Abu Kassim responds: Syabas for Being Transparent

On Labour Day ( May 1), I posted an article – ” MACC: The Destroyer of Public Institutions”.  In my usual style, I dealt with current issues of public interest and also touched upon a public account of encountering Dato’ Sri Abu Kassim in Kota Damansara on Sunday April, 17, 2011. I invited Dato Sri Abu Kassim to explain what he was doing there, see link here

On  May 5, I received a seemingly innocent email from Puan Nurhasmah Mohamed Kassim of the Corporate Communication Unit MACC seeking for my house address and other particulars. I was encouraged that the MACC was making an effort to engage bloggers and alternative media practitoners to become Frenz of MACC (FoMACC). Reproduced below is the email exchange between us:

I considered this approach by the MACC to be very refreshing and my elation could not be more obvious when I stated that I was prepared to work for the betterment of the country despite being a critic of the administration and that I hope to always be constructive.

On Sunday May 8, Rocky Bru fired a warning shot that the MACC may be going after me for my May Day article, go to Rockybru/ Batu Api /Agent Provocator. Rockybru couldn’t be more spot on or he must have been given the lead of the impending actions by MACC.

On  May 10,  I received a hand delivered letter in an officious white envelope marked “Urusan Sri Paduka Baginda” with an SPRM stamp. That stern white envelope would have made anyone shudder, see below:

In that envelope was a letter titled ” MACC RESPONSE TO THE ARTICLE ENTITLED “ABU KASSIM’S PERSONAL CONDUCT IN DINMERICAN. WORDPRESS.COM. For the benefit of my readers, I reproduce the letter in its entirety, see letter below:

Upon initially reading the letter, I was offended that the MACC had used a very cunning method to obtain my address. It appeared to me that having invited me to be placed on the MACC’s database, they have abused that information to serve me with a Warning or Demand Letter as can be seen above. However, upon reflection, I decided to take this Demand Letter positively.

Indeed, I had asked Dato Sri Abu Kassim several questions that would appear to touch on his integrity. Indeed, any less mortal would feel disturbed by what is perceived as an attack against his personality. But Dato Sri Abu Kassim is not any mere mortal. He is the Chief Commissioner of the MACC, that omnipotent agency mandated to eradicate corruption in our country. Thus, he should not feel slighted by my questions.

As a public official who is always in the limelight as a crusader against corruption, he should welcome my questions. He should welcome public scrutiny on his official and personal conduct. He should not feel offended nor challenged by these questions if he has nothing to hide or if he has done nothing wrong. That, Dato Sri Abu Kassim is what is expected from a public official like you.

To his credit, Dato Sri Abu Kassim can now claim that he is indeed transparent. He can take pride that he walked the talk. He can now claim that he walked through a baptism of fire and is not scorched. He can claim that he has answered to all the questions and passed the challenge with flying colours. That much I must commend Abu Kassim. Instead of merely denying that he was at the place he was seen that fateful Sunday  April 17, Abu Kassim admitted that:

a) he was in Kota Damansara;
b) he was accompanied by his 3 men;
c) he met an unnamed and unknown individual;
d) the premise where he met that individual was just beside Chee Chah Cafe;
e) while he was meeting that individual, his men took time for lunch at the Chee Chah Cafe.

For all that, I say Syabas Dato Sri Abu Kassim!

However, I would have heaped more praises and congratulations on Dato Sri Abu Kassim if the MACC Demand Letter did not threaten me in the way that it did. The MACC’s Demand Letter called my previous posting “baseless, bias and defamatory”.  How could it be baseless, when I was merely asking questions based on public eyewitness account? How could it be baseless when there is now an admission of the five factors that I have outlined above? As to what is the business premise beside the Chee Chah Cafe in Kota Damansara, my readers can visit that place, and tell me if it is not a wellness centre.

