Enter the Jester

COMMENT Very few court cases are titillating but the cross-examination on Wednesday, of Thai pathologist Dr Pornthip Rojanasunand by Abdul Razak Musa, the lawyer representing the Malaysia Anti-Corruption Commission, was a tragi-comedy.
This is Dr. Pornthip’s second appearance at the inquest into the death of Teoh Beng Hock, a DAP political aide who was suspected to have fallen from the 14th floor of the MACC’s state headquarters.
The facts are these: TBH died under mysterious circumstances. The investigation into his death is a charade. The inquest is a pantomime. The MACC prosecutor behaved like a court jester.
If it wasn’t for the seriousness of the crime, we wouldn’t know whether to laugh or cry. If Abdul Razak needed a change of job, he would make a successful stand-up comic.
Abdul Razak sought to discredit Pornthip because of the variance in her first and second post-mortem analyses, (she based her conclusions on the first-mortem report and on the observation of a second post-mortem).
However, she highlighted that procedures were not adhered to during the first autopsy. She said, “The other doctors made a mistake.”
This is not the only lapse in adherence to ‘standard operating procedures’. What will Abdul Razak say about the ‘suicide note’ that was ‘discovered’, two months after TBH’s death? Protocol was overlooked.
Are we to believe that Abdul Razak is the best lawyer the MACC can summon? He is a class-act, but for all the wrong reasons. He suggested that Teoh ‘strangled himself’ and was ‘depressive’.
Abdul Razak even amused the court with a comical demonstration of ‘strangling himself’. He might not be so thrilled to know that everyone present wished he had done so, and save the agony of listening to him.
The court was then transfixed when Abdul Razak suggested that Pornthip’s report was “based on her imagination”. He then asked if Pornthip had “any experience jumping off a building”.
Only a vacuous person, or someone who is high on drugs, could even contemplate such a ridiculous question. Abdul Razak then showed his ignorance of science and of common sense by saying that, “If (Teoh) was unconscious, his body would be heavier.” Is he alluding to the ‘dead weight’ of a person when it is motionless?
On the anniversary of Teoh’s death, the MACC chief commissioner Abu Kassim Mohamed pledged not to “cover up” Teoh’s death. Admittedly, he may be fighting a losing battle to regain public confidence.
At the end of July, the MACC operation review panel said the media should “protect” MACC to encourage foreign direct investment into Malaysia. It was suggested that the press had been unfair in its coverage of the MACC and should help rebuild its image.
Amanah Raya Berhad’s board director Aminah Pit Abd Raman said, “We are talking about image. This is the country that we love, you are the press. You can write one negative article that will effect investment for an example but you can also highlight the positive things.”
At yesterday’s inquest, Abdul Razak, accused Pornthip of having “already made up her mind (against suicide)”.
Having heard and read of the circus he conducted, I can write that Abdul Razak is a ‘determined’ person. Frankly, Abdul Razak – incoherent, incompetent and indelicate – has discredited himself by pressing the self-destruct button.
Malaysia has caught the world’s attention again – albeit for negative reasons: Corruption, injustice, religious absurdities, racial inequality, insubordination of women and this farcical inquest. The government will have a tough fight to regain credibility.
Teoh’s death is a disgrace to all Malaysians but the MACC seems more concerned about its image (does it understand that it is not in the image business but that it exists to fight corruption?).
Does the MACC feel that Teoh’s inquest is of little significance and no importance, and so they fielded a lawyer who was uninspiring?
If not, then people must be wondering if Abdul Razak Musa is the MACC’s secret weapon. But can anyone really be that daft?
Few in court yesterday will easily forget the collective sigh of relief when Abdul Razak finished questioning Dr. Pornthip.
The tragedy is that the comic side-show created by the MACC’s counsel is a distraction, and is diverting attention away from the more serious business of getting justice for Teoh Beng Hock.

Nobody’s death is ever a disgrace.
It is the way he was alleged to have met his untimely demise and the way his name is being dragged into the mud afterwards, along with the memory of his death at the hands of criminals after the fact, who never bargained for more than the usual fifteen minutes of fame.

It is in the business of rehabilitating the image of UMNO from one of a corrupt regime to one that is sometimes corrupt.

ABDUL RAZAK MUSA’s mediocrity as represented by his clownish antics in court , is exactly representative of the state of affairs in the Civil Service , the Police force ( as represented by the Musang ) the Legal Service ( as represented by the Gani Pai teng ka ) and the Armed Forces ( with humble apologies to Tok Cik ).
Abdul Razak Musa , represents Dr mahathirs legacy to the nation . similarly also Gani Pai Teng Ka and Musang Hantu .

