IGP Ismail Omar: Wake Up And Do The Right Thing!

Some weeks back I mentioned that I would be writing about the plight of the six rank and file policemen who had discharged their police duties in collating intelligence report admirably without fear or favour. They did so notwithstanding that the trail of crimes was leading them to the doorstep of their then boss, IGP Musa Hassan. They did that at their own peril. In the end they were charged for trying to “topple” Musa Hassan.

Good Men have been victimised

They were brave to do what they did because they believed that they worked for Polis DiRaja Malaysia (PDRM) and not for Musa Hassan. They believed that they would be protected by their own Force. They were mistaken. Despite being seasoned police operatives, they were naïve. And they paid a very heavy price. Until today their cases are not over. Those who have been acquitted are now facing appeals by the A-G Chambers. Until the present time they cannot take any permanent job as they have been suspended from active service.

Their plight has now been highlighted in Parliament by the MP of Bakri, YB Er Teck Hwa. See YB Er’s letter as posted on Friday March 18, by Raja Petra Kamarudin (RPK) in his article “The Unholy Trinity Revisited” (see link  http://www.malaysia-today.net/mtcolumns/38872):

No Action against Musa Hassan

To this day, no action has been taken against Musa Hassan despite the fact that his complicity with the underworld has been set out very clearly in several Statutory Declarations (SD), including by his own aide de camp (ADC) ASP  Noor Azizul  Rahim. The revelations about Musa Hassan cannot be more clear and explicit as can be seen below:

The MACC and the Government went to town about protection to informants under the Whistleblowers Act, yet in this case not only were these rank and file policemen  not given protection, instead they were prosecuted. These things can only happen in Malaysia, the innocent are persecuted, and the crooks get away scot free!

These poor men have been left unprotected and abandoned by their own brothers in blue. That is the harsh reality: when you are down, no one will be there to help you. This is despite the fact that Musa Hassan is gone. This is despite the fact that Ismail Omar is now the new IGP. And why is that so?

IGP Ismail Omar: Stand Up for Your Men

The answer is simple enough – because Gani Patail is still the Attorney General. IGP Ismail Omar is afraid of A-G Gani Patail who wields absolute power over prosecution of all criminal matters in Malaysia. The A-G believes that he has absolute immunity because only he decides whether an act is an offence, and who gets charged for an offence and who doesn’t. That is why he remains unscathed despite public records from Tabung Haji showing that he is a bosom buddy of Tajuddin Ramli’s proxy, Shahidan Shafie, that ex-police inspector who was once charged with taking bribes by releasing secret societies members in Johore Baru.

A-G Gani Patail’s exploits of the criminal justice system  are already  well known. If you are a friend of  the A-G,  the possibilities are endless. That is why last month, RPK wrote that “Its nice to have friends in high places” about A-G Gani Patail charging Dato’ Loy Tuck Choy (Dato’ TC) for a very minor offence just because Dato’ TC kicked his buddy, Dato’ Vincent Lye, out of Ho Hup Bhd. Robert Phang on Propriety of A-G Gani Patail’s Personal Conduct

That is why Tan Sri Robert Phang keep raising this issue – of the propriety of the AG’s personal conduct that calls his professional decisions into question. Phang raised this again  during his Teh Tarik Talk at the Sooka Sentral last Thursday (March 17, 2011). He did not mince his words that  the A-G was not only a discredit but also a liability to the government. Phang was  blunt and direct in saying that all the government’s proclaimed efforts to eradicate corruption would be  NATO- No Action Talk Only!  To Phang, A-G Gani Patail is the problem, a cancer that  should be excised, otherwise the whole criminal justice system would be diseased and fall further into disrepute.

ASP Azizul’s SD made specific mention of Dato’ Ramli Yusuf whom I wrote about last week as being taken on for a ride by promises of being reinstated after he met Prime Minister Najib and Home Affairs Minister Hishammuddin Hussein Onn. Despite having been acquitted, until now, Dato’ Ramli has yet to be reinstated. It would appear that IGP Ismail Omar does not have the courage to undo what Musa Hassan had inflicted on Dato’ Ramli.

But ASP Azizul also alluded to an unnamed person at paragraph 14 of his statutory declaration (above) about “a sense of fear gripped many within PDRM when the lawyer who assisted the CCD was himself arrested in a most humiliating manner and charged in court one day before Aidilfitri”.

Rosli Dahlan was fixed

It is unmistakable that this lawyer is my young friend Rosli Dahlan. I was stunned by this revelation. I thought Rosli was only assisting the Police in detecting white collar crimes like the massive MAS Scandal. I did not realize that he was also assisting the CCID in apprehending blue collar criminals like this Along illegal money lending syndicate.  I now fear for Rosli. He may have unwittingly made enemies not only with those in the corridors of power but also those who wield power in the underworld. I want to caution Rosli to be very careful.

