At Ringside: Dato’ Ramli Yusuff Acquitted For The 3rd Time!
by Din Merican
My comment yesterday was just a curtain raiser. Here is my ringside account of the Dato Ramli Yusuff’s acquittal by Judge S.M Komathy Suppiah.
At 4pm sharp on August 20, 2010, the KL Criminal Sessions Court Judge SM Komathy Suppiah asked Dato’ Ramli Yusuff to stand up and then pronounced: “ Dato’ Ramli, I find that the Prosecution has not established a prima facie case against you, your defence is not required and I hereby acquit you!”

This is the last of the series of cases leveled by the Unholy Trinity of the AG Gani Patail, the IGP Musa Hassan and the MACC.
The public at the gallery clapped. The pretty Judge smiled and then retired to her chambers. Dato’ Ramli’s friends and family members surged to him, some hugged him, others shook his hands. Tears dropped from Dato’ Ramli’s eyes and rolled down his cheeks. Tears of joy, tears of relief, tears of gratitude to the Almighty God for having given him full vindication.
Dato’ Ramli walked up to thank the hands of his most eloquent counsel, the eminent Dato’ Seri Shafee Abdullah. Dato’ Ramli walked to DPP Tuan Ahmad Bache and shook his hands too. A display of the finest breed of gentleman who would thank his own prosecutor. This was the scene in court on the acquittal of Dato’ Ramli for the third time.

Dato’ Ramli walked up to thank the hands of his most eloquent counsel, the eminent Dato’ Seri Shafee Abdullah.
A Possible End of Trumped Charges by the Unholy Trinity
This is the last of the series of cases leveled by the Unholy Trinity of the AG Gani Patail, the IGP Musa Hassan and the MACC. It is very telling that despite deploying the whole of might of the most potent law enforcement agencies and supposedly the best brain in the AG’s Chambers, not one of the charges leveled against Dato’ Ramli could stick. The charges could not stick because these were trumped up charges. These trumped up charges build from fabricated evidence was like trying to spread rotten egg on a teflon coated frying pan, it would just peel off. These fabricated charges crumbled once the facts are presented before a fair court.
Sessions Court Shows Independence and Fairness in dispensing Justice
It is with great hope that we see the Sessions Court showing independence and fairness in dispensing justice,
just when the High Courts and the so called Superior Courts have failed and disappointed us, countless times again and again. An indictment of the failure of the superior courts could not be more damning than a recent statement from the former Justice NH Chan in describing Augustine Paul as an obnoxious man who was not fit to be called a judge. In NH Chan’s mind, Augustine Paul was a transgressor of the law and thus violated the oath of his office.
The same should therefore be said of men like Musa Hassan, Gani Patail and now Abu Kassim for violating the oath of their offices. Enough ugly things have been said of Musa Hassan – Mattress Carrier and Fixer, but nothing more damning than when he tried to sway the court against the witnesses who had spoken in favour of Dato’ Ramli during the Sabah case.
The Sabah Case (Round 1)

Musa held the post of Bukit Aman prosecution/criminal law deputy assistant director in 1995 and Johor Chief Police Officer in 2003.
The IGP Musa Hassan made the biggest mistake when he appeared as the Prosecution’s 75th witness in order to rebut all the other police directors who had given evidence earlier. In the end, Judge Supang Lian damned Musa Hassan in clear unequivocal terms when the Judge said that Musa’s “ evidence was incredible and not to be believed”. Never before in the history of the legal annals has an IGP been damned with such words. In Japan, a four star general , which the IGP indeed has four stars on his shoulders, would commit harakri to save his honour. Do you know why Musa would not do? It’s because he has none!
Kuala Lumpur Case (Round 2)
AG Gani appealed but lost before High Court Judge Rahman Sebli. So in Sabah, Dato’ Ramli had won two acquittals- one before a Sessions Court Judge and another before a High Court Judge. The same thing happened before Judge M Gunalen, when Dato’ Seri Shafee Abdullah showed that many of the MACC witnesses had lied, especially the faggot DPP Kevin Morais. I have written extensively about this in my article “The Liar Kevin Morais buried in his lies”.
Kuala Lumpur Case (Round 3)
Then yesterday, we have the pretty Judge SM Komathy also acquitting Dato’ Ramli. As explained by Dato’ Seri Shafee Abdullah, it is significant that in all the three cases, Dato’ Ramli was acquitted without his defence being called. It is significant because it means that the prosecution had failed to prove a prima facie case. In layman’s term it means that the prosecution had not shown there was a case. In street terms, it means there was no case. It means the IGP, the MACC and the AG made up a case. It means they tried to fix Ramli but failed. Bad men plot but God disposes their conspiracies!
In mathematical terms, they tried to fix Dato’ Ramli three times for three different charges in three separate courts before three different judges but failed. In doing a headcount, it means that 3 senior Sessions Court Judges and 1 High Court Judge had found Dato’ Ramli innocent. Judge Supang Lian and Judge M Gunalen have since been elevated to the High Court. So that makes it three High Court Judges and 1 Sessions Court Judge i.e. a total of 4 Judges have found that Dato’ Ramli was innocent. Is that full vindication or what?

