – causing great and unnecessary inconvenience and hardships to hundreds of thousands of people, plunging public confidence in the efficiency, competence and professionalism of the police to an all-time low.

The two self-administered “police black-eyes” in the past week raises the question whether the Royal Police Commission set up in the early months of the Abdullah premiership and which made 125 recommendations to create an efficient, incorruptible, professional world-class police service – with its most important recommendation for an Independent Police Complaints and Misconduct Commission (IPCMC) – has turned out to be a total waste of time, resources and funds!

COMMENTS:

It is time we make IGP Musa Hassan accountable to the nation for what is suspected to be conduct detrimental to the honour and integrity of the Royal Malaysian Police Force.

For starters, he should be asked to go on extended leave to allow a thorough and unfettered investigation of the evidence fixing report by Anwar Ibrahim. This mattress lugging IGP has plenty to answer for. One would not be far off the mark if one thought the method and style of the party that arrested Anwar Ibrahim near his home carried Musa’s imprimatur.

It was as if they were on the trail of a dangerous misfit whose arrest and arraignment was top priority for the Force. You would not suspect that it was over a report of sodomy; more like arson or murder — the way they were clad in balaclava and toting weaponry suitable for the interdiction of a Botak Chin or a Bentong Kali.

Come on guys, this is Anwar Ibrahim they were after. Unless you are suffering from a severe case of amnesia, this is the former Deputy Prime Minister and Finance Minister of Malaysia, a man widely regarded as one of the Muslim’s world leading public intellectuals, esteemed by political leaders and opinion makers in the West and in the rest of the world and recently listed by Time magazine as the only Malaysian in their ranking of the world’s 100 Most Influential People.

Detained and subjected to questioning at the Kuala Lumpur Police Headquarters, the Police then took him to the Kuala Lumpur General Hospital for a medical examination that required him to strip and have his private parts examined.

Thank God, he had the presence and sternesss of mind to refuse to be photographed in the buff. Had Anwar submitted to the usual Police pressure tactics (that is the Good Cop Bad Cop routine, I mean), there is no guarantee that these photographs would not be manipulated for salacious couplings with Godness knows who–to bolster innuendoes about his sexual perversions.

When it came to extractions for a DNA test, Anwar flatly refused, knowing that he would be subject to the possibility of more diabolical manipulations by the same people who took such obscene delight in lugging a supposedly semen-stained mattress at his previous sodomy trial in 1999. Having been bitten by that traversty of a trial, Anwar is suitably warned.

Of course, his refusal to submit to a DNA sampling now exposes him to the surmise that he has something to hide. But such deductions do not take account of one glaring fact that Anwar has yet to be shown the report of his accusser. There is more than an even chance that the catamite had not made a detailed report of his alleged abuse by Anwar, thereby leaving the Police with enough latitude to construct ‘events’ and create a case for prosecution.

As Anwar said at his press conference today in Bukit Segambut rather emphatically, “[Can] you imagine – I was asked to stay in the lock-up overnight, spent five-and-a-half hours answering questions and I’ve not seen Saiful’s (Bukhari Azlan) report.” Talk of phantoms, Saiful’s report has become, with apologies to the late Saddam Hussein, “the Mother of all Phantoms”.

While I have the highest regard for the ordinary mata-mata who exposes his life and limb in the normal course of duty, braving the elements at times so that Malaysians can enjoy peace and security at work and at play, I regret to say that I have nothing but contempt for certain elements in the top brash of the Force who have no qualms of conscience about being satraps of political pharoahs.—Din Merican

    You forgot the ringgit and sen paid by the rakyat. How much police time wasted and how much money spent for something unnecessary. Initiallly, on this liwat case up till today.

    You must also asked how many million ringgit spent on the legal action against DSAI during Mahathir administration 10 years ago. To include his expenses in Prison.

    We want to know in ringgit and sen.

    Please ask in writing or in Parlimen.

    Correction. Nothing wrong with the machinery.

    The BN machinery when powered by Najib’s alternative energy is so effective that many PR supporters have been mentally disabled by a phenomenon known, my Kedahan friend once explalined, as “kecut teloq”.

    What is the meaning of “kecut teloq” ? You will have to consult our learned friends Shrek or Salak for a definition. Don’t depend too much on Salak though because he is likely to give you a skewed answer which will only confuse you further.

    Earlier on tv3 news he said Anwar Ibrahim should not be afraid, should allow DNA test on him, it’s for him to prove his innocence by agreeing to it.

    There you are, as we had suspected all along, the government already find Anwar Ibrahim to be “guilty” even before he is charged and face trial and must now prove his innocence!

    Why should they need to do a DNA test on Anwar again, not that his DNA changes every year! 😀

    I am sure they have records of his DNA done some ten years ago. Why are they so persistent to get his blood samples again unless they need it for something else and are up to something funny. I am sorry, like Anwar, I have lost faith in our Malaysian police and cannot trust them anymore.

