Citizenship given due to Reid Commission as well as Tunku

COMMENT; Former Prime Minister Dr Mahathir Mohamad must remember that his father was an immigrant from Kerala and was given citizenship together with Indians, Indian Muslims, Chinese and others because of the fair and just gesture by Tunku Abdul Rahman and the Reid Commission.

Thanks to the Commission and Tunku, Mahathir is a citizen of Malaya then, and now Malaysia.

Yesterday, Mahathir suggested that a Royal Commission of Inquiry (RCI) be set up toMahathir investigate the granting of citizenship to one million foreign immigrants in the Federation of Malaya, before Malaysia gained independence.

The Reid Commission was entrusted with drafting the constitution after taking into account the views of different groups. The tripartite working party, which included representatives from the Alliance, the Malay rulers and the British, met between February 22 and April 27, 1957 to go through each item in the draft constitution.

This was to ensure that the new constitution would be acceptable to the major communities. Some significant amendments were made at this final stage although the general structure of the draft constitution was retained, according to the Centre for Policy Initiatives (CPI), a think tank group.

“Articles in the constitution on citizenship, Malay special position, language, and religion were the most sensitive and were closely scrutinised and debated. Throughout these discussions, UMNO and the non-Malay Alliance leaders had to contend with very communal demands from radical sections of their communities. Over the years since then, these Articles in the constitution have continued to be major sources of disagreement and a bone of contention in inter-ethnic relations.

Tunku, TCL and TS“Members of the Alliance agreed on the application of jus soli for citizenship so that those born in the federation after independence became citizens and non-residents could qualify by fulfilling residence, language and oath of loyalty requirements. This liberal citizenship requirement was a major concession from the Malays because with this agreement, a large number of non-Malays became citizens.

“The Alliance, which insisted on a single nationality, also eventually accepted the Reid Commission’s inclusion of modified dual-citizenship especially for those from the Straits Settlements who were British subjects.

“In exchange for liberalising citizenship requirements, non-Malay leaders in the Alliance accepted the special position of the Malays. UMNO wanted to continue with Malay privileges as provided under the Federation of Malaya Agreement through provisions for Malay reservation land, operation of quotas within the public services, quotas for licences and permits for certain businesses, and quotas for public scholarship and education grants,” the CPI noted in its research.

Quid pro quo agreement

Together with this, Mahathir must recall vividly that the Malayan founding fathers agreed 1Malaysia2to a “social contract” on a quid pro quo agreement. It is a give and take agreement that provides Chinese and Indians citizenship by Tunku Abdul Rahman.

It was done in return for the non-Malays granting special privileges to the Malays and indigenous people (bumiputra or sons of sons of the soil) of Malaya.

A higher education Malaysian studies textbook conforming to the government syllabus states : “Since the Malay leaders agreed to relax the conditions for citizenship, the leaders of the Chinese and Indian communities accepted the special position of the Malays as indigenous people of Malaya.”

Another description of the social contract declares it to be an agreement that “Malay entitlement to political and administrative authority should be accepted unchallenged, at least for the time being, in return for non-interference in Chinese control of the economy”.

Therefore, the Constitution granted the bumiputra reservations of land, quotas in the civil service, public scholarships and public education, quotas for trade licences, and the permission to monopolise certain industries if the government permits.

“Tunku never gave out citizenship to subvert the electoral process but  to ensure that in the run-up to Merdeka in 1957, non-Malays who resided in Malaya had a right to citizenship, which was agreed to by all including the Conference of Rulers – all done in an open and transparent manner,” said DAP party Supremo Lim Kit Siang.

Whereas, he added that Mahathir conducted the Project IC or Project M in secrecy unlike Tunku, who followed the Reid Commission’s findings and accepted its recommendations in an open and transparent process.

Mahathir added: “We should look back and remember, Tunku Abdul Rahman was worse than I. He gave out a million citizenships to those who were not qualified (to receive it).”

Consultation process

In March 1956 a Commission chaired by Lord Reid was set up to formulate a draft and refine the constitution of the Federation of Malaya. The commission sought the views of political parties, non-political organisations and individuals on the form of government and racial structure appropriate for this country. In the consultation process, a memorandum from the Alliance had gained precedence.

The memorandum, an inter-communal conciliation aimed at mutual interests and strengthening the nation’s democratic system of government, took into account five main factors namely the position of the Malay Rulers, Islam as the official religion of the federation, position of the Malay language, the special positions of the Malays and equal citizenship.

Patek berasa dukachita kerana tujuan patek membuat kenyataan kepada akhbar telah di-salah faham oleh Y.T.M. Tunku. Sa-benar-nya tujuan patek sama-lah juga dengan tujuan Tunku, ia-itu untok menyelamatkan negara ini daripada bahaya yang menganchamkan-nya.

Pendapat-pendapat Tunku berasaskan kepada cherita-cherita yang di-bawa kepada telinga Tunku oleh orang-orang yang mengelilingi Tunku yang chuma suka mencherita kepada Tunku perkara2 yang mereka fikir Tunku suka atau patut dengar sahaja. Benarkan-lah patek bercherita berkenaan dengan keadaan, fikiran dan pendapat2 rakyat yang sa-benar-nya supaya Tunku dapat faham tujuan patek membuat kenyataan yang di-tegor itu.