In mathematical terms, they tried to fix Dato’ Ramli three times for three different charges in three separate courts before three different judges but failed.
The AG will likely Against Judge Komathy’s Acquittal
So, will the AG appeal this one? Well, we won’t be surprised. It is easy to imagine that the AG Gani is now enraged with Dato’ Ramli’s third acquittal. AG Gani must be fuming mad as RPK is presently exposing that the AG Gani had blocked Dato’ Ramli’s investigations into the crooks of the underworld and of the corporate world. RPK had exposed why Dato’ Ramli faced all these trumped up charges in his article – The Ramli Yusuff Story –the real reason why he was brought down.
It would be no surprise if an appeal is made as they need to divert and tire Dato’ Ramli down from tracking that the IGP, the MACC and the AG had conspired in the following:
1. In the Sabah case, ASP Chew Kam Soon of the Police and Superintendant Sok One a/l Esen of the MACC had fabricated evidence to make it appear that a village headman had named Dato’ Ramli in a report. They fabricated facts about disturbance to villagers, but instead charged Dato’ Ramli for unauthorized use of a police Cessna. They concealed the fact that Dato’ Ramli was in full uniform conducting an aerial survey of weakspots in the coastal line of Sabah. Because of that Judge Supang Lian and Judge Rahman Sebli acquitted Dato’ Ramli;
2. In the KL case (Round 2), IGP Musa Hassan detained an underworld operator Moo Sai Chin under the Emergency Ordinance and forced this criminal to agree to implicate Dato’ Ramli. For doing that he was then released not only from detention but also from Restricted Residence. That was why the MACC needed four cover reports to camouflage their tracks. The MACC faggot DPP Kevin Morais then lied throughout his court testimony. Judge M Gunalen saw through all this and thus acquitted Dato’ Ramli without calling for his defence;
3. In the Summons case before Judge Komathy, the MACC cut and paste provisions of the Reg. 5 of the General Orders to make out an offence under Section. 168 of the Penal Code i.e. that Dato’ Ramli was engaged in trading without permission. The problem was: i) Dato’ Ramli did have approval to form a company as admitted by Dato’ Robiah and then IGP Tan Sri Bakri Omar ; ii) the company was still dormant as admitted by the Investigating Officer (IO) and the Company Secretary; iii) a dormant company could not be said to be trading as was admitted again by the IO and the Company Secretary.
The Mystery: What happened Tan Sri Bakri’s Letter of Approval?
What remains unanswered is – did Musa Hassan destroy or caused to disappear Tan Sri Bakri’s signed

The suicide note in Chinese reads: 'Mom, I am sorry that I could not be with you anymore. Please give my liver to father after I die.' [Modern Express
letter of approval from Dato’ Ramli’s service record? If he did not, where is that signed letter of approval? It could not just vanish into thin air? Was that why the Prosecution refused to call Tan Sri Bakri and Dato’ Robiah to be witnesses. But then again, Musa is not known as the Mattress Carrier for nothing. In Sodomy I and the Black Eye incident, he was shown to be an expert in making evidence appear or disappear. Just like how the AG now conjures the suicide note from Teoh Beng Hock’s rug sack?
The Case against Lawyer Rosli Dahlan is absurd
So we now have it, that the three charges were clearly trumped up charges. Today’s verdict was very significant because it raises our hope that Truth and Justice will prevail eventually. I said that yesterday in an article which I dedicated to Rosli Dahlan to celebrate his birthday. So Friday’s acquittal of his friend, his client, his buddy is the perfect birthday and Ramadan gift for Rosli. And like a true loyal friend, Rosli was in court listening attentively to Judge Komathy’s verdict.
In reciprocation of true friendship and ikhwan (brotherhood), I overheard Dato’ Ramli saying to DPP Ahmad Bache that

No wonder Dr Pornthip asked if Razak was a lawyer (implying he was a red-nosed clown!). Having now read how fat “badut” Razak could ask Dr Pornthip if she had any experience jumping off a building, I now realize why the whole MACC is the biggest joke of the Abdullah Badawi legacy.
Ahmad should recommend the withdrawal of the case against his friend, Lawyer Rosli Dahlan. I overheard Dato’ Ramli rationalizing that since he (Ramli) have been acquitted, how could Rosli be abetting a non-crime? The MACC’s case against Rosli is as ridiculous as the MACC Director of Prosecution suggesting that Teoh Beng Hock died of self-strangulation!
Public Sympathy and Support for Rosli
When I saw Rosli in court yesterday, I took the opportunity on behalf of all of us to personally wish him a Happy Birthday. I told him that he should purge from his mind that the cause he is fighting for is a hopeless cause. I told him not to despair. I told him not to be sad. I told him not to think of quitting his practice. I told him that my article yesterday on Dato’ Ramli and Lawyer Rosli Dahlan hit 92nd spot in the WordPress Top 100. I told him that Malaysians are behind him in this fight for truth and justice. I hope he will read my article and realize that I am telling him about what the average Malaysians feel about the whole affair. I want him to know that he is not alone.

