Court of Appeal: Zambry is Menteri Besar

The appellate court today allowed an appeal by Barisan Nasional’s Zambry Abd Kadir to reverse the Kuala Lumpur High Court decision that had declared Pakatan Rakyat leader Mohammad Nizar Jamaluddin as the rightful menteri besar of Perak. And in the process the court ruled that Zambry was the legitimate Perak menteri besar.

Justice Md Raus Sharif – who is leading a three-member bench – said this was an unanimous decision by the Court of Appeal. The other judges in the panel were Justices Zainun Ali and Ahmad Maarop. The courtroom was silent when the judgment was read out.

Nizar was represented by a team of eight lawyers led by Sulaiman Abdullah while senior lawyer Cecil Abraham appeared for Zambry. Attorney-General Abdul Gani Patail – who stood as an intervener – was also present. Lawyers Mohd Hafarizam Harun, Firoz Hussein Ahmad Jamaluddin and M Reza Hassan held a watching brief for BN.

On May 11, Kuala Lumpur High Court judge Abdul Aziz Abd Rahim proclaimed Nizar as the rightful menteri besar. He ruled that the Sultan of Perak could not dismiss the menteri besar.

Zambry had appealed against that decision. Nizar’s lawyers told the court today that they will be appealing to the Federal Court. In an immediate reaction, Zambry who was attending a function in Slim River, said he was glad that the decision was in his favour. “The truth has prevailed,” he said.

  1. This is a lost cause. ‘Abang Aki’ is not appointed CJ for nothing.

    They are bent on making constitutional history. Cases like this over here would be referred directly to the highest court so the matter could reach finality earlier. Now it is a matter of time before appeal is made to the federal court – and the conclusion would be the same. I suggest PR give it up now.

The scumbags have successfully made Malaysia a laughing stock of the world and our Judiciary a veritable Zoo of with Judges all selling out their honour and turning the Courts in a truly Kangaroo Centre. Sureky the likes of Robert Mugabe will be happy that he has followers in Malaysia.
    Can’t wait for GE13. These assasins of our country must go.

  5. Maybe Abang Aki is waiting for his turn to make history. Maybe he will reverse the decision of the Court of Appeal and join the list of controversial justices to occupy the bench.

    Maybe Abang Aki has seen the light?

    Or perhaps he is suffering from Alzheimer and thought he’s Genghis Khan come to avenge the death of Altantuya?

  6. Give it up? Can’t do, gotta see it to the end of due process.
    Lost cause? Most likely, with ‘abang aki’ ruling the roost.
    Way forward? Gostan slowly. Build up grassroots, wait for the next battle. Think of serving people first, second… ad infinitum.
    Greatest losers? Short term – Perak, judiciary. Long term – the Naifians and warlords. Bean will take over from abang aki for sure.
    Meanwhile, let them straighten the senget-bengkok bridge and name the next hybrid orchid “Lumpiolus magisterium var. naif”.

  7. This is not a court for the smartest of lawyers endowed not just with the best of tacit knowledge but also the industry to go to the final detail. It is a court for the weak and the greedy to sell themselves for a pot of gold.

    Given the circumstances I think the political parties seeking to establish a free and fair judicial system should work towards the next general elections. It is important to sensitize the people more and more over the need to vote parties seeking to establish a true democracy in the country.

  8. well mr din merican , anwar did it to datuk pairin while he was in umno . although the modus operandi was not the same , but the effect and despair on the part of the losing party is the same . now najib does it to anwar’s coalition. my only hope is that anwar learns something from all this .

    at the end of the day it is not anwar or najib who will gain or lose . it is the public – the people. and if pakatan is for the ra’ayat , as they claim they are , they should feel the pain as much as the people are feeling from this decision. only then will they be able to put things right.

    for now mr. din , i still think there is very little to choose from between barisan and pakatan. and i hope this judgement from the appeals court will make or force the pakatan leadership to review the flaws in some , if not all , of their ways so that they will become the better party morally , ethically and also qualitatively.

  9. lets just review the situation. najib plans a trip to singapore via johore . the appeals court move the case from a monday to a thursday . bearing in mind that thursday is an auspicious day for the muslims and friday a holy day for the judgement . then we have a 3 man bench and they are all malays too .. to whom the auspiciousness of the thursday and the friday is all to obvious . then we have this question – how to dull the chinese mind ? the answer that appears is THE STOCK MARKET . then you have a picture in the straits times this morning with the perak ruler and the menteri besar datuk CAMRY standing side by side .

    now if you put this all together , then you should see how it was all stage managed . the only question i cant answer is this – was this a victory for umno – barisan or a victory for MALAY SUPREMACY ? MR DIN CAN YOU HELP ME HERE ?

  10. Take it all the way to the Federal Court even though the outcome will still be the same. Only then we will be able to expose the judges that do not have the balls to act independently. Let this be a lesson well learnt and prepare for the better the next time which is not too faraway. Then let the shit hit the ceiling fan at Speed No.3!

    For a state lacking in natural resource and relying entirely on Federal funds siphoned out from resource rich states i.e. Sabah/Sarawak to function. It takes someone bewildered by a ‘superiority complex’ mindset to utter such a claimed

  13. Just curious on what basis did the learned judges decide that Zambry is the rightful MB. Court of Appeal can only hear a case based on the evidence adduced or produced during the High Court hearing. It cannot entertain any new evidence.

  14. Dont get me wrong , i am a fan of din’s. I’m a willing jet fighter pilot in his regiment but i’m no mindless 2nd ww ‘harakiri’ japanese pilot. If our politicians & judges inteprates the law as they see fit .
    Being a citizen i too reserve my right to express myself as i deem fit. Hence i could go on and blabber that our historical folklore has been distorted and in actual fact Hang Tuah was a chinese muslim martial arts expert and Jebat was a gay javanese sidekick who was madly in love with him.
