UMNO MP “Treason” remarks are his Own

The Barisan Nasional (BN) today played down an UMNO lawmaker’s call for BERSIH chief Datuk Ambiga Sreenevasan to be hanged for treason, saying it was not the ruling coalition’s stand in what seems to be a bid to arrest its sliding popularity ahead of key national polls.
“What was mentioned by the Sri Gading MP, Datuk Mohamad Aziz (left), in the Parliamentary session yesterday (June 26, 2012) suggesting that the organiser of the Bersih Assembly, Datuk S. Ambiga, be hanged to death by linking her to the Al-Ma’unah militants for attempting to create disorder and overthrow the government of the Yang di-Pertuan Agong is personal and not BN’s stand.
“I would like to stress that Barisan Nasional upholds the Malaysian
Constitution and the rule of law and the BERSIH Assembly case is still being investigated by the authorities,” BN Secretary-General Tengku Datuk Seri Adnan Tengku Mansor said.
The two-paragraph media statement came just hours after the MIC President, Datuk G. Palanivel, called on Prime Minister Datuk Seri Najib Razak and BN leaders to put a stop to the relentless attacks against the electoral reform chief.
“It is not right for a Member of Parliament to say that Datuk Ambiga should be hanged.In fact, no Member of Parliament should make this kind of a remark,” Palanivel said in statement sent by his aide via text message.
Palanivel also questioned why Ambiga has been made a “scapegoat” and appeared to be the only target of criticism over the BERSIH rally for free and fair elections.
“Why didn’t these people demonstrate or put up burger stalls in front (the houses) of other BERSIH leaders?” he asked, referring to a recent protest by anti-BERSIH proponents outside Ambiga’s house.
“The Prime Minister and other BN leaders should put a stop to this matter. Such remarks will affect Indian voters who are turning towards BN now,” he added.
Mohamad had last night called for Ambiga to be hanged for the “treasonous” act of organising the April 28 BERSIH rally, which the ruling BN has claimed was an attempt to topple the Najib Administration.
The Sri Gading MP had compared the BERSIH chief to a militant Muslim group that had tried to overthrow the government in 2000 and were eventually sentenced to death by hanging for “waging war against the King,” the first people to be convicted of the offence.
“Shouldn’t we also hang Ambiga for treason towards the Agong? Traitors should be punished as harshly as possible,” Mohamad told Parliament when debating the supplementary supply bill last night.
Pakatan Rakyat (PR) lawmakers had accused the UMNO MP of abusing his parliamentary immunity and demanded action be taken against him for stirring racial hatred.
The Opposition lawmakers pointed out that parliamentary immunity is still limited to provisions in the Federal Constitution, adding that the Sri Gading MP could still be investigated by police for his remarks.
At a press conference here, DAP secretary-general Lim Guan Eng said he would direct all elected representatives from the party to lodge simultaneous reports against Mohamad for the latter’s “samseng-like”, “seditious”, “racist”, “repulsive”, “repugnant” and “derogatory” remarks against Ambiga, who is the co-chair of election watchdog BERSIH.
“Clearly these remarks are inflammatory, designed to stir disaffection, extremism and racism… it was directed against her because she’s a woman, Hindu and Indian,” the Bagan MP said.
“This is the first time in history that a lawmaker is demanding for the murder of someone,” he added.
Lim noted that although Article 63 of the Federal Constitution grants immunity to a parliamentarian when addressing the august House, there are several exceptions, particularly when the remark uttered has racial undertones or is an attack on the Yang di-Pertuan Agong.
Ambiga personally appeared tickled by Mohamad’s remark instead of being
incensed.“ ‘Off with her head!’ Sounds like Alice in Wonderland! The statement, of course, reflects more on the maker than on me,” Ambiga said in response to Mohamad’s remark.
The prominent lawyer-activist was able to maintain her composure and even pressed the UMNO MP if BERSIH’s eight demands for electoral reform would be implemented before the 13th general elections, which must be called by next year.
Together with national laureate Datuk A. Samad Said, Ambiga led a massive public rally for the voter roll to be cleaned of dubious entries, for which she has been repeatedly branded a “traitor” by right-wing elements within the pro-BN establishment.
They have also demanded that she is stripped of her citizenship.“The offer by civil society to help with the cleaning up of the electoral roll still stands, and as he is an elected MP, I believe the public would be more interested in his response to these critical questions,” Ambiga said.
She added, “As for treason, asking for free and fair elections is not treason. Giving away citizenship for votes is.”
Ambiga should ask this Sri Gading MP to repeat his remarks outside Parliament and then take him to cleaners by suing him. Tengku Adnan as UMNO Secretary-General should, in turn, haul him up to face UMNO Disciplinary Board. It is serious since treason is punishable by death. –Din Merican

You can’t blame the guy too much. First he was only taking the cue from his party president. Second, obviously he doesn’t have much between his ears to know that when it comes to the party losing the elections because of comments like this (besides making a mockery of the country’s Prime Minister, in the international media) , his own boss will not hesitate to send him to the cleaners and hang him to dry !
This fiesty lady can hold her own. She has the right attitude. Had she swallowed the bait she would by her attempt to rebut the allegations would be breathing life into the allegations. Instead by brushing it aside and dismissing it as childish, it failed to gain traction and arrived dead in the water.
Now his own Party has had to isolate itself from the remarks to limit the collateral damage done.