Rosli has a broad commercial practice having experience in a wide variety of commercial and corporate disputes and litigation including international arbitrations in Europe. He has worked closely with international clients in managing their cross border disputes. Rosli primarily acts as Counsel having appeared at all tiers of the Malaysian Courts and his portfolio of litigation work has a particular focus towards corporate litigation such as shareholders disputes, restructuring, recovery, land disputes and also regulatory compliance work. As an accomplished negotiator, Rosli has wide networking in the region, particularly in Indonesia which previously enabled him to secure the release of Malaysian accountants imprisoned in Makassar, Indonesia for violation of local and immigration laws.
Rosli must not feel alone just because Dato’ Ramli has been acquitted of all the charges whereas his case is still hanging over his head like the sword of Damocles. Rosli must know that people support him just as he was surprised to see that even his senior partner, Dato’ DP Naban, came to court today to lend support. It shows that his partners cared. It shows that Malaysians cared. It shows that we all share the same ideals, vision and hope.
I also wanted him to know that YB Salahudin Ayub who sits in the MACC Special Committee on Corruption has been in trying to be in touch with his office to get more information of the cover up in the MAS case that led to him and Dato’ Ramli to be charged. I hope Rosli will not use client’s confidentiality to avoid helping the good MP who is doing what the MACC had refused to do. I also now want to use this opportunity to ask YB Salahuddin Ayub to use his position in the MACC Special Committee to summon Rosli and Dato’ Ramli to appear before the Special Committee to testify what they know of the collusion between AG, the IGP and the MACC to release that underworld criminal Tengku Goh and corporate figure Tajuddin Ramli.

Gaji buta for some, durian runtuh for others. Abdullah Ahmad Badawi, the MAS advisor, should start cracking on the lop-sided monopoly contracts which are against MAS' greater interest. He can start with the LSG Sky Chefs-Brahim's Sdn Bhd catering contract with the national carrier. In three months, the Sdn Bhd did slightly more than RM50 million worth of business with MAS. Oh, by the way, the Brahim in the Sdn Bhd is Ibrahim Badawi, brother of the MAS adviser.
Malaysians must join me and we must stand together to demand that the MACC Special Committee do that. Our voice together as Suara Rakyat is Suara Keramat. Let us use our Suara Keramat to denounce these abuses of power. Let us use our Suara Keramat to drive obnoxious men like Gani Patail and Musa Hassan from their office. As for MACC’s Abu Kassim, he had made a public pledge to resign if any report is not investigated. His public pledge is his sumpah. Like the ancient Malays saying biar dia dimakan sumpah! Let them know that we the Rakyat will not acquit them so easily!

For the criminal lawyers out there, now that Dato’ Ramli is free, shouldn’t they now withdraw the case against Rosli ? It would make an ass of the Law if he isnt. Or is this a case of , as Mr Bean says, to make Rosli suffer as long as they can?To scare others into no action.

“Dato’ Ramli walked to DPP Tuan Ahmad Bache and shook his hands …”
He should. DPP Ahmad Bache scored into his own goal and lost the game 0-1.

“I hope Rosli will not use client’s confidentiality to avoid helping … ” Din Merican
Attorney-client privilege does not attach to all communications between client and attorney. Also there are exceptions.
In any case, I see no reason why Rosli would not want to cooperate with the authorities in bringing a criminal to book. Unless, of course, disclosure of the information and his client’s sources may also implicate his former client.

“It would be no surprise if an appeal is made …”
You need leave to appeal and I don’t see grounds for appeal here. Other than the lead prosecutor scoring into his own goal. But that is not a valid ground for appeal.

Yes! Congratulation to the good Dato and his team of world class lawyers. And to a decent and God fearing judge who would not bend to political ill-will. When we first read on how the Dato prevented his boss from hammering Anwar to death in Sodomy I, we knew that here was one good cop. Victory like this gives us a small glimmer of hope that the judiciary can perhaps be saved. Just get rid of the worms that are infesting it and all will be well. Likewise the same to the whole sick clowns who are now running or more appropriately, running down the country and plundering it of whatever little is left.

