Call for Probe on Mahathir is wrongheaded

December 23, 2009

Probe on Mahathir would be a Farce

by Terence Netto

The call for a probe into the billions allegedly wasted on hubristic projects in the 22 years Dr Mahathir Mohamad was prime minister is wrongheaded. Would-be investigators would find they are on a hiding to nothing, not because no waste occurred; it will be difficult to pin precise blame for it on any particular person.

mahathir lee kuan yew visit comment 110609 01Here it is useful to recall the episode of former prime minister Tun Hussein Onn being forced to tender an abject apology when cabinet minutes were released to show that the initial decision to corner the London tin market, which became known as the Maminco Affair, was taken in the last few months of his premiership in 1981.

The Maminco Affair is one item in a now spiraling inventory of losses amounting to an estimated RM100 billion regarded as incurred during Mahathir’s tenure as PM.

hussein onnThe Maminco Affair only came to light a few years after  Tun Hussein left office, by which time he was publicly on record as critical of the way things were being done under Mahathir.

The sorry spectacle of Tun Hussein, a man of honour and integrity known to be laborious with the fine print, apologising for something that occurred when he was in semi-retirement mode drew an anguished plea from the retired first PM, Tunku Abdul Rahman, that  Tun Hussein ought not be blamed for decisions taken in the twilight of his premiership.

In extenuation, the Tunku said he was also in semi-retirement mode from May 1969 to September 1970, the waning days of his premiership when his activist successor Abdul Razak Hussein virtually ran things while the Tunku was sequestered in the wilderness of his grief over the May 13 riots.

The supposed pillage of the public treasury under Mahathir owed more to a climate of opinion arising from May 13 than to the machinations of one man.

Public till a giant candy jar

Mahathir came to power representing a strain of political opinion that was apt to look on the past as unjust and at the future as the arena for rectification.  This stance was inclined to regard constitutional fetters on its freedom to act as colonial constructs, foisted on Malaysia by an inherently unjust order aimed at protecting its economic interests.

This rabid view combined with a blatant disregard for the dangers of forging a nexus between politics and business.
bukit gantang by election mahathir ceramah and luncheon 060409 04The upshot: a mortified public now discovers that the public treasury in Malaysia has become a field of ravenous appropriation in supposed furtherance of historically demanded equity.

A fortuitously timed book by a foreign journalist on Mahathir’s premiership has dovetailed nicely with the national mood of piqued curiosity about how the public till has become a giant candy jar into which a legion of predators has dipped.

I mean when two fighter aircraft engines belonging to the Royal Malaysian Air Force are purloined right under the eyes of people in charge of the defence of the realm, the public naturally suspects that nothing is off-limits to Malaysia’s brigands.

Thus Lim Kit Siang’s call for a probe into alleged wantonness in the use of public funds by Mahathir receives an assist from the public perception that indeed larceny has occurred on a monumental scale.

Dr M’s diversionary strike

Mahathir’s feisty response to the call for a probe typifies the man. He steals his detractors’ thunder by launching a preemptively diversionary strike: he welcomes the probe, reserves the right to sue, but wants successor Abdullah Ahmad Badawi’s tenure similarly investigated.

It’s like the Greeks say, character is fate. Octogenarian Mahathir is fated to end his years as he has lived it – in combate mode. But Malaysian history need not resemble Greek tragedy where the protagonists go through to a final reconciliatory acceptance of their fate.

mahathir cyberjaya lecture 220409 press conferenceWe have just to abjure the view that our 1957 Merdeka constitution is a colonial construct and forever hold in suspicion politicians with an overlay of vindictiveness to their make-up.

Instead of the futility of a probe on colossal waste, let’s switch to charging those whom no less than a Royal Commission had found culpable in the Lingam videotape affair.

The commission held that there were clear violations of the law and the implicated Mahathir has pronounced his readiness to face his interlocutors because he wants the chance to tell on who tried to influence him on judicial appointments.

A man who cannot avoid seeing politics as a matter of public antagonism cannot resist, as usual, the low diversionary blow. Let’s give him the chance to reveal that he not only did not know that politics must be kept separate from business, but also from matters judicial. It’s a dichotomy Malaysia’s first PM to come from outside the study of the law could not appreciate. And that is the chief source of the troubles now besetting us.