They still do not get it. Bersih 3.0 has nothing to do with Ambiga. It has all to do with how we run this country and the extent to which our Government Employees are going to disregard the rule of engagement as spelt out in the Constitution to favour the incumbent based not on what it takes but all cost to The State to which all of us owe a higher loyalty.
Thirty years ago some key founding members of ASEAN went through this process and the Govewrnment Employees were forced or went on their own free will to run their respective countries based on the wants, the needs and dictate of the incumbent at the expanse of placing rthe man-on-the-street on the wrong side of the law all the time. I do not have to point out here what has happened to them or even name them.But we know what they did. They allowed illegal activities to flourish in the name of of development and attracting tourist and employed the rule of law to make selective prosecutions while the mafia controlled the under world. What was happening in Japan was always their fall back position and excuse.
I am afraid that if the “good men” in our society do not stand up today all of us will lose our status as witnesses in any legal hearing because we would all be accomplices because we knew what was going on and did not stand up today.
Why hang Ambiga only, hang all the supporters of BERSIH , then UMNO/ BN can win back 2/3 majority in parliament !!! Maybe Sri Gading rep. not so dumb after all !!! Malaysia Boleh lah !!!
MPs should be more responsible in their comments especially in the Parliament even though they are protected to a limit by immunity from prosecution.
This particular MP has unnecessarily given ammunitions to his opposition spin-doctors to widen the issue to include race & religion. People like this are not suitable to be the Rakyat’s representative.

When you have this many constitutional rulers to have to deal with then there is that occassional not-quite-right-in-the-head ruler who comes along once every twenty years who sees it his royal duty to enforce obedience by cracking open thick skulls to see if that helps. You don’t waste a ship just because you disagree with the direction it is going. You replace its captain. You don’t run the country’s top judge out of office just because you don’t have control over judicial decisions.
Even then it is not treason. Just a man with an ego too big for his head. Now we have an MP whose brain is as large as his nut. Do we then say our parliamentary system has as many nuts as there are monkeys and it is time we look at another system? No. We throw the monkeys out and collect their nuts and feed them to our dogs.

Yes.. We have the Speech or Debate Clause Article I Sec. 6 of the U.S. Constitution. The Clause provides protection of speech in Congress by making conduct of U.S. Senators or House Reps engaged in legislative functions privileged against both civil or criminal suit.
But you really don’t want to say something just because you can. With UMNO, it is the reverse. They say because they can.
The Sri Gading MP is not even clear about the role of the Legislature.
Reportedly, the Hansard recorded his words as ‘Apakah Ambiga tidak boleh kita anggap penderhaka kepada Duli Yang Maha Mulia Yang di-Pertuan Agong dan hukum gantung kepada dia?’
Parliament can enact laws, and given the majority hold on Parliament which BN still has, BN can still (theorectically) on its own pass a law which makes it a crime to organise a rally in the manner which Ambiga organised BERSIH. And make the penalty a mandatory death sentence even, however implausible and untenable such a penalty may be.
BUT Parliamentrians cannot “sentence her to hang”. MPs are not judges, and the Parliament is not a court of law. MPs cannot sentence anyone.
Has Mohamad Aziz’s head been swollen so much by virtue of him being part of the ‘keRAJAan” that he thought he and his fellow MPs had the power to sentence like a Raja of old?
But that is now a moot point.
In the face of the loud outcry, and his own BN colleagues distancing themselves from his statement, Sri Gading has come out with a half-hearted “if my remarks hurt my friends, the Indians, MIC, PPP, and affect the spirit of understanding in Barisan Nasional (BN), I withdraw what I said on June 26”.
The Chinese denounce someone who worms his way out of whatever difficult problem his words have got them into as a “turtle” (Think of the animal withdrawing its head and limbs into its shell in times of adversity instead of bravely fighting like a tiger for what it stands for).
Surely members of the august Dewan will want to pains they give no one grounds to use that derogatory term on them. Care with one’s words is most recommended.
I really hate myself for repeating these words when I hear again comments made by UMNO leaders..

This MP got a diploma in Community Relations from the Training Course conducted by Biro Tata Negara and he scored a Distinction in the subject, ” Introduction to Malaysian Criminal Law”. The subject was tutored by Nazri Aziz.