“I overheard Dato’ Ramli rationalizing that since he (Ramli) has been acquitted, how could Rosli be abetting a non-crime?”
But I thought this was the charge facing Rosli:
He (Rosli) was charged with failing to declare his assets in two months as required under a notice dated July 17, which was later extended to Aug 16, an offence punishable under Section 32 (2) of the Anti-Corruption Act 1997.
Mr Bean - August 21, 2010 at 9:04 am
Tuan Din Merican,
Recana anda menusuk hati dan membangkitkan semangat sehingga berkocak darah mahu memberontak atas kezaliman ini. Alhamdulillah, kebenaran terbukti akhirnya. Saya sangat bersetuju kita laungkan Suara Keramat Rakyat dan menghalau bajingan Musa Hassan Gani Patail dan menyahkan mereka dari jawatan masing masing. Allah laknati mereka. Abu Kassim membuat nazar kepada awam, maka biar dia dimakan nazarnya.
Saudara Rosli- La Tahzan, Allah bersama kamu.

Mongkut,
Rosli is a private sector person who pays his income taxes regularly. Details are available from the Inland Revenue, where his sources of income (from different assets, physical and intellectual) would be declared. That is why I think they are trying to fix him for daring to speak up and suing them.–Din Merican

salimah hassan - August 21, 2010 at 9:46 am
Bean,
If you had followed RPK’s narration, you will note that Rosli did file his Statutory Declaration on his assets. Kevin Morais then said it was not sufficient and that’s why Rosli was charged. But the charge did not say what or which asset he did not declare.
You were once a top lawyer yourself and could elaborate that a charge must specify the full details so that the accused is left in no doubt as to what he is charged for. Fundamental to the right to be heard is the right to know what is the offence in order to make a proper defence.
The MACC called Rosli an “associate” without even knowing the definition of that term in the Act. In short, the MACC doesn’t even know their own Act. Read Mariam Mokhtar’s narration of the clownish antics of the MACC’s Director of Legal and Prosecution, Dato’ Razak Musa, and you will realise what a “badut” he is (to borrow Din’s expression). That is why Kevin Morais was having such a tough time under cross examination. He had to lie as to why he issued the Notice vs Rosli and why he ordered Rosli’s arrest.
They had to lie because none of their actions could be justified. As you have also pointed out, the objective was to destroy and hurt, it did not matter how. Just as you have done the day before, use the might of your pen to rally and galvanise support so that readers can be so utterly revolted by these abuses and want to effect change. Let’s help the cause.

I fully support this. We must not make En Rosli Dahlan feel alone. We must continue ti support him. Din Merican must continue to remind all Malaysians that this unassuming low profile lawyer is fighting a cause bigger than just his case. It would be so easy for him to give in, but he is fighting because he is fighting the common man’s cause too- against injustice, victimisation, to stop abuses of power and for the truth.

Mr Din Merican,
This is a very powerful piece. It gives the goose pimples! You should go into politics with such rousing speeches and power packed lines.
Your court of public opinion should now be used to help Rosli Dahlan. Since the pictures on your blog show your very wide networking, why not use your connection to get Rosli’s charge to be dropped! Please keep on writing like this.

Dear yclai,
I am sure it is not appropriate to use connections (and I have never used connections to get on in life, although I do have genuine friends whose assistance made things possible for me). This is a trial about injustice to a professional. We need to have a full documentation of cases like this for future reference, so that innocent people would not be charged without thorough investigations by the MACC IOs.
Our DPPs from the AG office are not eloquent enough; I am being fair, to both sides.Their art of oral presentations is rather poor. Rosli and Datuk Ramli have more connections than I. In fact if I am not mistaken, Datuk Ramli received Datukships not less than 5! Rosli Dahlan has a resume that would put even the AG or IGP to shame! My wife used to tell me we would not have lost Pulau Batu Putih, if Rosli were to represent Malaysia at the International Court in the Hague ! __ Din Merican

Shafee Abdullah.. the eminent lawyer that ably defended Dato Ramli is also the lawyer that RPK is having a tussle with, and who RPK alleges is involved in Anwar’s SOD 2 frame- up !! And remember Walter , Shafee Abdullah was also mentioned vis a vis V K Lingams , royal commission investigations as a lawyer who sought Lingam’s assistance in ” fixing ” some for him . So now Shafee Abdullah is seen as a hero and not a villain in your new BOLEHWOOD epic , i guess .
There is greater consistency in Raja Petra’s writings than here in this blog. So I for one would disregard Shafee Abdullah’s role here . He is nothing more then an enigma here in BOLEHWOOD.