It seems such a coincidence that there are so many reports on Rosli Dahlan in the last few weeks. From the International Law Office (ILO) website, there is an announcement that he received an international award with three other Malaysian lawyers:

Last week, the business radio channel BFM 89.9 carried an interview with Rosli about the MRT controversy in Taman Tun Dr Ismail. Rosli did not mince his words in chastising unthinking government officers for their insensitivities in posting the MRT development notices on trees and lamp posts like the Along illegal money lending syndicate, listen to this:

Free Lawyer Rosli in the name of Justice

Is something happening here? Is there an attempt by the powers that be to atone for what they have done to Rosli? If so, then it is time to bring his case to a happy closure and let him rebuild his legal career that has been sufficiently ruined. I have said it before and now say it again, Lawyer Rosli is innocent and should be allowed to get on with his life and pursue his profession.

End Victimisation of Dato Ramli and the 6 Policemen

As for Dato Ramli and the 6 policemen, I say to IGP Ismail Omar – these are your men who were victimized in the course of their work. The injustice done by Musa Hassan can  and must be undone by you. Power is in your hands, wield it wisely and judiciously without fear of A-G Gani Patail. This is your moment in time to be an inspirational leader of  PDRM.  The Police Force needs it, your men certainly need it. I say to you IGP Ismail Omar -  Wake up and do the right thing!

  1. A passionate plea but do you think those in the corridors of power care? The people you are appealing to for mercy and justice are heartless, vicious and soulless. They don’t believe in God or the hereafter. Gani thinks his sins will be forgiven by making a pilgrimage.

  2. Malaysia has turned into a Police State. Even a Prime Minister cannot stop the Police from conducting Operations Lalang in 1987 and put opposition politicians in jail under ISA.

    Today the Police, whose salaries are paid by Malaysian taxpayers, are a power unto itself. It does not stand accountable to anybody, least of all Malaysians who are paying their salaries to feed their families and their children.

  5. Is there much to be expected of IGP Ismail Omar who on assuming the post of IGP said that he will continue with the legacy of is predecessor, Musa Hassan. and what is the legacy of Musa Hassan- a “Pengkihanat!” as labeled by his own ADC.

    This is a timely call by Dato Din Merican to IGP Ismail Omar to wake up! Not too long ago, another sleepy head was deposed for all talk and no action or rather all sleep thus no action!

    Is this your version of 1Malaysia? It stinks to high heavens and you still retain the A-G despite all the damaging allegations. Is he holding your bees and that’s why he is untouchable?

  7. It is a real shame we have a police force big in numbers but small in courage to do the right thing. It is high time for IGP Ismail Omar to wake up from his slumber. Resurrect the spirit and morale of your subordinates for your much wanting leadership to protect them during the time of need.

    The clarion call is for the IGP to commend and reward them when they perform their jobs without fear or favour. The 6 officers deserve to be given unequivocal support for upholding their oath of office. Demoralising them will undoubtedly give the wrong signal to the others in the police force and will reflect badly on poor and weak leadership. If the IGP cannot provide the leadership, it is best that he step down and retire.

    In truth, we need a total overhaul of leadership in the Police Force, A-G Chambers, MACC, Judiciary, and not to mention even the Government. The FEAR FACTOR is alive and real but for the wrong reasons. Righteousness, morality, diligence, and most of all, the fear of God have been compromised.

    Like Dato’ Din and many others asking IGP Ismail Omar to wake up and do the right thing, that is a fair call.

  10. Rosli Dahlan deserve to be set free and Ramli Yusuff need to be reinstated and given his pensions back. I think the PM and Home Minister are also both afraid of the ex-IGP and the AG! They just dont seem to do the right thing! hats the problem, people with skeletons in the cupboard are always beholden and cannot do the right things but held by their balls!

  13. These guys have de facto immunity from criminal prosecution for as long as they toe the line, not rock the boat nor make waves.

    There is none of the tradition nor the laws that you see in some other jurisdictions which allows a private citizen to walk up to the judge and present evidence that would allow private prosecution to move forward.

    I remember seeing Ismail Omar at one investitutre ceremony receiving one of his many datoship. Didn’t even stand out, was rather bored and disinterested. Didn’t think he’ll make IGP.

  24. Ismail looks like the typical OCS (Officer in Charge Police Station) of yore. I remember the OCS of the Serdang police station in Kedah whom I befriended when operating in the jungles behind the town. He was very much like Ismail, especially his toothy grin.

    Ismail was made Deputy IGP by Musa for a reason. He wanted a “yes” man who would not question his orders. Anwar Sadat’s choice of Hosni Mubarak as a deputy was for the same reason. Likewise Al Kutty’s naming of Sleepy Head as his running mate.

    Most leaders need someone coy and sissy beside him so they can do whatever they want.

    So guys, don’t pin too much hope on this Ismail fella making an impact. He’s another of those “Saya Yang Menurut Perintah” type whose only wish is to retire with his pension intact and be appointed director of some GLCs.

    Look at Ahmad Sarji. He has been hogging the corporate limelight far longer than his service in the government. Is he so indispensable?