Perhaps, it is my perception that the last paragraph of the MACC Demand Letter was a threat. Perhaps, I too have become jumpy like the MACC. Therefore, I remind myself that I owe it to Dato Sri Abu Kassim the right to be heard, the right for him to defend himself against any negative public perceptions. Thus, Dato’ Sri Abu Kassim this is my way to show to you that I am objective. This is my way of answering to Rockybru that I have no vendetta against the MACC nor Dato Sri Abu Kassim. As to whether Dato Sri Abu Kassim is one of the good guys, it is for the public to judge him, not me.

After all the good and transparent things that Dato Sri Abu Kassim had attempted to do by his explanation, the MACC Demand Letter signed by its Assistant Head of Corporate Communication Unit, Puan Salwa Binti Muharam, had to spoil all that. Instead of being an explanatory letter or an attempt to clear any negative public perceptions on the matter, she chose to threaten me. The MACC Corporate Communication Unit should know better than to make threats in such ways. The MACC should win over critics rather than to threaten to silence these critics. That is the most basic rule in public relations. No wonder the MACC is in the state that it is today.

The MACC Corporate Communication Unit should also know that in today’s cyberworld, it is primitive and archaic to demand for removal of any posted article. If the MACC demand that of me, then the MACC should come down harder on Rockybru because he extracted only a part of my article and chose to give prominence to the part that he said constituted as defamatory of Dato Sri Abu Kassim. It was Rockybru who sensationalised the whole thing. So Rockybru, my friend, join the bandwagon!

To my mind, it is more meaningful to give a person the right to be heard. That is the rule of natural justice and that is what I intend by this article – to give Dato Sri Abu Kassim the opportunity to explain himself, which he did. I have always done that in the interest of fairplay. And Justice For all!

  1. To be thinking that the MACC is sincere is very naive on your part Dato’. As for Rockybru, he’s just a gossip monger who fancies himself as a real journalist.

Didi, maybe I am, but I believe that the MACC can be a force for the good of our country.Fighting corruption must be given top priority if we are to be one of the drivers of Asian economic growth. This point was highlighted by The Asian Development Bank. Abu Kassim has this unique opportunity to make difference. That is why I have high expectations.–Din Merican

    I would have refused to give my phone number and address and instead asked them to contact me by email. Why do they need the address if they want to engage bloggers. How can we trust MACC when they deceive people to get personal info? They even lied at the RCI to cover up a probable murder in their vicinity.Can you trust them?

    In this country the civil servants act like king. They abuse their power and get away with it. It is always those in the lower rungs who get hauled up. Rocky Bru is a scum. He has no morality, conscience and integrity. All that matters is his position and monthly salary. He is a snake, a fox and a worm – all in one.
    As for me I don’t trust any civil servant, police or UMNO politicians.

    Honestly, even if I am witness to a crime, I will NOT step forward because I don’t trust the police. They might lock me up and even kill me if they have been well greased by the criminal. I don’t trust the Judiciary, AG, EC, Macc, Police, BN.
    They are all fake Muslims.

  8. The problem with this country is that the TUAN politicians and Top civil servants behave as though they are beyond reproach by the public that they are supposed to serve. You did well in highlighting the issue Mr Merican and the threat by MACC is totally uncalled for . Take care.

When RockryBru was charged in court togther with another blogger some years back on the ECM Libra and NST case, there was a “Walk with Us” campaigned and I took leave from work and walked with RockyBru. The next thing he jumped over for the company car, the job title and the salary and perks! I felt cheated and disgusted for supporting this worm and lizard all in one! I lost every iota of respect for this low-down specie of the animal kingdom! Don’t trust a double headed snake, Dato!

    If ever the push come to shove, and the MACC should start flexing their muscles and have that prosecutor DPP who tried to show the court how a person can self-strangle himself and perhaps a top-notch lawyer like Shafee to shake you, just post your personal or Dr Kamsiah’s personal bank account, my friends and I will give you the support that is needed.

    We do this to support truth and justice, not because of anything else, we have not even met personally Dato, but we will support you all the way just based on the fact you uphold basic justice in this beloved land of ours – the very lands that fouble-headed snakes would not hesitate to destroy just so he could have his Caffe Latte every afternoon with the VVIPs!