Samad, “Mediocrity” would be a stupendous understatement and misrepresentation of the quality and vision of the enforcement side of the Malaysian civil service. It is more of an organization of bangsats and baruahs, filled with hatred for anyone in the way. It is cultivated in the schools, by principals that have been brainwashed and filled with hatred instead of love for children that they are supposed to be role models for.
What do you expect, when educational ministers wields keris against minorities and such images are splashed all over the country? Minorities are done for if BN remains in power. Malaysia seems to be begging for a major disaster so that the country can come together as one. JLX or someone had commented that it will be good for Malaysia to get bankrupted so that it can start anew. That would be to punish the innocent for the ills of the politicians and bad leaders. It would be akin to having a rogue tiger in a cattle farm. So instead of shooting a rogue tiger, you slaughter all the cattle? This is exactly our problem. Our rogue tiger is BN. We should not die for these bastards. Instead, our survival is only guaranteed if these rogue tigers from BN are decimated. That must be our goals and dedication, to get rid of such threat to our country. Perhaps GOD created Pulau Jerajak for this purpose.

Looks like there is more than 1 court jester.
I thought DPP Abdul Razak couldn’t understand between ‘unconscious’ and ‘dead’ and was groggy until even the coroner had to chuckle but this Sayang Bangsa also just as dumbo. Maybe you should also take 3 days to read a 11-page report LOL!

Jester?? That’s a dangerous word to use, because medieval jesters were often the ‘foolish’ chief advisors to the Monarch, whether in Europe or in the Calphates. They were often very shrewd and of high intellect besides being able to discern the mood of their masters. The equivalent term nowadays is probably idiot savants.
My vocab is insufficent to describe this ridiculous character who ‘interrogated’ Dr. Pornthip, who sarcastically asked: “Are you a lawyer?” I agree with james whole heartedly about the ‘mediocrity’ part. This lauyar had just “licked a toad” before he showed up in court.

Rasputin was an evil megalomaniac genius who manipulated the Czarina, and thence the Czar. This flur is too ridiculous to even lose face-water and stoopid (er.. not foolish) beyond redemption. Anyone knows where he graduated from? I think they should take away his licence and put him in a zoo. MACC is just another dump for failures and it boggles me, why anyone would want to be hired by them. All they do is to watch re-runs of HK soap operas and think that it’s real..

Over here, it would be legally incumbent upon the coroner to carry out an inquest or a judicial investigation into the passing of anyone who died under hard to explain circumstances or a sudden death under unexplainable circumstances. It is incumbent upon the coroner to establish the cause of death and deliver a verdict which could range from an open verdict to accident/misadventure, or unlawful killing or suicide.
Often it comes down to a battle of the experts. In law, the general rule is opinion evidence is irrelevant and hence inadmissible. But when it comes to expert opinion, it is relevant and therefore admissible. Exception to the Rule.
So you bring in an expert to offer his or her opinion. The other side then will line up their experts. There is no end to experts. Pay them the right sum of money and they will testify as to how your mother-in-law had been kidnapped by little green creatures coming off a spaceship.
The more experts the merrier because it looks like you have the truth on your side. Right? Wrong. But then what do they say about repeating a lie often enough? They acquire a ring of truth around them.
In Teoh’s case a pathologist had ruled that the cause of death is probably from a fall from great height, that it was not a dead body reacting to the pull of gravity. The fall actually caused his death. A distinguished British pathologist brought in by the opposing side had ruled that the cause of death is a fall from a great height and that he was conscious when he fell but refused to rule it as suicide. This is like DPP Ahmad Bache kicking the ball into his own goal. It happens.
As it turns out in this particular case, it comes down to a consensus rather than a battle between one of the highly distinguished and respected pathologists this side of the world and an unorthodox pathologist who heads Thailand’s Institute of Forensic Medicine and one who sports a punk-rock hair, dyed purplish red, eccentric clothing, and glittery eye makeup, and platform shoes with an exotic name.
But then this is Malaysia. A country whose citizens are known to have punched themselves in the eye and strangled themselves to death. This one jumped off the building while dead.

Alamak, komando – you don’t understand what ‘idolatry’ means lah. It also means worshipping the the ‘gwai-lo’ or ‘ferringhi’, together with the Dunhill, Lotus and Jaguar etc. ‘brands’ mah.. Oh forgot, Jimmy Choo, the Ipoh flur. Same like the affluent Arabs.
These Britishers consider our nasi lemak ‘quaint’ and satay ‘odd’, but their national dish is ‘curry’. Sometimes bangsats become cultural icons, you know..