Tunku biasa cherita kepada patek sendiri ia-itu Tunku mengelakkan rusohan dengan menahan hukum bunoh yang di-jatohkan kepada 11 orang subversif China. Sabenar-nya tindakan Tunku ini-lah yang mengakibatkan rusohan dan kematian yang berpuloh kali banyak yang terjadi semenjak 13 Mei.

Tunku selalu “bertolak-ansor,” ia-itu memberi kepada orang2 China apa yang mereka tuntut. Punchak tolak-ansur ini ia-lah pembatalan hukum bunoh tadi. Pembatalan ini menimbulkan kemarahan yang besar oleh orang2 Melayu.

Orang2 China pula menganggap Tunku dan Kerajaan Perikatan sebagai pengechut dan lemah dan boleh di-tolak ke-sana ke-mari. Sebab itu orang2 China tidak takut lagi menolak Perikatan dan orang2 Melayu pula tidak ingin kepada Perikatan. Sebab itu orang2 China dan India membuat kurang ajar pada 12 Mei kepada orang Melayu. Kalau Tunku biasa di-ludah di-muka, di-maki dan di-tunjok kemaluan, boleh-lah Tunku faham perasaan orang Melayu.

Orang2 Melayu yang Tunku fikir tidak memberontak telah-pun menjadi gila dan mengamok sehingga mengorbankan nyawa mereka dan membunoh orang yang mereka benchi kerana Tunku terlangsong bagi muka. Tanggong-jawab tentang mati-nya orang2 ini, Islam dan kafir, terpaksa di-letak di-atas bahu pemimpin yang salah pendapat.

Patek mohon ma’af tetapi patek ingin sampaikan perasaan orang-orang Melayu kepada Y.T.M. Tunku. Sabenar-nya, orang2 Melayu sekarang, baik PAS baik Umno, betul2 benchi pada Tunku, terutama orang2 yang di-hina-kan oleh orang China dan yang kehilangan rumah-tangga, anak-pinak, saudara-mara kerana tolak ansur Tunku.

Mereka kata Tunku chuma ingin di-kenal-kan sebagai “The Happy Prime Minister” walau-pun ra’ayat menderita. Mereka tahu bahawa dalam keadaan dharurat-pun Tunku ashek bermain poker dengan kawan2 China Tunku. Budak2 polis mencherita yang Tunku mengguna-kan kenderaan dan eskot Polis untuk menchari kaki poker.

Sa-balek-nya pula orang2 China tidak ada sedikit-pun hormat kepada Tunku. Mereka berkata Tunku “naïve” dan tidak ada kaliber. Ada lagi yang mereka kata yang tak dapat patek sebut-kan. Kata2 itu datang dari semua golongan orang China, dari intelek sa-hinggga China becha.

Pada masa lewat2 ini lagi satu kesan burok telah timbul. Orang2 Melayu dalam Civil Servis, dari Perm. Sec. ka-bawah, pegawai2 tentera dan polis Melayu tidak ada lagi kepercayaan dan respect kepada Tunku. Patek tahu kebanyakan mereka sokong PAS dalam undi pos. Pegawai Melayu dari  Polis, tentera dan askar biasa maseh patoh kepada kerajaan oleh kerana arahan sekarang sesuai dengan kehendak mereka sendiri. Kalau Tunku membuat apa2 yang tidak di-ingini oleh mereka, patek perchaya mereka tidak akan menurut kata Tunku.

Patek tahu Tunku takut kominis mengambil kesempatan kalau timbul kekachauan dalam negeri. Patek lebih takut kalau kerajaan mula “lose control over the armed forces”. Sa-kali ini terjadi, keadaan tidak akan puleh semula. Sampai bila-pun kerajaan civil mesti tundok kepada tentera. Tunku biasa jadi “Happy Prime Minister” tetapi orang yang akan turut ganti tak akan merasai “happiness” apa2.

Patek harap Y.T.M. Tunku jangan-lah menipu diri dengan berkata “satu hari mereka akan bershukor dengan perbuatan saya”. Ta’akan yang sa-orang itu selalu betul dan yang banyak selalu salah. Patek ingin sampaikan kepada Tunku fikiran ra’ayat yang sa-benar, ia-itu masa telah lampau untuk Tunku bersara dari menjadi perdana menteri dan Ketua Umno.

Patek faham betul2 kuasa yang ada pada Tunku dan patek masih ingat nasib Aziz Ishak. Tapi patek tak akan jadi sa-orang yang bertanggong-jawab kalau patek tidak terangkan apa yang patek sebut-kan. Kalau di-penjara sa-kali-pun patek terpaksa kata apa yang patek telah kata-kan.

Patek di-beritahu ia-itu Tunku berkata patek Pakistani. Patek tidak perchaya kata2 orang kerana patek tahu Y.T.M. Tunku tidak akan berkata begitu. Patek-lah yang selalu mempertahan-kan Tunku apabila orang2 PAS kata yang Tunku anak Siam yang ta’ berhak memimpin orang Melayu. Jadi Tunku juga akan mempertahan-kan patek walau-pun maseh ada dua sudu darah Pakistani dalam tubuh badan patek.