One must appreicate Shafee Abdullah as a lawyer. Whether we like him or hate him, there are hundreds of case reports in law journals of cases that he handled that show his eminence as a jurist. Every case that he handled has become a legal precedent. He has a pleasant demeanour as a counsel in court.
Just because RPK slammed him doesn’t mean we just mimic and follow like a herd mentality. RPK’s attacks is about his political connections. RPK never attacked his capability as a lawyer. For a lawyer, the real accolade is when friends and foes alike would rather have him on their side rather than as an opponent. The fact that Shafee is very much sought after is illustrative of the esteem he is held in his profession and his clientele.
________
Comrade,
Dato Shafee is a truly outstanding legal mind. I was impressed by the way he addressed the Judge and argued his cause before her. He also treated his learned DPP, Ahmad Bache with respect and courtesy. It is my privilege to know him. He has the makings of a good Judge who can also be the Chief Justice of Malaysia, given time. We should ask that Rosli be made special prosecutor and Dato’ Ramli special investigator to eradicate the country of crimes whether blue or white collar. While investigating MAS, they should also check Pak Lah’s conflict of interest.
My cousin was in MAS. Go ask previous CFO Ong Liang Heng about the letter of support to Pak Lah’s brother, Ibrahim Badawi, who got the MAS Catering contract. This contract is lop sided in favour of LSG Skychef. Now Pak Lah is MAS Advisor. Isn’t there a provision in the MACC Act that presumes abuse and conflict in situations like that? So, dont just accuse Tajuddin and Mahathir. Pak Lah is worse, he got contracts from MAS for his brother.
That was why he screwed up Ramli who went to see him. Unknown to Ramli, Pak Lah wanted that info to pass to IGP Musa Hassan and AG Gani Patail that ended in Ramli and Rosli being charged. So that’s how they buried the MAS case. As RPK says- All Roads To Crime Lead To Putrajaya!

Encik Din Merican,
I pray, their virtue.. especially prudence…. may God lead their way. Not forgetting, their strength to face evil doings by the devil itself.
I did read about your writing on our CM, Pehin Sri Taib Mahmud… Tell me about (sigh). I respect him…. as an old man. But as a leader…. I doubt it…. Sarawak… abundance resources…. what happen to it?
I am the lucky one to have good education… But how about the under privileges? Sudah brapa ramai PM brtukar ganti… Datuk Najib sendiri… bagaikan ragu2 nak menyiasat Pehin Sri TAib.
Hmmm.. God’s Mercy is great…but so do God’s Justice. As a Christian, I pray for our leader to lead our country fairly…. and not clouded with greed.

Terima kasih sudi menjenguk laman blog saya.
___Din Merican

Don’t equate this scumbag to an army general, Din. He’ll not make it through cadet training had he joined the army. The only kiri he gonna taste is duan kari.

You know Ilham, if Din is an opportunist thats great because he siezed the opportunity to inform the people that they need to know how the government can fix you up if you refuse to support their corrupt manner. If this is opportunistic then I say MORE please Din Merican. Way to go!
If you Ilham are angry with Din that means Din is DOING something RIGHT to expose YOUR LOT. The angrier you are the More Din must carry on. He IS on the right path.

I am happy for Dato Ramli’s acquittal. I am sure Rosli Dahlan will be acquitted soon too. I am also happy there are still good people in the judiciary like Judge SM Komathy! There is still hope yet for Malaysia…
Guys… there is no need to get angry with the unholy trinity of the mattress carrier Musa Hassa, Gani Tatail and Ahmad Kassim. Have faith in God, He has a wonderful way of sorting things out… just have faith. Even that MAS Adviser Tun and his brother caterer Ibrahim, its only a matter of time. Have faith in God, He knows what to do and when….

Dato Ramli congratulations. And to Rosli Dahlan we are behind you 100%. Congratulations to the superb defends team. The MACC, The IGP and AG are the LOWEST SCUMS OF THIS EARTH. They are the lowest of PARIAHS. To the Executive that these pariahs are working for, remember that your days are numbered. To all the BRAVE Judges we APPLAUD for your COURAGE.

Hmm.., a lot of ‘tongues’ inhabiting this blog. Well done, that shows that Din is attracting the charismatics!
“If you Ilham are angry with Din that means Din is DOING something RIGHT to expose YOUR LOT.” Kat.
You see kat, the problem is that the ‘Malay’ mentality as defined by Octo allows for jealousy, greed and self-aggrandization as the path to worldly success. Has been for the past 3 decades – where backstabbing, gossip and ridicule become the norm. A person like Din is no saint – like all of us, but he knows where his heart is. Ilham and his likes don’t know who he is – he’s the product of Tuan Cik’Gu Octo’s assembly line. Watch this again (even if you’ve seen it before), becuz that’s their condition – the product being the kids wiith the masks going into the ‘grinder’ and coming out as gound meat:
Menyalak-er - August 21, 2010 at 3:18 pm
The evidence is very clear that at the time of the charge, the ROC’s record shows that Ramli was not a Director and even if he was one, there is no evidence to show that the company had engaged in any trade.
I guess any half-past six lawyers also would secure an acquittal since no sane Judge would have called upon Ramli to enter his defence. And for the record., this is the first time in the history of the country, the MACC had brought such a stupid charge against any person.
Having said that, I must admit that I don’t like this Shafee fella. He is the mastermind behind the Sodomy 2 and a diehard Umno lawyer. RPK had also accused him of ‘judge-fixing’ in previous cases.
As for Judge Komathy, she is much better than most of the High Crt and Superior Court Judges.

