To the arrogant Mr. Home Minister Syed Hamid Albar
|
Dear Mr. Home Minister Syed Hamid Albar, We are not stupid. If you have grounds to say that Raja Petra is publishing “libellous, defamatory and slanderous” stuff, please take him to court and seek legal recourse. You are supposed to be a lawyer. So please start behaving like one and do not make arbitrary decisions whch are essentially politically motivated. Stop grand standing since it only reflects your personal inadequacies. I have been reading Petra’s blog and I know how careful he can be. His comments and analyses are fact based and the information is from impeccable sources. Your government is increasingly repressive and people of this country are sick and tired of the pontifications of our Prime Minister, Deputy Prime Minister and ministers of the UMNO-led and dominated Barisan Nasional government. One would have thought that Badawi and others including yourself would have learnt something from the March 8, 2008 General Election. But it is quite clear to all of us now that the loss of 5 key states of Penang, Perak, Selangor, Kedah and Kelantan and the two thirds majority in Parliament was not humbling enough. UMNO was again severely beaten only two days ago in Permatang Pauh when Anwar Ibrahim trounced the Mandarin speaking Ariff Shah of UMNO with a majority of over 15,000 votes. If the election was more open, transparent and free from harassment by the Police and the FRU and UMNO’s dirty tricks and threats (using paid agents) with the help of Rashid Rahman and his staff at the Elections Commission, Ariff Shah would have probably lost his deposit! In stead of learning from this latest fiasco, UMNO and the government are flexing their muscle against the Malaysian people. You cannot win, Mr. Minister, when you take on the people of Malaysia. Please remember this: the winds of change that have hit our shores since March 8, 2008 are unstoppable. You should behave yourself and make sure that you use the power in your hands with a high sense of responsibility. Be accountable. That is my humble advice. Remember BERSIH, Hindraf and the actions you took in recent months that caused massive traffic jams in Kuala Lumpur including the highway arrest of Anwar Ibrahim by balaclava-clad men of the Police Force, and rectumus politikus (politik jubur) UMNO played in Permatang Puah and the Koran swearing nonsense by Saiful Bukhari, Deputy Prime Minister Najib, and former Menteri Besar of Perak, Tajol Rosli. People put you in office and they can remove you. People are also laughing at the antics of UMNO. I spent 10 days among people in Permatang Pauh and saw what UMNO with the help of the Police and FRU and Vet 69 personnel, Special Branch, and Military Intelligence and its agent provocateurs were doing. I visited places in Permatang Pauh where you would probably never dare to go. I talked and listened to the hard working ordinary Malaysians in the kampongs. The message is clear: first, the government is no longer connecting with them, second, UMNO leaders and politicians are corrupt and cannot be trusted, third, they want a change in the leadership of our country and fourth, they no longer believe the mainstream media, tv 1, tv2,and tv3. Permatang Pauh is a clear sign that people have hand enough of this government. It is time for Badawi and his colleagues to take stock of the government’s performance record since 2004 and act. —Din Merican _____________ www.malaysiakini.com Malaysia Today banned for ’slanderous’ postings |

| Home Minister Syed Hamid Albar said today that the prominent political website Malaysia Today had been banned because it published “libellous, defamatory and slanderous” content.
“But when you publish content that is libellous, defamatory and slanderous to other people I think it is only natural we take action,” he said. He defended blocking access to Malaysia Today that has attacked top leaders, saying it had ignored warnings against publishing “slanderous” articles. “So many warnings and opportunities have been given and it is not heeded, so I am sure they have exercised their authority well under the law.”
Mirror site still up and running Raja Petra Kamaruddin, founder and editor of Malaysia Today, said a mirror site had been established with a foreign provider.”I will fight the government action all the way. Their action will not stop me from writing,” he said, promising to challenge the shutdown in court.
Raja Petra is already facing a sedition charge and a defamation suit after linking Deputy Prime Minister Najib Razak and his wife to the sensational murder of a Mongolian woman. Media watchdog Reporters Without Borders ranks Malaysia 124 out of 169 on its worldwide press freedom index, and says the main media are “often compelled to ignore or to play down the many events organised by the opposition”. The government has previously threatened that bloggers could be punished under draconian internal security laws which provide for detention without trial. |
“I think we don’t intend to curtail people’s freedom and right to give information and debate,” Syed Hamid told reporters.
Malaysiakini reported yesterday that government-backed watchdog Malaysian Communications and Multimedia Commission
A check by Malaysiakini revealed that Malaysia Today

Uncle Din
Thanks for the great job in Permatang Pauh.
No matter how sickening it can be, we need bahlols from UMNO to fire up the citizens to support the cause started by DSAI.
It simply shows that UMNO is not interested in truly representing the rakyat, UMNO is only interested in perpetuating its political control. Like it or not, we have to put up with the stupidity for the time being.
Anyway, there is no way the government can stop access to the news portal, all we got to do is to change the dns configuration.
Thanks

to the arrogant RPK,
when somebody wanna take you to court over some libellious statements you made in the blogs, you chickened out by not submitting to the court’s order. In fact, you acted like you are afraid to defend your libellious, defamatory and slanderous stuff in the courts.