    This idiotic Home Minister is a shame to the country. I call on him to resign immediately and go home!

    Sure that’s what he said on TV?

    Could’nt be since he is a lawyer himseld. Could have said but not in those terms. Nobody needs to prove his innocence when charged but only to cast reasonable doubt on the prosecution’s case.

  8. I think Mr. Bean is completely out of touch with the politics of our country. We entering into an era of “sodomy politics” with the Oracle of Malaysia, Che Det, and his son, Mukhriz Mahathir, joing the fray. To me this is the politics of small minds play marbles.

    In Kedah lingo, that “KT” means “chicken” or “no guts”. Sure, Jong is a tough lady. Why should she have any phobia about Ts( eggs)!

    PKR members are known to stand up for democracy, freedom, justice. Unlike those in the top echelon of UMNO plutocracy, they are not a bunch of bodekists and kakiampuists. Guys, I expect more serious comments on what Kit Siang and I wrote (above).

  9. What we do see is that non of the component parties of BN dare to support UMNO on this fixed up scenerio . They know very well should they come to support UMNO there will be totally wiped out in the next GI 13. I have the opportunity here in Jakarta and have Indonesian politicians in BPR and DPRD telling me that Malaysia is a crasy country. The government and the police do not honour or understand the word daeline. I am sure if there is a survey conducted here the majority of Indonesian will definatly agree to give another black eye to the PDRM.

    You should give credit to this other ‘old’ man (although by far, a thoroughly gentleman) called LKS, who has fought for our country for decades without a single word of thanks from the rakyat. He and his son have been imprisoned, although the pain of having to endure seeing his son in prison far more severe, made fun of (I remember a cartoon drawn by Lat of LKS with a very very big mouth). It’s high time that we recognised ALL the tokoh-tokoh hebat regardless of race, religion and even political party affiliation.

  11. Anwar did the right thing when he refused to provide blood for the purpose of serological typing and DNA analysis. What the police could now do, I suppose, is for them to issue a search warrant. With a search warrant the police could then take his blood for the purpose of testing for DNA. Any motion filed to stop the police is bound to fail as it would constitute an attempt to suppress evidence.

    In certain jurisdictions like the U.S. taking DNA samples illegally would mean they cannot use the evidence as they are the result of an illegal search and seizure and is against the Fourth Amendment of the U.S. Constitution.

    I do not believe there is the equivalent of the Fourth Amendment in our Constitution.

    And I do not believe there is a DNA statute.

    Any legal eagle here?

  12. So far the police appears to be acting within the law. Anwar was called to give his statement under the more serious S. 111 CPC (as opposed to a mere witness statement under S. 112). He refused. A warrant of arrest was issued. He was arrested. He was released on police bail on condition that he must report on a predetermined date for more questioning. He has not been charged.

    He was asked to provide blood for the purpose of serological typing and DNA analysis. He has not seen the police report made against him nor provided with a copy. The police report is a public document and the accused or his lawyer is entitled to a copy. He is entitled at this point of time, therefore, to refuse to provide blood samples. No adverse reference could be drawn.

    The police while acting within the law, is ahead of themselves.

  13. Caution! Caution! Beware DSAI and DSAI supporters!
    Got rumour that “the authorities” is going to make the case like this to “get” Anwar!
    1) They are going to get the foreign DNA experts in to fool “orang kampong di Malaysia”. They think that by saying DNA test is carried out by foreign DNA experts, they can fool “orang kampong di Malaysia” that that DNA test is very advanced, very credible and is of International standard.
    2) They will pickup some DSAI hairs/cells/etc from the Police lockup room where DSAI was detained on 16 Jul 08.
    3) They will use some of these DSAI hairs/cells/etc and sprinkle some into the sample collected from Condo where Saiful claimed to be sodomised.
    4) They will then pass the 2 sets of sample to foreign DNA experts to see if both sets of sample matching. And they will limit the job of foreign DNA experts just to see if both sets of sample matching, JUST THAT and NOTHING MORE THAN THAT.
    5) Based on 3), what would the test results of foreign DNA experts like? They will then publish the test results of foreign DNA experts in all the main stream media, STRESSING RESULTS OF FOREIGN DNA experts.

    If “the authorities” would like to ACT “Professional” by inviting foreign DNA experts, Rakyat would also like to urge Malaysian police to let an independent foreign team of Investigation experts/Investigators to ensure professional investigation has been carried out by Malaysian police.

    Rakyat would also like to urge “the authorities” to let an independent foreign team of Judiciary experts(Judges and Queen’s counsel) to ensure professionalism in Malaysian court procedings and trials of this Sodomy accusation.

    Rakyat semakin matang, “authoritis” pls don’t anyhow try to bullsh*t the rakyat.