Brilliant Pink Flyod,menyalak-er. Why are some so much more evolved than others? Dont answer that. thinking aloud. I suppose the world needs that to understand the higher consciousness and to evolve , intrinsically clever really!

RPK says Shafee has ambitions to be AG, Din touts him as C J material . Vote your preference to Din.
walter - August 21, 2010 at 3:42 pm
A successful lawyer like Shafee does not need all these posts. He makes more money from his legal practice. That is a safeguard against corruption.
But are we not missing the point here? Dato’ Ramli needed the best lawyer in town to defend him.
The big names like Karpal etc are all politicians. Shafee is the only one who does not hold a political party post. He sits in Suhakam and other NGOs.
So why blame Dato’ Ramli for his choice of counsel. Let’s just focus on the principle issue and that is the trumped up charges. He should be restored his rank and all privileges. He has suffered enough and yet he has not even said anything drastic in the press.
The BN Govt is a fool to make an enemy of a man like him.
kclim - August 21, 2010 at 3:55 pm
Kat, to see that the truth is outside not inside is a difficult process. It requires a modicum of intelligence and language ability to understand metaphorical language. Emotions like those within ‘ilham’ get in the way of truly processing reality which is external and not dependent of their ‘wishes’. They are intrinsically unable to assimilate and process the external environment holistically. That is why, awareness, forgiveness and unconditional love is so hard to find. And i ain’t speaking of physics much less metaphysics..
Menyalak-er - August 21, 2010 at 3:56 pm
Din, I wonder if there is any possibility of Ramli Yusuff to counter sue MACC for their trumped up charges?
I really have lost my respect for Abdullah Badawi! What he did was beyond acceptance for someone who promoted “Islam Hadhari”. That’s not only conflict of interest, but also abuse of power.
nordin - August 21, 2010 at 5:18 pm
Thanks Din for keeping us well informed. Both Ramli and Rosli should be encouraged to actively participate in helping rid our country of corruption and plundering. Hope they become torch bearers. As for Shafee Abdullah, isnt it the duty of a lawyer to fight for his client even when he knows that his client is the real culprit? I respect him for his ability as defense lawyer. But would not support Shafee for AG or CJ!

Sure… this Shafee chap may have got Dato Ramli off the hook three times without his defence being called, but I wouldn’t want to bet on him as a CJ or AG stuff… he is still a ‘cari makan’ lawyer as far as I am concerned and my views are not influenced by RPK but long before RPK broke his story. I have formed my opinion from among the views of the legal fraternity and I won’t want this Shafee fella anywhere near the CJ or AG’s chairs… no way!
Sentinel - August 21, 2010 at 6:17 pm
Sorry to come back to this Shafee guy, but the fact that he was the lawyer engaged by Razak Baginda and the guy in the telephone conversation with PM Najib as alleged by RPK, and subsequently pulled out as Razak’s counsel ,still mystifies . Maybe he knew the dark secrets and might be a liability as such if he continued as counsel for Razak .All the same he gets good reviews for the cases he has handled and a high success rate.

[8:8] For He has decreed that the truth shall prevail, and the falsehood shall vanish, in spite of the evildoers.
[4:132] To GOD belongs everything in the heavens and the earth, and GOD is the only Protector.
[4:133] If He wills, He can annihilate you, O people, and substitute others in your place. GOD is certainly able to do this.
[4:134] Anyone who seeks the materials of this world should know that GOD possesses both the materials of this world and the Hereafter. GOD is Hearer, Seer.
You Shall Not Bear False Witness
[4:135] O you who believe, you shall be absolutely equitable, and observe GOD, when you serve as witnesses, even against yourselves, or your parents, or your relatives. Whether the accused is rich or poor, GOD takes care of both. Therefore, do not be biased by your personal wishes. If you deviate or disregard (this commandment), then GOD is fully Cognizant of everything you do.
[4:136] O you who believe, you shall believe in GOD and His messenger, and the scripture He has revealed through His messenger, and the scripture He has revealed before that. Anyone who refuses to believe in GOD, and His angels, and His scriptures, and His messengers, and the Last Day, has indeed strayed far astray.
[4:137] Surely, those who believe, then disbelieve, then believe, then disbelieve, then plunge deeper into disbelief, GOD will not forgive them, nor will He guide them in any way.
[4:138] Inform the hypocrites that they have incurred painful retribution.
[4:139] They are the ones who ally themselves with disbelievers instead of believers. Are they seeking dignity with them? All dignity belongs with GOD alone.