“Mohamed Sharil said MCMC had instructed all ISPs to block access to Malaysia Today based on complaints received by the general public regarding offensive comments posted on the website.”
Complaints received by the public? Somebody should challenge this action. It is not difficult to demonstrate locus standi. Pakatan can pay for the court and attorney costs.
What is there to prevent the ISPs from ignoring the order – after all the issue of Malaysia-Today printing “libelous, defamatory and slanderous” material has yet to be deliberated by our courts. Is there not an element of sub judice here?
Then there is the issue of whether they can legally make any ISP answer for what their users print – and to what extent they can?
Any legal eagle here?

And dear Syed Hamid,
You can hide behind that fancy suit of yours , or that so-called Home Minister title. BUT one thing is for sure, your time is almost up. We are going to take this country back from the likes of you simply because we, Malaysians deserve so much better.

“So, what the CLMA chairperson, Afzal Abdul Rahim is urging is that bloggers should practise self censorship with respect to news about the Badawi government. That is unacceptable in my book” Din Merican
Malaysians talk in codes. When they say “Hey, freedom of speech doesn’t mean you are free to say anything” they are opening the door to censorship. Self censorship is censorship. Hello??
In the ‘Home Of The Brave and “Land Of The Free’, the United States, the beacon of democracy for the Free World, it means exactly what it says. Freedom of speech means exactly that i.e. you are free to speak on anything. The U.S. Constitution prohibits the passing by the legislature of any laws pertaining to freedom of speech. First Amendment reads ´Congress shall make no law…..abridging the freedom of speech, or of the press or the right of the people peaceably to assemble and to petition the government for a redress of grievances.”
This runs contrary to our own Constitution which starts by spelling out the circumstances which Parliament may impose limits to this freedom. Over time this has given rise to a plethora of legislation like the Printing Presses and Publications Act 1984, Sedition Act, Internal Security Act etc. which when added together make a mockery of our freedom of speech. The reality is Malaysians have no freedom of speech and no amount of coded language used can disguise that fact.
But a more serious constraint to our freedom of speech, however, comes from a place least expected i.e. Malaysians themselves, who unaccustomed to free speech after living under authoritarian rule for decades, like to censure each other for abusing that privilege. The truth is freedom of speech is not a privilege but a fundamental right of all free people.

Devolution Not Advancement (DNA) Bill!
Permatang Pauh shows that it is not about DSAI anymore. It is about realising that we as a nation is standing on the cusp of a new identity as a nation of Malaysians. It is about realising that we the citizens of Malaysia want justice to be done. It is about realising that the democratic institutions, and the people we elected into Parliament, do not abuse the powers entrenched in the system to victimise a single person. It is about realising that if the DNA bill gets passed in its present form, it is not just DSAI’s human rights that will be trampled upon, but ANY of our human rights can be trampled upon willy-nilly by the supposedly democratic institutions that were set up to protect us! And this includes the human rights of any UMNO or MCA or MIC MPs or Senators that have run afoul of the elitist few that holds the power to yield the DNA sword!
Think: how incredible it is that the BN Government is so fearful of one man that they are willing to create a new law in an effort to snare him, after failing to get him to submit his DNA! Syed Hamid’s denial that this is so despite it being so painfully obvious, once again makes the BN Government the laughing stock of the international community, lurching Malaysia towards Mugabe-style (mis)leadership!
Yes, this DNA Bill have shown that the Malaysian Parliament has Devolved Not Advanced (”DNA”) as a transparent and accountable democratic institution!

Then there are others – conmen and confidence builders.
What does it take to build up the MP’s confidence?
Would it still be wealth? You know, like not a total loss but a small gain that has greater life, does not dissipate on the change of a new government? Wealth that has longer staying power? Making more people wealthy thereby augmenting their own wealth while sustaining other self-reinforcing elements across the total socio-cultural expanse?
That’s the trait in mature economies. The opposite is boom-bust on a shorter cycle systemic in character. And of course poverty piles up in heaps! And that snowballs …down to the election process!

“Malaysia-Today publishes amazingly accurate news from very impeccable sources. ” Din Merican
“Amazingly accurate”? “Impeccable”? If I were you I would put up a strong caveat to that!
I find RPK’s blog entertaining but I wouldn’t rely on it for news like I do on Jakarta Post, Bangkok Post, Manila Post, Straits Times Singapore, Hong Kong Standard, New York Times, Washington Post or Wall Street Journal or Asahi Shimbun.
What’s more? I believe RPK himself does not expect anyone to make his blog the major source of news! I would like to look on Malaysia-Today as an example of investigative journalism that is also entertaining to read.
RPK invites his readers to read his blog with buckets of salt and separate the truth from fiction themselves. Most of the time half-truths and fiction are combined making it an interesting read for readers looking for comic relief. At times I feel RPK seems to be laughing at his readers who when starved of news tend to believe everything they read! At other times, he would seem to be throwing a monkey wrench into the machine and see if it grinds to a halt. He would watch all that with glee!