  1. If one were to nail Dr M, it would have been on the next minute he handed over his post to Badawi. Not after six years and 2 PMs. To bring him down with some blurry video recordings and a “biography”, in relation to this astronomical RM100 billion, who are kidding?

If DrM detractors really want to nail him down, do it properly with hard facts lah! Otherwise they will get caught with their pants down. And this time, they will.

So why worry about the probe?
    ________
Carlos, the issue here is not “to bring him (Mahathir) down”, but ask him to account for his actions and if there is any element of any criminal wrongdoing, then he must be charged in court where he can defend himself. Not to worry, he won’t lose because the judiciary is under the thumb of the UMN0-BN government. The Malaysian public has the right to know what happended to their hard earned money and savings. BTW in case we both forget, Mahathir is no longer in power.–Din Merican

  2. “Instead of the futility of a probe on colossal waste, let’s switch to charging those whom no less than a Royal Commission had found culpable in the Lingam videotape affair”.–Terence Netto

I agree with Netto. The Royal Commission on Lingam Tape found Mahathir and others culpable in the judicial appointment fixing scandal. Unfortunately, the Najib Government had decided to put an end to the Lingam Affair. Justice undone.

Now, Mahathir talks big because he knows that he is kind of immune from prosecution when it comes to account for the affairs of his 22 year administration. Too many people in power will “go down” with him. UMNO-BN cannot afford to lose many of its leaders and cronies with entrenched interests.

So, let the people decide in free, fair and clean elections on a new government. It is time for us as citizens to make amends for our apathy and for the sake of future generations and ensure that we can renew our faith in government. That government must be competent, open, transparent and honest.–Din Merican

  3. There is no way Mahathir will be called to account for his corrupt practice, his cronyism, his asking taxpayers to bail out his children during the financial crisis and how he siphoned public money to fill in UMNO’ war chest and his family’s.

He already got all the things in placed so that he is immuned.

Give him some credit, he planned it way back in 1988 when he sacked the Lord President and castrated the judiciary, and when he cut off the tongue of the Royalties.

By which time those who worked in the Police, the then ACA and the government ministries, the kangkung professors and vice chancellors of our so-called “universities” were nothing more than either UMNO supporters, UMNO-symnpathisers and they were made by Mahathir to believe that UMNO is bigger and more powerful than Allah.

According to Mahathir’s edict in his 22 years, Malay Muslims CANNOT be protected from infidels and mALAYSIAN non Muslims by Allah and by prayers; they can only be saved or otherwise “Melayu akan Hillang”, by the grace of UMNO and the $$$$ offered to Malay Muslims if they pay homage to UMNO.

Mahathir learnt well from his ancentors’ homeland in Kerala State in India. He understood the susceptibility of the ethnic Malays to feudalism and the fear of Malays to authority since the days of the Sultanate. So Mahathir deftly manipulated the ethnic Malays learnt from his genes on the Indian style of governance ( read the caste system of Indian) such that the homage to royalty eg Sultans is shifted to UMNO. First thing, degrade the Royalty, and UMNO under Mahathir did a fine job by pushing mud on the sultans’ faces through the constitution and then give them contracts and projects and land to shut them off.

Those blind UMNO cronies are willing to martyr themselves if Mahathir is ever made to go to court to defend himself.

Mahathir has made himself a rajah of the old Indian feudal system… its all in his Iskandar Kutty genes. Only the pariah UMNO Malays cannot see it while others could.

  4. Din, didn’t you read what the RCI to be made of, as requested by Dr M. I think he’s going all out, leaving no room for anyone to criticise unfoundedly later.

You and Netto also has to be precise on the definitive conclusion of the Lingam tape inquiry. Did the inquest question the man in present? in the end, it was all down to innuendos and nothing else. And you expect people to decide in free and fair, which they have, with significant trend in the last GE. But that has not put PR in better light, in fact worse than BN.

Don’t worry Din, people are smarter nowadays. They know what they want. They have learn their lessons well.