  10. The MACC has an obligation to respond to allegations of misconduct…. Dont you think so guys? Gone through the letter , failed to detect any serious element of threat except for the standard format of reprisal…

    and of course this sentence at the very end of the official letter “to issue corrective statement is not headed to” Icing on the cake.. eeh…

  11. i cant understand why our civil servant can never grow out of their Tuan mentality. We the rakyat dont owe you a living – it is the other way round. So, what is wrong in asking what are you doing there at a particular time of day and whether it is on official business or not?

    You must understand that soon as you accept the post to be one of the top civil servant serving one of the most important agency in Msia – everything you do and every word you say will be of public interest.

    If you cant accept it then resign. threatening to sue at every corner will not only waste public funds (by the way, will you be suing on your personal capacity or as the MACC chief?) waste time and resources but importantly it gives the public the impression that you have much to hide and so must attack to defence.

  15. MACC is a taxpayer funded government body, they are obligated to answer questions from any subject of malaysia.

    bloggers are considered journalists so their responsibility is to remain neutral. an organisation like MACC should’nt ask bloggers and the like to help them polish the image.

    Dato’ please do not fall into their trap, next they’ll ask you to praise them for nothing!

  16. Dear Dato, I have lots of respect for you, being so objective. But guess most of the nation do not have much trust for our gomen any more. We are getting very suspicious of these bunch of civil servant (police, MACC, AG etc). It is during this Kassim time that one of the custom office dropped from the MACC office, so how to trust them.

    I hope you are afraid of heights so you should get a medical certification that you cannot go higher than the ground floor of any building. Its better to be prepared, just in case. Also you should get another full medical screening to prove you are in great health as you do not know what could happen to your health should you be invited for tea at the MACC offices.

    By the way, who is the Rocko Brew fella? I thought he became irrelevant when he became the Malay Mail editor.

  26. Rockybru who was once thrown out of the New Straits Times when Kalimullah M. Hassan was the Chief Group Editor is back on his high horses. His specialty is that of a paid s..it stirrer, a turncoat and dirt spinner.

    I am surprised that our Dato is still courteous towards someone who is committed to any cause including support for the corrupt Taib Mahmud of Sarawak as long as he gets paid. Originally a Singaporean, he now operates in Malaysia. If he had remained there, he would have been spending a lot of time and money fighting civil defamation suits.

    As long as he thinks he can get some political protection, he will remain an audacious and crude stirrer of filth. A person with ITM (MARA) Diploma in Mass Communications will not be able to find a job in journalism in Singapore. Only Malaysia can accept this sort of a mediocre character. Yet he thinks he is God’s gift to journalism. In truth, he is bad news. In short, Dato, he is not your friend.

  27. Yes, don’t trust gomen agencies 100%. Once, I wrote to the CID Chief of Bkt. Aman to inform him that a specific anti-vice inspector was on the take and that he had allowed organised gaming in my town. Ten days later a man came to my house and warned me not to be a busybody. I denied. He then told me that the hand written letter bore my name and address. I was very naive to believe the appeal by Bkt Aman to the rakyat be their eyes and ears to fight crime and that informers’ identities would not be divulged. I did not know that there were also criminals in the PDRM Head Ouarter.

    Nowadays, Wisdom of Crowd are the Judge. By the recent system of Kerajaan Rahman, Razak, Hussein, Mahathir n Najib, there is no way for any Government Agencies to Play Fair. JKR, MACC etc. were the Product of this System.

  31. This is my take on the issue. You have to respect your adversary. Expect nothing less than the good cop and bad cop routine from IOs be they from the commercial crime division of Bkt. Aman or any other investigative body.

    That’s their modus operandi. You can take away trust off the table.

    You are lucky they only came to warn you. Sometimes they even reveal your identity to the criminals. If that happens you might find yourself in a burnt car, or on the ground floor of a multi storey building.