I’ve been following Malaysia-Today for the past one and a half years and the things RPK wrote about the government is nothing but the TRUTH and the whole lot of them is true esp. when he wrote about Bukit Aman.

Barack Obama sure was on the attack this time, fearlessly attacked John McCain on many issues – said JM kept talking about sending Osama bin Laden to hell yet, he won’t even follow him to the caves where Osama lives! … mere lipservice!
What Obama said tonight aptly applies to UMNO/BN too – Don’t we too in Malaysia have had enough of politics of the past, same old BN politics so expect same old results!
CHANGE is all we need and let’s rise up to it Malaysia!

Is there any other way the rakyat can keep the administration in check. The winds of change can blow from both ways, and when it does not favour you, you will sing a different song. “”Home Minister Syed Hamid Albar said today that the prominent political website Malaysia Today had been banned because it published “libellous, defamatory and slanderous” content.”"
I believe the fundamentals of our legal institution states that anyone and everyone is innocent until proven guilty. And even if our legal institution is flawed with back-handling and corruption, even if the ISA allows detention without trial – shouldn’t these seditious acts be tried in the circus courts we have now before judgement is made?
I think RPK has every right to issue civil proceedings against our venerated Syed Albar, current Home Minister, once Foreign Minister – man with many experience and wisdom, for making a slanderous remark. I think I’m quite right to say he’s remarks are libelous, especially in light that nothing has been proven.
I gave up my right to practice law in this land because of such persecutions. Let’s not let the rest of the country who are stronger than me loose their rights out of frustration as well.

If RPK committed crime. Charge him. Use his article as evidence. Why block site? MSC is already not that successful. What is govt trying to do now? Kill it off?
I have a dream - August 29, 2008 at 8:11 am
It is important for RPK to take MCMC to Court to establish the Precedent. MCMC/Government must put their money where their mouth is. It is too cheap for them abuse everything. It’s time they PAY for it!
Now is as good as ever!

Wonderful piece Din , thank you ! I pray RPK is well! Im outside Malaysia, and am not able to access yet into MT. Am waiting for the Prince to strengthen and come out to us fortified.
Whether he is Representative of the people of his Constituency that has made him an MP may not be of fair dinkum. The fact is — Cats wont say no to milk when the whole govt machinery is used to the hilt to stay in Power.
So now their “glossary” is , does he think that as a Minister he owns the Institutions we Rakyat set in place for our own betterment ????. The blinding question now is —- for them , looking at the mirror and asking themselves,if honestly they are the representatives of the peoples who pay their salaries and who can remove at their WILL.
Albar should remember Honecker , Ceausescu, Stalin , Idi Amin , Ian Smith,Botha etc . and he should know what and how they left planet Earth and how their lineage too is regarded. !!!!1 Speaks for itself.

Jong,
I was glued to my TV set throughout the Democratic Convention in Denver, Colorado. I wished I could be there when history was being made. Obama a fierce orator showing moral outrage at how the Bush Administration had squandered the opportunities, connected to the 85,000 people who came from all over the country to hear him speak. You and I would have to be there to actually feel the electrifying moment. Be that as it may, my TV set became red hot even thousands of miles away!!
What I find inspiring is to hear him speak about his mother (and Din Merican could easily connect to him), how she raised him single handedly, his father having abandoned him at the age of two. Often she would be on food stamps (money from the government to help the poor buy food) just to get by, saved and scraped through so she could send Barack to school. (Din Merican has had to work to earn his ‘duit sekolah’ in the shadows of Wat Siam early in life and it is this experience that served him well into adulthood and gave him the qualities needed to succeed in life – independent, tenacious and resilient in the face of adversity with a sense of empathy for the underprivileged). Often you see people among the crowd with tears streaming down their cheeks just listening to him. They see in him a reflection of themselves. Obama had connected and connected to these people well last night – as he always does.
Barack’s story is the story of many Malaysians who struggle daily to make ends meet, a parent often a mother who has had to raise their children single handedly, of a father who is not there for their kids and a mother who has had to work in the many “pasar malams” because their day job didn’t bring in enough money, just for that little extra so they could send their children to a good school, buy them the sports equipment they need and put that little extra in their pockets so they do not have to go through what their parents are going through.

Jong, had you been among the crowd in that football stadium, you’d have made a fortune selling your donuts !

There are many ways to look at legal costs!
Money comes in many forms. Mr Bean will tell you, “goodwill” is great money!
And in the Balance Sheets it tells you if a company has reasonable governance!
Eh, Mr Bean?