“You were once a top lawyer yourself and could elaborate that a charge must specify the full details so that the accused is left in no doubt as to what he is charged for. Fundamental to the right to be heard is the right to know what is the offence in order to make a proper defence” comrade
Dear comrade-in-arms,
Eh, top lawyer? I am only a wannabe lawyer working hard to get a mention in Forbes. Unlike Din Merican my only claim to ‘stardom’ would be to see Latin words like ‘juris doctor’ follow my name next Fall. I was once a weekend soldier in the late 60s. You could say Tok Cik and I were comrades-in-arms though today our Tok Cik is safely in the arms of his mistress – more often at the back of his old Cooper S than in the front.
Din Merican is right about my role on this blog being that of an agent provocateur. Din Merican lends his name to those wanting to see justice done the right way – as opposed to the left. I offer myself as a lightning rod to those seeking to do justice any which way. Because I believe there is but one way to do justice. There is no right way. Or left way.
On a more serious note.
Like I said earlier, Ramli ( a top crime buster) is just one man’s fight to prove his innocence. There are others who have fallen by the wayside. In Teoh’s case he actually did fall – from twelve floors up. Today they are just casualties. Unsung heroes, if you will. In time Ramli and Rosli too would be forgotten. The rest of us are left to fight an uphill battle – and may need Tok Cik’s help, being the decorated soldier that he is.
Having said that, let me say this again. Rosli will most likely be acquitted. I say ‘likely’ because there is no telling what they will do. If they could have Anwar Ibrahim punched himself in the eye, have Teoh strangled himself, why can’t they make Rosli’s defence counsel kick the ball into his own goal? With DPP Ahmad Bache, it was an accident. But if you know Ahmad Bache, that is his forte.
Mr Bean - August 21, 2010 at 8:54 pm
“If Anwar Ibrahim could punch himself in the eye, why couldn’t have Teoh strangled himself?”
If a Royal Commission can be set up to find out who punched DSAI in the eye then I think since MACC Director of Prosecution suggesting that Teoh Beng Hock died of self-strangulation another Royal Commission must also be set up to find the truth.

Now that Dato’ Ramli has been fully vindicated by four Judges, the jPA and Police Commission should restore his full rank, entitlemrnts and privileges. He should be given the PGPP and accorded the full respects of a Police Commissioner (equal to a 3 star general). He should be given back his command. Upon his retirement he should be accorded the Paluan Berundur in the best traditions of a uniform service. He is entitled to all that to redeem the sins of those who tried countless times to fix him. He deserves all that, and nothing less.

In 2002, Pak Lah as DPM twisted MAS hands to allow his brother’s company Fahim Sdn Bhd to be given option to take over 51% of MAS Catering S/B which he later sold to LSG Skychef at a huge profit.
No wonder Pak Lah didn’t want to do anything about Ramli’s recommendation to prosecute TR because the project for privatizing MAS catering was hatched during TR’s time and TR had all the ammo against Pak Lah. The LSG contract is no different from the ACL case fought in Switzerland just that LSG has not gone into dispute stage.
Advent Management Sdn Bhd is now suing Fahim Capital Sdn Bhd & 5 Ors in KLHC CS No.D1-22-745-2004 because Fahim(Ibrahim Badawi) reneged on commission fees after Advent introduced Fahim to LSG. Case coming for trial on Monday. You should report on the case.

peerage,
Beating Retreat or Palaun Berundur is steep in traditions dating back to 17th Century England. It started as a drum beat to warn soldiers to retreat at sunset. Later it became a ceremonial drill and armies in the Commonwealth took on this tradition, including the Malaysian Army, especially the infantry – Royal Malay Regiment and the Rangers.
Throughout my 30-year sojourn in the Service I had attended several beating retreats and had a few organised in my regiment and brigade where the combined pipes and drums platoons of the battalions are used. However, they are not to placate generals or the army top brass but rather to honour heroes (dead and alive) and they are conducted at sunset. Regimental colours are paraded and are neatly kept away after the drill. The ceremony ends with a cocktail party or a mess night.
Honouring Ramli with a beating retreat is too far-fetch and inappropriate. Let’s keep military traditions where they are.
Too bad with creeping Islamisation all these traditions will one day be tall yarns to be told and retold by old geezers like yours truly.
Cheers.

But still, it is only right and fair that the JPA and the government give Dato Ramli Yusuff back his title and his benefits as a Police Commissioner including his pensions. Afterall he was suspended pending the trials, he was never removed from the service.
Najib should do the right thing but knowing him, he never does.