  33. Hmm.., just had the time to read this in entirety.
    Seems to me, that the Establishment is up to it’s bullying ways as usual. Kindly note that MACC is merely one of the middling functionaries of the regime, and it is a precursor to more ill wind (Farts, belches, burps etc). However, the semi-solids are still quite far off.

    Btw, they MACC (esp it’s corporate communications div) cannot haul up Din for ‘interrogation’ just because of a mild altercation with their head honcho – which has nothing to do with their stated aims. Now, if this letter came from a certain ‘faggot’ (kindling material), there would be more cause to worry. The most will be a referral to AG’s chambers on a a very Public law-suit.

    That said, I’ll agree with Bean J.D., on tactical maneuvers for the time being. I don’t know enough to be of help at the moment, but i’ll be there when needed. Not to worry Datuk.

  34. Tactical redeployment or withdrawal, whichever way you see it, involves the whole force not part of it.

    In order to inflict maximum delay a highly mobile rearguard force is deployed in the rear to keep the enemy busy.

    Delaying positions are established along the withdrawal route to engage the enemy as it advances.

    The whole idea is to delay the enemy for as long as you can while you prepare yourself for a showdown at your position of choice.

    I wonder how this gonna apply to the Din/Kassim impasse?

  35. If MACC wants to actively engage the bloggers they should also set up their own blogs and allow the public to post comments. No need to deal in hard copies. The bloggers have their email address. Just send an email. Wasn’t there a RM 50 million email project so governemnt agencies can send emails to rakyat.
    The MACC blog can also act as a conduit for info, both ways from and to the public. Just like the PO Box 2000 of old ACA which goes directly to Harun Hashim when he was had of ACA.
    I smell a rat here. Just be careful. They smile while holding a knife behind their back.

Reading the demand letter from MACC that Dato retract his earlier statement or statements made on this blog pertaining to the use (and misuse) of state resources viz. official car and personnel during what was alleged to be a private visit to the masseuse by an officer of a national investigative body, or else face defamation charges, it seems rather odd that someone is given an opportunity to admit to false statements being made. It is even more odd considering that it is the personal character of its officer that is being defamed and not that of the reputation of the national investigative body and for the investigative body to write to ask on his behalf that statements already made public be retracted as false is tantamount to telling the trustee alleged to have committed CBT to regularize transactions in his trust account to avoid being charged for the alleged crime.

    The burden is on the party who alleges to prove and not on the party who is alleged to have committed the act to disprove. MACC not only has the shoe on the wrong foot but it is on the wrong turf. We have carefully crafted tort rules upon which the aggrieved party could rely on.

    It is true that certain forms of libel is not protected by free speech. However, it must be proved that Dato has been motivated by actual malice and not just reckless disregard or a negligent failure to invetigate. If at all Dato is liable, it is for failure to investigate but not of knowing or reckless falsehood.

  38. At least Dato Abu Kassim made an attempt to admit he was at the vicinity than to deny. AG Patail failed in comparison regarding his Haj trip. He probably provoking Dato Abu Kassim to take action while he sits in with his criminal friends flexing his muscles and indirectly coercing Abu Kassim to do all the dirty tricks for him.

  39. This is shameful. MACC misusing information given in good faith and use it to send threatening letter to a social activist.

  40. It is never easy for a public official to prove criminal defamation. Because he is a public official, his public conduct is subject to public scrutiny – and that was what our bloghost is ‘guilty’ of i.e. public scrutiny of the behavior of a public official.

    Be that as it may, the standard of proof in criminal defamation is higher when it involves public figures and public officials. There has to be proof of actual malice. There clearly isn’t in this case.

    He stands a better chance of making a case at an invasion of privacy. He doesn’t want to do that.

  43. Saya baca artikel pertama Dato Din, panjang. Peguam Negara Gani Patail lebih teruk dibelasah kerana bersekongkol dengan proksi Tajudin Ramli. Ada juga gambar Gani dengan taukeh Cina. Tak pulak Gani Patail nak saman Dato Din. Apahal Abu Kassim nak melatah ni, langsung tak mesra pelanggan!