    A guy I knew – a typical Chinaman, looked like one, talked like one i.e. a typical Coporal Clott – who couldn’t tell his left from his right when marching rose to the rank of ACP. What does that tell you?

    But you are right where if they have anything upstairs they won’t join the men in blue, cos, they would rather join the likes of Tengku Goh and issue commands to the men in blue instead.

  30. One other guy who was sacked from RMC due to poor grades, joined PDRM instead. He rose to the rank of SAC 1 before retiring. He would salute with his left hand when the order “hormat kiri” was given on parade. Neither could he stop when the order “henti” was hollered.

    UMNO owes the AG real big time especially on high profile cases such as the persecution of Anwar Ibrahim. So it is impossible for them to let go off this crooked AG for they would lose a “dedicated” AG. To find a “suitable” replacement at this crucial juncture is dangerous for them even though there are many more “4 tahils” out there (5, 6, 7, 8 tahils etc) who are ever so willing to do their biddings for handsome returns!

    So, as the man says… Goodbye justice & welcome lawlessness for a long long time….

    Similarly , the cancer in PDRM has been growing for sometime now . Careful ” surgery ” and good competent ” surgeons ” would be required to put things right .

    These competent ” surgeons ” are not available in PDRM now . Only the incompetent are still in place because they were put there by Musang Hassan.

    Hence , the predicament in which IGP Ismail Omar finds himself . Doing the right thing cannot be easy in this cancerous enviroment .

  37. The top judge is replaced by his assistant who also tried him. The IGP is certified clean by the AG. The MACC head is certified clean by an MACC commissioner.

    The trouble with you is that you are too engrossed in fiction (Yes Prime Minister TV nonsense) and enamoured by PAP’s propaganda in the book “Men in White”. These two have no relevance to the politics of Malaysia. Nobody gives a damn about UK politics for that matter.

There is a saying I heard once and I havent forgotten it and that is” God hasnt given up on you , dont you give up on us”. Dato’ dont ever give up on fighting for fairness.   43. AG consorted with Tajudin and Tajudin is free from any charge although MAS lost RM8 billion. The photo is there. AG is friends with Vincent Lye. Although Vincent committed CBT, he doesnt get charged. Instead Dato TC gets charged. The picture is there. What more proof do you need MACC ? So don’t crap about eradicating corruption.   55. To be fair to IGP Ismail Omar, his hands are tied. He can’t reinstate the 6 policemen because their case is not over. Even if they are acquitted, he still can’t reinstate them if the AG appeals vs them. That is why he can’t reinstate Dato Ramli despite Dato Ramli having been acquitted three times by three different Sessions courts because the AG has appealed against all three acquittals. That brings into question why the AG appealed despite having previously said in Razak Baginda’s case that he (AG) respected the court’s finding of fact and would noy appeal against Razak’s acquittal.

    The blame lies squarely on the MACC and A-G Gani. They should know these cases are a no go from the beginning. In Bean’s words, these are not normal prosecution but orchestrated persecution calculated to inflict misery and suffering with no prospect of real success. That is what that seems to irk Din Merican when he sees good people being charged in order to destroy their lives and their families and to ruin them financially with the expensive legal costs.

    It is such abuses by the A-G that have brought his personal conduct into question. These are the rogues in government referred to by Tan Sri Robert Phang. We should all speak with one voice and tell PM Najib that all these abuses have to stop or BN will earn the wrath of the people at the ballot box come GE 13.

    Statutory Declarations don’t mean shit, as we say over here.

    You can go swear anything you want and have your statement – not worth the paper it is printed on (in some cases) – sworn before some retired court clerk/interpreter acting as Commissioner for Oaths for RM2. This is not evidence of anything. The evidence is the oral sworn testimony you’re giving in court, when you could be questioned, examined and cross-examined for its truth and veracity.

    Out-of-court statements though sworn are hearsay and are not admissible if the purpose is to prove the truth of their contents. Without the maker, it is hearsay. If the maker is in court, then it is what he testifies in court under oath that is the evidence and not what he said to somebody under oath out of court.

    Like we say over here, SDs (or out-of-court statements though sworn) don’t mean shit.

  58. The statement you gave the police under S. 112(?) of the CPC is hearsay and is not admissible for the same reason. It’s only use in court is to impeach your credibility if your credibility is in issue and there are inconsistencies between what you told the police earlier and what you are now saying in court. That’s Evidence 101.

    The AG has found a purpose in the use (or rather the misuse) of his discretionary power. The aim is not to seek a guilty verdict but to punish the person falsely accused. Imagine the accused falsely accused of some crime going about his life with a dark cloud over his head for years without end, trial being repeatedly postponed while his resources are being depleted and his career is in kept in deep freeze – and his family falling apart, having had to live his life under the public limelight.

    The only reason why he has not seen it fit to prosecute this Phang for alleged corruption is that Phang having resigned is no longer a threat.