Patek sa-kali lagi mengulangkan ia-itu kenyataan yang patek buat itu ia-lah menchegah kejadian yang akan menambah perasaan benchi orang2 Melayu terhadap kerajaan dan menggalak-kan orang2 China menjatohkan lagi maruah orang2 Melayu. Rusohan yang lebeh besar akan berlaku jika ini di-biarkan. Tentera sendiri tidak akan dapat di-kawal. Dan lagi kalau T.H. Tan dan dewan orang China boleh membuat kenyataan, kenapa ketua2 Umno tidak boleh?

Patek menulis surat ini dengan hati yang ikhlas dan harapan bahawa Y.T.M. Tunku akan bacha surat ini dengan sa-penoh-nya sendiri. Patek berdo’a ke-hadhrat Allah subhanahuwataala supaya di-buka hati Tunku untok menerima kenyataan yang sa-benar ini walau-pun pahit dan pedas.

  1. Atir has calculated just like he did to put down PBS.

    Alien MyKad holders in Sabah and Peninsula couldn’t care so long as they got MyKad so they would thank Atir for that and vote BN.

    Legal young MyKad holders first time voters are sensationalized into dissonance doubts as they read NOT the constitution so their young mind are easier to sway back towards Atir.

    Older legal MyKad holders, some may be sway as will to think Atir had fought to rewrite history.

    By suggesting that a RCI be held for those who became Malaysian in 1957, he hopes to divert the RCI issue in Sabah.

    Election is about winning by vote count. One man One vote. Its the numbers that count and not the intellectual debates. There are possibly a high side of 2m new illegal MyKad holders including those in Sabah, Selangor, Johor, Penang etc. their imported numbers are up against Pakatan.

    Atiir’s strategy might just achieve him 4 things.
    1. Regain his popularity to get the Muhidin-Mukriz team take over UMNO
    2. Ensure loyalty of new MyKad holders from Sabah, Selangor, Johor and Penang etc.
    3. Sway back legal young Malay MyKad holders voting first time with Malay sentiment.
    4. Sway back older Malay MyKad holders with Malay sentiment.

    Our knowledge propagation here are elsewhere is no threat to these new imported voters……….unless something happen BIG in Sabah.

    A referendum of Sabah 1963 constitution will tell the illegal man on the street that he will be booted out when Sabah kick out Malaysia, then MyKad is useless to them.

    This seems to be Jeffrey Kitingan party strategy but he seems to be a little too late as the Sabah Cabinet is bought by UMNO else how could PBS had lost?

    Therefore the touch points in Sabah are very spread and difficult for both BN and Pakatan. Its the land below the wind, and the wind is wildly seeking direction to its home tunnel.

    Its look upon very differently in Sabah and in WMsia. In trying to confuse both the 1957 and 1963 constitution, Atir might be just clever enough to achieve his aim after all he had succeeded to put down PBS when DSAI and others were in the picture.

IF MAHATHIR can justify the issue of ‘jus soli’ was wrong of Tunku Abdul Rahman, Philippines can justify their claim of Sabah that it was wrong of the Spanish to sign away their claim when the other side never admitted defeat in the first place and hence claims folllowing it are all not legal either…

    So in the end, Mahathir, if he wins his argument with Tunku, STILL HAS TO GIVE UP SABAH – and loses…

  5. Tunku Abdul Rahman did right not to go along with the principle of jus soli. It is not jus sanguinis either. But a hybrid.

  6. I repeat again…..as much as I admire Tunku, he started the concept of ketuanan melayu. I believe Pak Bean agrees with me. Tunku has been involved in bringing down folks such as Stephen Kalong Ningkan. He supported Tun Mustapha because Mustapha is a muslim. Furthermore, notice that UMNO got 2/3 of parliamentary seats before 1974.

    Tunku reneged on his promises of appointing a non muslim malacca chief minister. Heck, he messed with singapore, raising the ire of melayus in singapore & thus lky decided to go into malaysia parliamentary elections in balancing out UMNO onslaught

    But then again, Tunku who was & is a gentleman, play by certain gentleman rules. Mahathir played by no rule

  7. this piece of indian reject has no justification to criticise what the founding fathers did in consultations with the British and local rulers before independence.
    if one reads the contents of some internet and youtube articles one will get an impression that umno singlehandedly wrung the independence from the british.
    the distortion of malaysian history began in the mahashit reign, and if it goes on unimpeded the malays and malaysians will lose their identity. one day we will become a pa…… nation full of economic refugees from Phillipines, Indonesia, Burma, Indochine, India, Bangladesh and ….etc etc.

  8. Looking at the facts stated in the link. Sometimes, one wonder if there are plenty of melay celups coming in taking away all the melayu jati & orang asli rights. In 1931, the melayu tulen unlike Mahathir was much lesser than what expected now. So now the real cat all of the bag. If Mahathir wants RCI for 1 millions of Indians & Chinese becoming citizen…..We must question how on earth Mahathir can be a bumiputra enjoying special right