If Dato goes to court and repeat what somebody else had said about which he has no personal knowledge that would be heresay and would not serve as evidence. But heresay statments may well be true. They just do not qualify as evidence in court without their makers being present to be cross-examined for their truth and accuracy.

    RPK did essentially the same thing when he adopted statements said to be made by named sources in his sworn statements which he then circulated.

    So, after the official function at PWTC, Dato Abu Kassim went to Kota Damansara in his official car escorted by his official body guards to meet an unnamed individual in an office premise. Who was that unnamed individual? Which office is opened on Sunday? Was that an official meeting too? So why did his 3 burly men left him out of their sight to have lunch at Chee Chah Cafe next door?

    Hold on! Wasn’t this the same fixed-up charge that the MACC made against Dato’ Ramli Yusuff? When the MACC found out that Dato’ Ramli was indeed at all times in full uniform on official duty, they changed the charge to say he took a detour for a personal matter. So, Dato’ Abu Kassim, by that same yardstick, that detour using your official car and official bodyguard is still wrong! A a classic case of the pot calling the kettle black????

    There is nothing wrong with private citizen Kassim having an ‘urut’ after a hard days work in the field or in the office. It is all a legitimate exercise of his rights as a private citizen.

    What is wrong is the alleged use of state resources in the exercise of his right as a private citizen. Does that not ring a bell? We are talking abuse of power.

    MACC is alleging that an article that appeared written and published by the bloghost on this blog has cast imputations on the character of its Commissioner Kassim. Our bloghost in defence has never stated that he had personal knowledge of the matter referred to therein and was merely asking questions based on allegations made by third party eye witnesses, and by doing so he was only seeking information over a matter which is the subject of public interest.

  63. I see two issues here:

    1. after Dato Din has divulged information that this Abu Kassim fella was allegedly seen in a wellness centre, official cars and bodyguards et al, he gets afraid and as a natural reaction of a Malaysian civil servant who has committed wrong, he uses his office (the Communication Dept) to extract Dato’s address and phone numbers and then misuse this to intimidate him to withdraw the allegations, an abuse of power;

    2. If there has been a public disclosure of an alleged wrong already published publicly, there is only one thing a senior civil servant should do, resign or step aside, or be suspended pending an official probe from the MACC Advisory Panel members appointed for this purpose, as the Independent ICAC in Hong Kong and Scotland Yard would normally do, if you want to copy their system, then copy all, why only take the parts advantageous to you and discard the rest?

    Abu Kassim now has only two options left to him:

    1) submit his letter and step aside while a full-fledged thorough and independent investigation be carried out to determine the public allegations of using govt properties to go for an urut urut on a Sunday, and;

    2) to also call for an investigation to an abuse of power of falsely obtaining a taxpayer’s address and phone number and then misuse this to intimidate, harass and even blackmail him.

    If Abu Kassim has any respect and dignity in him, he would do the above but having him reneged on his earlier pledge he will resign his post if any major corruption cases are not investigated, I don’t this guy has any respect, dignity or conscience in him.

    Hell has a special place reserved for people like him and I am sure he will have a swell time meeting up old buddies and pals like Augustine Paul et al…

The only issue before Gay Patel in his capacity as chief government prosecutor in this case, is whether the statements published on this blog referring to a key government official entrusted with the investigation of white collar criminals, are defamatory and meant to discredit the reputation of the national agency?

    If you refer to the relevant statements published here, Dato stops short of adopting statements apparently made and subsequently claimed to have been made by third party eye witnesses as his own. Commissioner Kassim is a public official and falls into the category of the state actor and for claims of defamation to succeed he would have to discharge a higher burden of proof i.e. that of actual malice on the part of the publisher. Mere failure to investigate the truth or negligent recklessness would not be enough. This would be the civil standard and when it involves private citizens.