  5. ” only the pariah unmo malays cant see it ” – frank

how right frank is . all blinded by the nickels and dimes , the pariah prime minister of 22 years distributed among the malays. and for this , they remain blind.

  6. Maybe its a good thing that Mahathir came from “outside the study of law”… Lawyers just can’t seem to get to the point or use short sentences. I’m assuming Mr. Netto is a lawyer… if he’s not, then he should be one. His obfuscation will put Sir Humphrey Appleby to shame.

  7. and terence netto should not make excuses on behalf of the arsehole dr mahathir mohammad.

  8. ” He welcomes the probe , reserves the right to sue but wants abdullah badawi’s tenure similarly investigated. ” – Terence Netto

Only an asshole like Mahathir can get away with lines like this . Can’t understand what Malays see in him.

  9. Mahathir may have nothing to pin against Anwar (hence, the farcical kangaroo trials), but on Najis he may have something to hold to his balls. Remember, the whole world is well aware of the Altantuya murder and how Najis and his wife/boss are directly involved in this. Do you really believe that this senile megalomanic pariah will be allowed to be exposed for his crimes against the nation?

  10. Carlos,

I was not born yesterday. I know Mahathir since my days in Alor Setar as a teenager in 1950s. My friends and I admired him as a caring medical practitioner running his own Maha Clinic down town. I respected his achievement as one of the Malays from backward rural town of Alor Setar, who could enter medical school in Singapore.

I followed his political career closely (even when he was a Member of Parliament from Kota Setar, 1965). When he was sacked from UMNO in 1969, I wrote him a letter from Washington DC expressing concern about his dismissal and urged him to continue with his political mission.

In 1970 when I returned from the States, I had read his banned book The Malay Dilemma. I believed at that time that the Malays deserved state help to compete with other Malaysians in education and business. The NEP was supposed to empower the Malays, a sort of handicapping system, not one that would disenfranchise and weaken them. I never thought that Bumiputra Commercial and Industrial Community would result in an elitist UMNOputra-ism, thereby creating a two classes of Malays (the elite UMNOputras versus the ordinary Malays).

In 1981, I welcomed his rise to be our Prime Minister. His slogans, “Kepimpinan Melalui Teladan” and “Bersih, Cekap, dan Amanah” excited me, and I believed in him and openly supported him. He presented himself as a liberal and democratic leader at that time. After the UMNO crisis and Ops Lalang in 1987, the Mahathir I knew and admired changed. His actions against Tun Salleh Abas in 1988, against the Malay Rulers, and Anwar Ibrahim in 1998 showed him to be increasingly intolerant of dissent. Even then, I remained his supporter.

During the 10 years (1988-1998) I was overseas and was out of the loop on Malaysian politics. I had to re-look at political and economic developments when I returned. His treatment of his erstwhile Deputy Prime Minister, Anwar Ibrahim took me by complete surprise and began to make me more skeptical and I became more critical.

At that time, there were already signs that the economy was overheating and the stock market was booming. The things began to change suddenly in July 1997 when the Thai stock exchange was badly hit by speculators and the contagion began to spread to Indonesia, South Korea and our country.

So, the steep recession of 1997-1998 was a shock to me and I began to see the excesses of Mahathirism as an economic model. I read widely, and discussed it with my friends like Professor K.S. Jomo and Dr. Terence Gomez at University of Malaya, and others in MIER, and ISIS Malaysia (Dr.Zainal Aznam, the late Professor Ismail and Al-Alim); I was convinced on the basis of empirical evidence and writings of Jomo and Gomez that crony capitalism and corruption had caused a crisis of confidence in Malaysia as a direct investment destination.

Mahathir’s mega-project and heavy industries and export oriented policies have failed. In stead of thinking a totally different approach , one designed to boost national competitiveness, his advisors adopted a more interventionist role of government in the name of protecting NEP-NDP (after 1990) and Vision 2020.

I was completely disillusioned and asked myself how could I have been so wrong about the economics of Mahathirism. In late 2007, I read Anwar’s Malaysian Economic Agenda, and became fully convinced that something drastic had to be done to address the problems of rampant corruption, crony capitalism and misguided and politically motivated affirmative action policies if we are to be competitive (by enhancing national productivity and moving up the value chain via research, innovation and technology).