Tok Cik,
All retiring Commissioners holding Director’s post are given state farewells. May be the police farewell salute is not quite your military’s Paluan Berundur, and there is no quarrel in that.
The point is Dato’ Ramli was suspended while he was a serving Director who was slated to be the DIGP and thus IGP. He was the most senior of the Directors, even more senior than the IGP himself. Musa wanted to eliminate him to secure his own extension which is now coming to his 3rd. He is showing that even if you scrape the barrel, there is none in PDRM who is fit to succeed him. He is taking the IGP post as his hereditary rank and title. That is truly the trait of a despot and it is so pathetic that MoHA Minister Hishammuddin can do nothing about.
Musa Hassan withheld the Pingat Gagah Pasukan Polis from being awarded to Ramli on the grounds that there was an MACC investigation that Musa himself instigated and fabricated with his freind the AG and the MACC.
Now that Dato’ Ramli has been fully vindicated by 4 Judges without his defence being called, isn’t it the decent thing to give Dato’ Ramli back all these entitlenents and privileges? Can’t the Police Commission, the JPA, the MoHA and the PM do the right thing to dissociate thenmselves from the evils of Musa Hassan.otherwise, the whole govt is implicated in Musa’s evils. Or are they so emascualted and cower for fear of that Mattress Carrier who may keep their darkest secrets?!
peerage - August 22, 2010 at 11:38 am
I agree with Bean when he said to Tok Cik- why not? Why shouldn’t Dato’ Ramli be accorded the Paluan Berundur?
It would be the right thing to do for Minister of Home Security Dato Hishammuddin to accord Dato Ramli a courtesy visit where the KSU will deliver his letter of resumption and end the suspension. It would also be the right thing to do for the DIGP to pin on his chest the medal insignia of Pingat Gagah Pasukan Polis.
Dato’ Ramli must be directed to don his uniform and then make his round of state farewells. It is time the Minister take that initiative to heal the PDRM. That would be very inspring!
comrade - August 22, 2010 at 12:00 pm
If I were Ramli, what would I do? Legally, they will have to reinstate me without loss of salary, rank and seniority, pension and benefits etc. Would I accept reinstatement? No. But I would pursue compensation for the loss of wages etc suffered while under suspension – with interest. I may make a symbolic gesture by returning to office for a day and then I will retire gracefully.
By accepting reinstatement and pretending that nothing has ever happened, I would be opening myself to ridicule from the rank and file and the senior brass.
Mr Bean - August 22, 2010 at 1:31 pm
Bean,
When you are not playing devil’s advocate, you are in your finest element. That is exactly what I intended to say in case it did not come out that way. It only shows your clarity of thought which may have been muddled the way I presented it. I hope Din could convey this advice to Rosli who would then advise Dato’ Ramli that is how the curtain should be brought down. That would be a poignant and digniifed ending.
comrade - August 22, 2010 at 1:58 pm
peerage,
I mean no disrespect for Ramli neither do I want to disregard his astuteness when squaring off with his superiors. I had similar experiences with my own bosses who think they were beyond reproach.
I had David Daud and Borhan to contend with. When you have a ground battle to fight and with these two “goons” breathing down your neck you can imagine what cross your mind – sometimes.
A beating retreat may not be an appropriate send-off for someone like Ramli. There are other ways to show appreciation for an officer of his integrity and standing. I would suggest a full-honour guard which is normally reserved for the King or, at the very least, a half-guard. The parade should be held at the Police Training Center Jalan Gurney or somewhere more symbolic.
However, this must have the blessing of the top guns. Would Kerismuddin approve after all the hammerings? I doubt.
Today anything sensitive have the approval of the Ministry. We have degenerated to such a level that it’s no longer a joy to identify oneself with either the Police or the Army. I say this for myself having to deal with my former subordinates and students who are now holding general staff appointments. They are so meek and subservient. They treat their political masters better than their own parents and siblings.
Btw, I did a couple of courses at the Police College, KKB and had interacted with officers like Syed Barkatbah, Koo Ah See, Nordin, Jamaluddin, Jamlus, Lawrence Lim, Nafri, to name just a few. They were a class in their own right. But of the present crop of officers from Musa’s generation, I have my reservation. And I say the same of my army blokes.
Bean,
Thanks for promoting me to a 5-star general. That rank is meant for the Agong only but who cares? After all, this is Bolehland.
About my well-choreographed retreat to the back seat of my vintage Cooper S. Well, that’s what I do best whenever in a bind.
Cheers.

Don’t read too much into the role of Shafee Abdullah……it could be as simple as returning a “favour” to someone(Ramli) who honestly help him when he was “down & out”….. that’s why you have the “contradictions” with RPK ‘s “bad guy” portrayal of him.