    It is in the nature of the job of a public official that his reputation is always key and pivotal and he or she benefits from the publicity. Since he puts his reputation out there, his conduct in public is always a matter of public interest. Before comments by members of the public could be said to be defamatory, such comments would have to pass the test of strict scrutiny. Otherwise, they are expressions of free speech guaranteed by the country’s Constitution.

    He used his Office letter head, an office staff to write that letter and unethically and cummingly obtain Din’s address.

    It is curious to note that while the MACC Demand Letter was very specific as to many details, it was ambiguous if the latter was also a meeting for an official purpose. The fact that Abu Kassim released his 3 men to have late lunch at the Chee Chah Cafe beside his meeting point with that unnamed individual suggest that it was not an official detour. Dato Abu Kassim should reply this first.

    At the same time, I would caution Din Merican to start preparing for a full scale assault by the AG Chambers and the MACC. Din seems to be preparing for battle already with this public disclosure including giving Abu Kassim the full right to be heard. That is indeed responsible blogging befitting his status as a prolific social activist.

    Beware also that by now, Abu Kassim’s pocket diary of the events would have been synchronised with that of his 3 bodyguards. That’s what the TBH RCI discovered was done by the Selangor MACC- they rewrite and “corroborate” each other’s pocket diary.

To put it mildly, it is very naughty of the Malay Mail Chief editor to run down a private citizen who is seeking to remind all public officials, especially those like the A-G and the MACC Chief Commissioner, that they have to maintain high standards of probity. They cannot perform their duty effectively if they are seen in wrong company, etc. These guys are lonely and carry with them the weight of public expectations. A judge, for example, cannot be a friend if he is to do his job properly.

    Dato Din’s article should be read in its entirety. He made mention of other cases and chose his words carefully. He raised a number of questions with regard to Dato Seri Abu Kassim who seemed to have explained himself well. By doing so, the MACC Chief Commissioner has set a new standard of accountability for all public officials. Syabas to Dato Seri Abu Kassim.

    As far as Mr Bru is concerned, I write him off as a person who will do anything for personal gain or his ego. He is unfit to be in The Malay Mail. Today, he may be useful to those in power who will utilise him for their purposes and then dump him when he is no longer an asset to them. Dato’ has shown that despite the skepticism shown by everyone here he will always do the right thing, i.e advocate for change for the country for constructive change even though he stands alone.     Is it always about mistrust, fighting and expressing anger, or can it not be constructive with no threats to anyone’s personal liberty? The lessons here are invaluable to us because Malaysians have to understand this level of open and honest discourse.

    The act must be evidence of an intent to cause particular harm, must be wanton and wilful doing of an act with awareness of plain and strong likelihood that such harm may result.

    The most biased of judges would find it hard to find “wanton and wilful” and “with awareness of plain and strong likelihood that such harm may result”. You can more easily find those in some comments made by RPK on his blog.

    But like everyone here knows when you are dealing with the most corrupt of judicial systems in the world, skilled in the art of making the impossible possible, a full compliance with request made would not diminish your integrity. Call it the Phang Doctrine if you will.

    But taking down someone who is more of a social rather than a political activist, someone criticized of late as being pro-Najib would not be good for the reputation of a regime struggling to find its niche in a new post-Mahathir era.

  101. If I were to show this letter from MACC purportedly from the country’s national investigative agency to a judge here, he’d die laughing. First, because no government in the world ever writes such a letter warning of an impending prosecution unless remedial action or actions are taken, and that too on behalf of its officer. Alternatively, assuming it is not authorised it can only mean that someone high in the hierarchy has knowledge of it and is complicit in the matter.

    The only way you can tell is to call for a press conference to ask if the government has not made changes in its national policy in the use of Bahasa and whether we can expect a change from Bahasa to English in our institutions of higher learning and in our courts. We can all then send more ‘syabas’ messages and this time to the Minister of Education and to the Prime Minister – to the Prime Minister for re-inventing himself for others to follow.

    This is a milestone in the history of our nation and should be welcome.