The MEA offered a new Way Forward. It is based on good governance, education, healthcare, political, economic and social reforms, leading to a humane economy that is just and equitable for all Malaysians. When the call came from Tan Sri Khalid Ibrahim, who was PKR Secretary-General and now Selangor Mentri Besar, I joined Anwar’s cause.

In September, 2007, I became a member of PKR and during the period leading to the historic March 8, 2008, I was attached to Anwar Ibrahim’s team at his Office and had the opportunity to be with his young and highly motivated team of assistants and associates. I also worked closely with Tan Sri Khalid Ibrahim and campaigned in Kedah, Penang and Selangor.

I am still working with PKR and look forward to the next Elections. I believe that given what is happening in 1Malaysia, change will come.—Din Merican

  11. Din

You are a good soul and a bleeding heart.

I take politics with about 1 jug of salt and take in only 20% of what politicians on either side of the fence said, least of all if they make promises.

As for me, the jury is still out on how PR will govern.

If PR does not have the balls to remove people like Zulkifli Noordin and Hasan Ali, then I don’t look forward much towards change by PR. That is unfortunately the sadness I have.

  12. Din,
    Its good to know you.

  13. Din,

You are a good chap ! We all hope for all our sakes, that you will not be wronged twice !! About MahaTongkang, he may be untouchable for now but be rest assured his descendants will pay for his sins and crimes.

What goes around comes around, according to the Laws of Natural Science – the Laws of Retribution !
At the moment, it is better to be content with what is already on our full plate than to crave after that plumb turkey running loose in the backyard, so to speak.

First thing first, get our house in order first before we can venture out. But if we need to get the octopus especially a huge ferocious invincible one, a good strategy to apply will be to cut off its tentacles one by one ! :)

  14. This above is the best and precise statement I ever read from Din.
However, like many others, I will not support anyone simply because he is from Pakatan and oppose anyone from BN simply because he is from UMNO.

I will support the truth as I see it and will always hope that good people be given the important task of running and ruling the country. This is crucial as people with power could do serious damage to the masses if they are heartless and bad. For now I will support Pakatan but I have the right to whack them if they take our trust in them for granted. Like RPK said I don’t even trust some of them to walk my dog.

  15. “…What goes around comes around, according to the Laws of Natural Science – the Laws of Retribution !”- ocho onda

I am so relieved !!! You have come to my side of thinking.

The power of Nature and the Power of Science…

Nature does NOT discriminate and does not give a damn whether one is a Christian, Muslim or Hindu or Atheist or whether one is a Malay or Chinese or Indian. When there is an earthquake, tsunami, or hurricane, Nature rolls along destroying in its path, churches, mosque or temples… Nature does not care what God you pray, or what ancient fairy tale books you call Holy you read.

Nature does NOT discriminate. Religion does. Therefore Atheists do NOT discriminate.

Nature driven by Science is the fairest of all. When there is bounty, Nature gives to all. Nature allows Science to benefit all. A vaccine works for Muslims and non Muslims.

The problem in Malaysia is because Religion has become a State policy and thus we have so much discrimination on race and on religion.

When there is an earthquake or tsunami, there is no prayer in the world which God can overturn Nature.

There is a saying for those who believe in God, “When Nature makes its presence felt on humanity, God has to come around and pick up the pieces left behind.” That shows how much power God has over Nature. So all the promise of the mythical Paradise and Heaven is just a fanciful whim of the brain cells between our ear.

Having said that, lets enjoy the holidays of Christendom and also of Islam and Hinduism, that is the best and only decent contribution of Religion to our regimented secular life.

  16. I believe everyone has some “good” and some “bad” features..same with BN and PR. Let’s choose the better one between the 2 comes next GE. That’s within our control.
The rest ( Lingam, Port Klang, Airforce engines,PR’s in-fighting etc) let’s just talk about it. Practically, we cant change much now…but by reminding ppl of such things , day in and day out, comes GE, ppl can decide for themselves.
    Cheers
